A baby girl was killed and two other young girls were wounded by gunfire while in the backseat of a car in Syracuse, police said Monday.

The children were riding in a car with two women, their mothers, shortly before 7 p.m. Sunday when someone opened fire from a car headed in the opposite direction, Deputy Chief Derek McGork said at a midmorning news conference.

The 11-month-old girl was shot multiple times, Onondaga County District Attorney Bill Fitzpatrick told CNY Central. He said the other girls, ages 3 and 8, are sisters, and they are expected to survive.

No arrests had been made Monday and police had no leads on a motive or potential suspects, Chief Kenton Buckner said.

The names of the victims were being withheld to protect their privacy and allow time for relatives to be contacted, authorities said.

Police were canvassing the area for camera footage and asked people with information to come forward. Police did not yet have a description of the vehicle from which the shots were fired.

An arrest has been made in connection to the death of an 11-month-old Syracuse baby, according to law enforcement sources.

23-year-old Chavez R. Ocasio has been arrested and charged with murder in the second degree in connection to Dior Harris's death.

Ocasio was also charged with violating his parole, tampering with physical evidence, and criminal possession of a weapon in the second degree.
Ocasio was arrested in 2014 as a 17 year old that shot a 13 year old in the head with a shotgun. He was hailed by Onondaga Community College in a November 2, 2020 ‘Student Spotlight’ article for “getting a 2nd chance at life” and was quoted as saying "Just because you have a bad moment, that's not who you are. People can change. Real people elevate. It makes you stronger when you get caught up in a bad situation and get out."

Why does a person who shot a 13 year old boy in the head get credited in a student spotlight? Kudos to anyone who rises above a violent past. (Obviously this criminal didn’t.) But why would you put this student in the spotlight, even if he was being a perfect example? The article doesn’t say the victim died, only that he had a serious brain injury. I wonder what quality of life his first victim has today if he’s still alive. I wonder if he is able to read the student in the spotlight article written about his would be murderer.

I bet he had a good chuckle because he fooled everyone so well before he went on to murder a baby and shot two small children.

If someone teaching this thug thought he was doing so well, they should have encouraged and congratulated him privately. Don’t publicize it, though. Even if he never did a wrong thing again, the original victim’s family never should have had to read words about his great progress and second chances after he snuck in their back yard and shot their son in the head because he was pissed off about some bullshit argument at a convenience store.
 
Two years ago, a gunman fired bullets into a car in Syracuse, killing 11-month-old Dior Harris who was sitting in her car seat.

Baby Dior is the youngest known victim lost to street violence ever in Syracuse.
Chavez Ocasio, 25, was arrested days later and if convicted could have faced up to 125 years for her murder and the attempted murder of four people in the car.

Ocasio, however, took a plea deal for attempted murder: 15 years in prison. The deal came after police say they arrested the actual shooter; they say Ocasio was driving the car used in the shooting.
Dior’s parents, Shaquail Harris and Desiree Seymore, are frustrated, shocked and angry about the plea deal. They say the punishment doesn’t fit the crime.

“We will forever suffer,” Seymore said. “They will do time and get out and we will forever feel this way.”

Harris said Baby Dior died 15 days before her first birthday and that 15 years is absurd; a slap in the face, he said.
Harris and Seymore sat down with Syracuse.com | The Post-Standard recently to talk about the case and their disappointment with the plea deal and the way the Onondaga County District Attorney’s office is handling the case.

Ocasio was the getaway driver in the drive-by shooting that night on Grant Avenue in April 2021.

This, alone, Harris and Seymore said, makes Ocasio as guilty as the shooter.
“[Chavez] knew what he was doing,” Seymore said. “He went to get that boy, he knew what he had planned, and he pulled up right next to our car. He knew.”

DA William Fitzpatrick said he understands the family’s pain of losing their child but feels the plea deal with Ocasio was necessary.
Ocasio is the key to getting the individual who fired the fatal shot, he said.

“Without the driver’s cooperation there would be no shooter, and he would still be at liberty,” Fitzpatrick said.

Fitzpatrick said being the driver doesn’t make Ocasio as guilty as the shooter. He said that 15 years in prison is an extraordinary disposition for the man who did not fire the shot.
The man who prosecutors say opened fire on the car - Jessy D. Outley, 26 - was arrested and charged in February with second-degree murder and second-degree criminal possession of a weapon. In addition to Baby Dior being shot, two other girls, ages 3 and 8, were wounded by the gunfire. Ocasio took the plea deal a week later.

Dior’s parents say they are also frustrated because they say then-prosecutor Melinda McGunnigle did not keep them up to date on the case. The DA said the couple has been consulted since day one.
When the case was passed over to assistant district attorney Maureen Barry, she sat down with the couple to update them on the case. This is when Dior’s parents said they were told Ocasio took the plea deal.

Harris and Seymore said they want another person to take over the case because they feel Barry isn’t fighting enough for their daughter.
Seymore said she has been traumatized going over the case again and again with investigators, reliving every detail of that night. She said it was something she was willing to do if it meant putting Baby Dior’s killer behind bars for good. Now, she says, she feels stripped of that chance.


Seymore said she was supposed to testify in Ocasio’s trial. She saw him and the vehicle he was driving that night.
“They keep saying focus on the shooter, don’t focus on Chavez,” Seymore said. “But it’s not just about [the shooter], it’s about both of them.”


Dior’s parents say prosecutors don’t know what they are going through and have shown little compassion. Outside of court, Harris and Seymore continue to feel the pain of losing their baby girl.
And the couple continues to worry about the safety of their three children living in Syracuse. Harris said he wants to move his family out of the city to give his wife and kids a better life, but moving Baby Dior’s burial site is expensive, and they don’t want to leave without her.
But Harris and Seymore say as Baby Dior’s parents, they have to do what they need to have their daughter’s name live on, even if it means speaking about their dissatisfaction with the plea deal.

“The DA told us sometimes you have to make a deal with the devil,” Harris said. “But if it was your baby, and I said that, how would you feel?”
 
That prosecutor is full of shit! He wasn’t the “getaway” driver, he pulled the vehicle into position to enable the shooter to fire into the vehicle.
I do wonder what the motive was and why nothing is in the articles about it. Were these animals actually aiming at the children?
