Police said an Albuquerque family had already been on the state Children, Youth and Families Department’s radar due to allegations of child abuse when they were called to the family’s home and found a 9-year-old boy dead Friday afternoon.

They said the boy had suffered multiple current and past injuries, including cigarette burns to his body.

Synthia Varela-Casaus called the death of her son, which occurred after she allegedly kicked him and he hit his head, an accident.“I was disciplining him and I kicked him the wrong way; it was an accident,..... “I messed up.”

Police found the boy, wearing a pair of blue pajama pants, cold to the touch and unresponsive on a tiled bedroom floor after 38-year-old Varela-Casaus called 911 around 4:30 p.m. Friday saying her son had fallen off a bouncy horse and hit his head

.....“When officers arrived on scene, he was already cold to the touch, so they knew it hadn’t happened when (Varela-Casaus) said it had,” Drobik said. “When senior officers arrived on scene, they were shocked and horrified at the brutality.

It was horrible......the child’s current and past injuries were extensive. Cigarette burns were found on the boy’s chest, upper lip and back; a bite-mark was found on his left arm; and he was bruised above his genitals and on his back, according to the complaint ..... the boy had a history of being abused.....the family had been on the state Children, Youth and Family Department’s radar for a long time and, according to the complaint, the boy had complained of abuse in the past. When police interviewed Varela-Casaus’ two other children, they said their parents often hit the 9-year-old with a belt, and one child didn’t want to talk to police because the child was afraid of getting “spanked” like the 9-year-old, according to the complaint.



”When officers first started interviewing Varela-Casaus, she evaded questioning and did not ask about her son’s condition or seem upset, the complaint states. She eventually confessed, according to the complaint,

...she kicked him in the stomach and he fell, hitting his head on the dresser and then again on the floor..... then kicked him at least two more times while he was on the ground....

.....she appeared to show little remorse. “On the ride down here, the only concern she had was what her bond would be, so that’s the state of mind she’s in,” Drobik said.Varela-Casaus has a criminal history dating back to 1994, according to online court records. She has been convicted of prostitution numerous times, shoplifting and disorderly conduct. In 1994, she faced charges of embezzlement.

According to the complaint, Varela-Casaus’ husband told police he had been on scene 30 minutes before 911 was called. He said he heard Varela-Casaus strike the boy repeatedly and said she told him that she “only hit him as she normally does, but she may have hit him too hard ‘this time.’”Varela-Casaus’ husband is still under investigation by police, Drobik said

Could a 9-year-old boy's death that was caused by abuse have been prevented? According to police records, the boy had cried out for help at least once before.

According to a criminal complaint in Synthia Varela-Casaus’ arrest, police were informed during their investigation Friday night and Saturday morning that the New Mexico Children Youth and Families Department had an investigation into the home where Varela-Casaus’ boy was found dead Friday.

While investigation continues, the question remains as to why this incident happened.

"Because it was ... it was an accident,” said Varela-Casaus in her first court appearance Sunday.

Meanwhile, it became apparent in court that Varela-Casaus has a long history with authorities.

"We did locate two juvenile contacts, 28 misdemeanors, 16 convictions, 21 bench warrants, 14 for failure to appear, five felonies with three convictions,” said a court criminal background investigator.

According to a criminal complaint against Varela-Casaus, the 9-year-old boy's body was marked with new and old wounds from bruises to cigarette burns, also a bite mark and several cuts.

The complaint also states the family has an active case with CYFD after the boy allegedly threatened to harm himself and also disclosed he had been abused.

So could the boy’s death have been prevented?

"Per the Children's Code Law of New Mexico, we aren't able to release any information regarding any current investigation or any prior,” said Henry Varela, a spokesman with CYFD.

While CYFD says it can’t comment on specifics of the case, it says even with allegations of abuse, CYFD can only recommend that a child be taken out of its home. The final removal call has to be made by police or the courts.

"If law enforcement goes into to a situation that they have to respond to and if they feel that at that time that there's no imminent danger for the children that are in that home then they may not ... they, you know, may not give us custody of that child,” said Varela.

It’s not clear if the boy should have been in the house, but Varela-Casaus made it clear with her words in court Sunday that's she's dealing with other issues.

"I have an aneurysm located on the (unintelligible) gland on the brain, and I have all of the documentation for it, and my surgery is actually scheduled on 6:30 on January 16th, and then I have a psych evaluation January 24th,” said Varela-Casaus.

It's also unclear at this point if anyone failed to act in any way in this case, whether it’s police or CYFD. CYFD says it reviews its employees casework frequently. However, it couldn’t say at this point if it will review this particular case.

The only mistake that she made was killing him, because now she lost her breathing punching bag. I don't think for a second she has any remorse for what she did, just that she died before she got all her aggression out.

Obviously if you have to continually kick the shit out of your kid, then you are a lousy parent. Find another form of punishment, take toys away (doubt the kid had any), do time out, talk to them...idk. I can say I have never kicked anyone in the stomach especially not a child. Hope she has the most awful death possible.
 
The Albuquerque mom charged with killing her 9-year-old son also spent time online spreading religious messages, calling her kids "precious angels” and asking Jesus to protect all kids in the days leading up to her little boy's death.

Neighbors say while it was common to see Synthia Varela-Casaus yelling in their front yard, online she had a much different image of love and religion.

"It's sad to know that he had to go through all of that,” said Jimmy Chacon, a neighbor living near Varela-Casaus.

