As Kayla Moore stood before Muskingum County Common Pleas Court Judge Mark Fleegle, Assistant Muskingum County Prosecutor John Litle lamented the fact she only faced three years in prison.
"Betraying your child because you like to do drugs, it is an unspeakable act," Litle said.
Moore had pleaded guilty to one count of endangering children in a case connected to Moore's boyfriend, Anthony Kovaleski. Moore had seen Kovaleski attempt to rape Moore's daughter, who was 8 at the time, Lilte said. Instead of reporting the incident, Moore called Kovaleski a profanity and allowed he to continue living in the home, he added.
Kovaleski pleaded guilty to attempted rape earlier this month, and was sentenced to eight years in prison.
Moore, for failing to report the incident and repeatedly using drugs in front of the child, faced up to 36 months in prison.
The girl had told her teacher and then a school councilor she had seen the couple doing drugs. "The girl described drug usage every night, numerous different overdoses." Litle said on Monday. The girl also described Kovaleski's attempted rape. She referred to Kovaleski as her dad.
The incidents took place from May 2019 to February 2020.
Moore offered an apology when asked by Judge Fleegle if she had anything to say. "I'd like to apologize to my daughter," she said. "I made a terrible mistake.
"Whatever the outcome, I'm going to be a better mother to my daughter." she concluded.
Judge Fleegle noted the permanent harm the incident had caused, and sentenced Moore to 30 months in prison.
