30-year-old Mercedes Ferguson has been accused of starving her 4-year-old son to death.

In August 2023 Ferguson called 911 to report her son was not breathing.

Life saving measures were unsuccessful and the boy was declared deceased.

An autopsy later ruled his death homicide through starvation.

A 33-year-old woman whose preschool-age son slowly starved to death after the two stayed inside their Elsmere-area apartment for weeks in 2023 has been sentenced to 12 years in prison.

Cut off from her family and unwilling to burdening neighbors, Mercedes Ferguson never sought food assistance or social services as her son grew weaker — a failure that ended in the 4-year-old boy's death.
Ferguson told Superior Court Judge Paul Wallace she never meant for her child to die. “This was not done on purpose,” she said before being sentenced on April 27. She added she would not wish the pain of burying a child on anyone.

“This was a lesson I wish I didn’t have to learn this way,” she said.
After completing her prison term, she will also be required to serve a period of probation.

"The greater punishment is that she will live with that for the rest of her life," Wallace said referring to Ferguson killing her child.
Attorneys acknowledged the death was a culmination of issues, including Ferguson having schizophrenia and her son's autism, leaving him unable to communicate fully. But prosecutors, who wanted Ferguson to be sentenced to 15 years in prison, said the boy was able to communicate with his mother and said more could have been done, including Ferguson selling items found inside the apartment.

Ferguson's attorney, Michael Heyden, called the sentencing "fair."

 
i wonder how much weight she lost during those 2 weeks while her son starved to death... her son couldn't communicate fully but you would think that for the 4 years of his life she would have learned to understand her child's needs grrrrrrrrrrrrrrrrrrrr..... a wee baby can't communicate at all but it sure doesn't take long for a caring mother to understand her baby's cries,, this one means hungry, this one means wet, etc etc i never gave birth but had a wee one that came home with me when he was 5 hours old and i knew his cries enough that when he was 3 weeks old he had a cry i never heard before and i paid close attentiong,, long story short after i notice a dif. in spewed milk i call family dr. and only got "a worried first time mother" as answer.. then called emerge with same results so i took matters in my own hands and next time he threw up i was ready with a clean clothe diaper on my shoulder and folded it and bundled my baby up and went straight to emerg with him and i plumed him right down on nurses counter and opened the diaper and said "there now call me a worried first time mother".. he was admitted and needed an operation right away....