"It makes you wonder why, why they have the kids, you know?" said Chacon.

Chacon and other neighbors say it was common to hear Varela-Casaus fighting with her kids and a man in their front yard.

"I just always see them yelling at the kids,” said Chacon.

"We could hear arguing every now and then,” said a woman in the neighborhood who wanted to remain anonymous.

"Just the mom … just nervous with the kids, it seemed like,” said Chacon.

But neighbors say from afar, the kids, including Omaree, seemed OK.

"They all looked like happy little kids,” said the anonymous neighbor.

Online, Varela-Casaus' Facebook page painted a picture of a mother who cared. She often wrote about her kids, with one post saying in part, “Mommy loves you my precious angels Omaree …” followed with the names of her two other kids. Those kids are now in state custody.

Other times, Varela-Casaus posted prayers, including one saying in part, “Jesus please put a hedge of protection over all the children in the world …”

Some of Varela-Casaus’ friends have since replied to that post, writing in part, “… how could you ask for this and then kill your baby ..."

The family that helped raise Omaree Varela, and had temporary custody of him and his younger sister, said the 9-year-old’s death allegedly at the hands of his biological mother was avoidable.

They blame the state Children, Youth and Families Department, which they say ordered them to return Omaree to his mother in 2011 after they had been caring for Omaree on and off for several years.

Essie Sotelo and her daughter, Shana Smith, took care of Omaree and later his younger sister Neviah Varela when, they allege, the biological mother’s drug abuse turned her into an absentee parent.

“I blame CYFD for what happened because they put him in that house,” a sobbing Sotelo said Monday. “I told them that girl (Varela-Casaus) was not ready to take care of those kids. He was doing so good when he was with us. He liked school, he loved sports, he was happy.”

Smith was equally critical of CYFD. “They failed that little boy. What they could have done was look at the environment he was going into before taking him away from us. They could have continued once a month to check on those kids, Synthia could have been required to undergo random urine tests, to take anger management counseling and attend parenting classes. They should have dug deeper.”

Official CYFD documents that Sotelo and Smith shared with the Journal show clearly that CYFD was well aware of Varela-Casaus and had concerns about safety of the children.

In September 2009, CYFD’s Protective Services Division recommended that Omaree Varela, then 5, and sister Neviah Varela, then 10 months old, remain in the care of Sotelo, and that the biological mother and the infant’s biological father “not take the children into their care until interviews and assessments of their caretaking ability can be completed.”

Sotelo said she knew Varela-Casaus because she was a longtime friend of another one of Sotelo’s daughter’s, who served time in jail with Varela-Casaus, both of them on drug and related charges. According to court records, Varela-Casaus has been convicted of a variety of crimes, including prostitution.

Sotelo said Varela-Casaus referred to her as “mama,” and Sotelo regarded her and Varela-Casaus’ children as family.

Omaree, she said, was left in her care from mid 2006 through mid 2007.

Varela-Casaus took him back in 2008 and her second child was born in September 2008.

In May 2009, Smith, who lived in Phoenix, came to Albuquerque to visit her mother for the summer. Smith stayed at Varela-Casaus’ apartment. By the end of the summer, Smith alleges, Varela-Casaus was using drugs again, leaving the apartment and her children for extended periods of time. Smith and Sotelo continued to care for the children, and when it was time for Smith to return to Phoenix, Varela-Casaus asked her to take the children with her, Smith said.

By August 2009, Varela-Casaus was having second thoughts and asked for her children back. Sotelo traveled to Phoenix to pick up the children and bring them back to Varela-Casaus’ apartment, but she never showed up to take custody.

CYFD got involved in September of that year, and Sotelo asked for and was granted caretaker status of the two children. The CYFD letter, dated Sept. 16, 2009, states it is investigating an open case regarding Synthia Varela, and Omaree and Neviah, and recommends that the children stay with Essie Sotelo during the investigation.

Sotelo, who had been planning to move to Phoenix, later received a letter from Varela-Casaus, giving her permission to take the children to Arizona, which she did in January 2011.

According to Smith and Sotelo, two months later, in March 2011, CYFD contacted them and ordered the children back to Albuquerque. The children were returned that month and “that was the last time we saw them,” Smith said.

By this time, Varela-Casaus had a third child, a son, and was married to her current husband, Steven Casaus.

Roberta Morales
One of Varela-Casaus’ longtime friends, Roberta Morales, said that although the incident is tragic, she doesn’t think that the mother meant to kill her son. She said Varela-Casaus visited her a few days ago with Omaree and his siblings, and she scolded them for jumping on the furniture.

The kids were running around, happy, jumping around; she loved them … those kids were always with her,” Morales said, sitting in her living room with two of her grandchildren Sunday. “I’m not making an excuse for Synthia; all I’m doing is saying how I see it, and what I believe in my heart and my experience is that if she is guilty, she didn’t do it intentionally.”

Morales said she met Varela-Casaus in an Albuquerque jail in the mid-1990s, and they immediately became friends. She said they remained friends while Morales was in and out of jail, and “in and out of addiction.” Court records show that Varela-Casaus was convicted numerous times for prostitution and other crimes.

Morales said when she was a child she was hit with extension cords and thought it was abuse, but then she said she later believed it was an acceptable form of parenting.

“I know me coming from the ghettos I come from – and I call it ghetto-fabulous – you get smacked if you open your mouth or you come into the presence of adults talking, so for me, that wouldn’t be abnormal,” Morales said. “To kick a child is abnormal, but there’s a difference.”
