A 12-year-old girl was shot and killed inside a Montgomery County home Friday morning, and her 13-year-old brother was charged with her murder for allegedly shooting her at point-blank range in the chest, the district attorney said.


The victim, Jasiyah Vasquez, died before police officers in Upper arrived at the house. She was found dead on the living room floor, District Attorney Kevin Steele said in a statement Friday night.

Her brother, Jah’sir Vasquez, was arrested and held without bail on a third-degree murder charge because surveillance camera showed the shooting occur, Steele said.

"We followed the evidence in this case, which clearly showed that the 13-year-old shot and killed his sister. Despite the child’s age, Pennsylvania law requires that we charge Jah’sir Vasquez in adult criminal court for the shooting death of his sister," Steele said in a statement.
The investigation allegedly found that the children's mother, Daisy Vasquez, had asked her son, Jah'sir, to get her 9-millimeter handgun from a car outside, Steele said.

According to the surveillance video found by detectives, Jah’sir could be seen entering "the house with the handgun in his right hand and then pointing it at Jasiyah. Seconds later, while Jah’sir had the gun pointed in his sister’s direction, it discharged, and Jasiyah collapsed," the DA's statement said.

It's almost as if mom set up a possible scenario of where she could get rid of two kids for the price of one.

But if his mother had not sent him after the gun, this would have never happened. I can see it as an accident, just a boy being a boy, a big brother pestering his younger sister. "Hey you mess with me and I'll shoot ya!" and pointing it her to make his point, but still playing with her, and it goes off. Because he doesn't know what the fuck he's doing, because he's a kid, and puts his finger on the trigger. I just can't put all the blame on him, his mother carries 90% of it.
 
At the very least, any child of any age who resides in a house where there are guns, should be taught not to touch it or point one at anyone, much less pull the trigger, or horse around with it in any way. No child should ever be asked to go get an adult's gun either. If the adults handle the gun(s) with respect, then the kids will tend to have that attitude also.
 
He’s a 13 year old CHILD and his MOTHER asked him to handle a firearm. He should not be charged as an adult, he should be placed with a responsible individual who will get him therapy and structure while his pos mom rots in jail.

I was handling firearms at age 13, but always in an instructional setting. Not just "Hey, go handle my loaded handgun where I can't see you." My daughter is 8, and while I haven't started teaching her how to handle firearms yet, she does know there are certain things she can do with an adult at her elbow that she's not allowed to do alone.

Right, but “hey go get the loaded gun from my car” seems like a super different scenario than the one you just described

A Collegeville mother whose son police say fatally shot his sister is now facing criminal charges. Prosecutors say Daisy Vasquez lied to police about the March 19 shooting. She initially told police she had accidentally killed her daughter while attempting to unload her handgun. Prosecutors say she told her son to retrieve the gun from the car. The 13-year-old boy is charged with third degree murder.
 
Daisy Vasquez, 32, will be spending up to a year behind bars after she pleaded guilty to child endangerment in connection with a case in which her son fatally shot her daughter after the defendant asked the boy to retrieve her handgun for her from her vehicle.
Vasquez was sentenced in Montgomery County Common Pleas Court to 90 days to 12 months in prison in connection with her guilty pleas, court records show.
Prosecutors announced charges against Vasquez back in March 2021 after her 13-year-old son, Jah'sir, accidentally shot and killed his sister, 12-year-old Jasiyah, after Vasquez asked the boy to go to her car and retrieve her handgun for her, Patch previously reported.

Late last year, Patch reported that the case against Jah'sir was subsequently moved to juvenile court after the boy had originally been charged as an adult in connection with the fatal shooting.
Court records show that Vasquez received her sentence on Wednesday by Montgomery County Common Pleas Court Judge Risa Vetri Ferman, who also ordered the defendant to report to the Montgomery County Correctional Facility in early July to begin serving her sentence.
In addition to the jail time, records show that Vasquez was also given up to four years of probation once she is released from custody. She will also have to undergo eight-and-one-months of house arrest immediately following her release.
A story in the Pottstown Mercury said that Vasquez wept in court this week after receiving her sentence, with the mother stating that she was unaware that the gun she asked her son to retrieve was loaded at the time.
"He didn't shoot my daughter, my gun went off," Vasquez was quoted as saying about her son.
News reports said that the boy, now 14, admitted to his actions during a juvenile court proceeding in January and was given a sentence of probation for involuntary manslaughter, after prosecutors concluded the shooting was unintentional. The probationary period may last up until the time the boy is 21 years old.

The stupidity of this statement defies description.

I hope her son can move past not only from killing his sister but from being raised by a mother with zero capacity for insight.
