A southern Utah mother and her boyfriend have been charged with murder in the death of the woman's 14-month-old daughter earlier this year. Prosecutors say the girl was abused.

Cherokee May Dea, 24, and her boyfriend, Brendan Russell Dalton, 30, were each charged in 5th District Court on Wednesday with murder, a first-degree felony, in the April death of Dea's daughter, who is identified in charging documents only as G.L.D.

They also face three counts apiece of child abuse, a second-degree felony, and one count of endangerment of a child, a third-degree felony.

According to police, the 14-month-old girl — who had no significant health problems when she was born or when she was treated for "strep throat and severe dehydration" about three weeks before her death — died of blunt force trauma that caused hemorrhaging and injury to her brain.

A medical examiner determined the girl would have suffered the injuries shortly before becoming unresponsive. Police found the couple was likely in an argument during that time, according to charging documents.

Dea and Dalton told police they were on the couch watching a movie with the girl on April 13 when the child vomited. As he bathed the girl, Dalton told police the child was smiling, playing peek-a-boo and tracking him with her eyes. However, Dalton noted that the girl appeared to have a lazy eye, charges state.

About an hour later, around midnight, the girl was alone with Dalton while Dea went outside to have a cigarette, the woman told police. Dea reported she had stepped out because the two had been arguing after she told him she believed he was seeing other women and wanted to break up, charges state.

While the girl was alone with him, Dalton told police the baby began crying and breathing heavily, and when he picked up the child, she arched her head and shoulders back and passed out, charges state.

Dalton went out to get Dea and the two discovered the baby wasn't breathing, charges state. They attempted chest compressions on the girl and took her to Cedar City Hospital, where a CT scan revealed head injuries, charges state. The girl was rushed by medical helicopter Primary Children's Hospital and placed on life support. She died April 17.

The medical examiner also discovered that earlier fractures to the girl's wrist, upper arm and two ribs appeared to have been healing at the time she died, charging documents indicate.

As police investigated the girl's death, a woman reported that while Dea had been in her home about six months earlier, the mother had picked up the girl, who was sitting quietly in a recliner, and shook her back and forth while yelling at her, charges state.

"The witness stated that she was only a few feet away from Dea when this happened and that it was very upsetting to her," the charges state.

Morphine was also found in the girl's urine, charges state. Dea and Dalton gave no explanation for the morphine, but Dea admitted they smoked marijuana daily, used methamphetamine about every five days, and occasionally used heroin, according to the charges.

Dea also referred to Dalton as the father of her children while talking to police, the charges state, and told investigators that "although Dalton does have a temper, she never saw him do anything to G.L.D. to cause these types of injuries."

The mother said her daughter had been with her the entire day before she was taken to the hospital and that the girl had slept most of the day. Dea also said she had noted during that day that the child appeared to have a lazy eye and she was considering taking her in for an examination, charges state.

Horrible just horrible. I know what a coke head is like the day after so I can't even imagine what a heroin and/or meth user is like after coming down. Add in a baby who at that age is still in need of caring. Another bad combination. RIP GLD

The fate of a Cedar City woman who admitted guilt in the April 2017 death of her 14-month-old daughter remained uncertain Monday.

Sentencing for Cherokee Dea, 25, has been delayed three times following her guilty plea in February to reduced charges of child abuse homicide and three counts of child abuse. Dea originally was charged with felony murder.

Discussions between defense attorney Troy Sundquist and county prosecutors are ongoing. Details of the sentencing negotiations are not public. Dea faces a maximum of 40 years in state prison.

Edward Leis, deputy chief medical examiner for the state, testified Thursday he found brain injuries consistent with child abuse, as well as broken bones, bruises and other signs of major trauma, many of which would have happened perhaps months before the girl's death on April 17.

"A lot of these were in areas where you wouldn’t expect from a small child just walking around and bumping into things," Leis said as he described bruising on the child's body.

The girl also was reported as having a high level of morphine in her system. Dalton and Dea had told police they regularly used heroin, as well as marijuana and methamphetamine, but Dalton said he did not how the child could get morphine in her system.

Cherokee May Dea has been sentenced, to one and 15 years in Utah State Prison, after admitting to injuring and killing her young daughter in 2017, according to court documents.

District Court Judge Matthew L. Bell recommended that Dea get treatment while she is in prison, the sentencing order states.

Dea admitted to seriously injuring and causing the death of her daughter, who was about 15 months old at the time, according to her plea agreement. She also agreed to "testify truthfully in any and all court proceedings regarding the co-defendant in this matter, Brendan Dalton," according to the agreement.

Dalton has pleaded not guilty to murder, child abuse and child endangerment charges.

On April 13, 2017, late in the evening, Dea's baby vomited and Dea’s boyfriend, Dalton, gave the child a bath, according to charging documents. He said the baby was tracking him with her eyes and he noticed she had a lazy eye, according to charging documents. Later, the child began "crying and breathing heavily," so Dalton picked her up to try to soothe her, documents state.

The girl then “began to arch her head and shoulders back and then lost consciousness,” according to the documents. Dalton laid the girl down and went outside to get Dea.

When the two came back inside, the girl was not breathing, according to documents. They performed chest compressions and then took the girl to the hospital, where a CAT-scan revealed that she had suffered a brain injury, documents state.

She was airlifted to Primary Children’s Hospital in Salt Lake City. The girl was put on life support until she died on April 17, according to documents.

An autopsy later revealed that the girl died from blunt force trauma to the brain, charges state. She also had two rib fractures, a right wrist fracture and a left elbow fracture, the autopsy revealed.

Medical personnel also found morphine in the girl’s system, according to charging documents. Dea and Dalton admitted to “using drugs on nearly a daily basis,” including marijuana, meth and occasionally heroin, charges state.

Dea told investigators that she was with her daughter for the entire day before the girl suffered fatal injuries, according to charging documents. She said she also noticed the baby had a lazy eye that concerned her, and considered taking her to get examined, according to charging documents. Dea told police she had been arguing with Dalton on the night she took her daughter to the hospital and wanted to break up with him because she thought he was seeing other women, charging documents state.

A witness told investigators that while Dea was at her home about six months before Dea’s daughter died, she had seen Dea shake her daughter, the documents state.

Brendan Russell Dalton, 34, will serve a term of 1-15 years at the Utah State Prison, a term ordered by 5th District Court Judge Matthew L. Bell during an in-person sentencing hearing in Cedar City on Monday.

How much time Dalton ultimately will serve will be determined by the Utah Board of Pardons, Bell said. Dalton was given credit for the more than four-and-a-half years he has spent in Iron County Jail since December 2017, when he was formally charged in connection with the child's death.
As part of a plea agreement with prosecutors, Dalton had pleaded guilty last month to a single count of child abuse homicide, a second-degree felony.
