Doomsday Mom Lori Vallow Sent to Mental Health Facility, Hubby to Head to Trial

One year to the day after her two children’s remains were found buried in shallow graves, a court has ordered Idaho doomsday mom Lori Vallow Daybell to be committed to a mental health facility for 90 days, where psychiatrists will attempt to restore her competency to stand trial, according to court records.

The move comes as Daybell’s fifth husband and co-defendant Chad Daybell, who is also accused of killing his first wife, pleaded not guilty on Wednesday to multiple murder and conspiracy charges. Daybell faces life in prison or a death sentence if convicted on the most serious counts. His trial is set to begin in two weeks.

Vallow “lacks fitness to proceed in that the Defendant is incapable of assisting in the defense of this case,” states the order signed by District Court Judge Steven W. Boyce. But although the order says she “does lack capacity to make informed decisions about treatment,” Vallow “is not dangerously mentally ill,” in the eyes of the state.

Phillip Hamilton, a New York City criminal defense attorney who is not involved with the case, previously told The Daily Beast that pausing court proceedings in such a way can sometimes be helpful to the prosecution—which, in this instance, recently withdrew its initial objection to the mental health hold.

“The prosecution has a lot to prepare for in this case, so sometimes it can buy them a little extra time,” Hamilton said, adding, “To the extent that a licensed medical professional found her not competent, the prosecution has an interest in not giving her a chance to appeal if she’s convicted—you want all of the loopholes closed.”

Lori Vallow, already charged in the deaths of her two children, has been indicted in connection with the 2019 killing of her fourth husband, Arizona prosecutors said Tuesday.

Vallow is charged with one count of conspiracy to commit first degree murder, the Maricopa County Attorney's Office said in a statement. A grand jury charged her on Thursday.

Vallow is accused of agreeing with her brother, Alex Cox, to kill Vallow's husband, Charles Vallow, in 2019. Before Charles Vallow died, he had filed for divorce.

Prosecutors in Idaho will seek the death penalty against Chad Daybell, who is charged with his wife, Lori Vallow, in the killing of her two kids.

Daybell was also charged with killing his previous wife, Tammy Daybell, and court documents filed Thursday revealed that the Fremont County Prosecutor's Office will seek the death penalty in that case as well.

Vallow and Daybell were charged in May with murder in the deaths of Joshua "JJ" Vallow and Tylee Ryan, who were 7 and 16 respectively when they disappeared in September 2019. Daybell was also indicted on a charge of first-degree murder and insurance fraud in the death of Tammy Daybell.

"The State will seek the death penalty against Chad Guy Daybell in the event of the defendant's conviction for any of the three counts of first degree murder and/or any of the counts of conspiracy to commit first degree murder as charged in the Indictment," according to the court documents.
 
Oh yeah she was involved, I've watched a few videos talking about that and she tried to spin it as her ex just trying to frame her, but he had only just moved to the house where he was shot at and Melanie was the only one who knew where he was living in that group of people, so connect the dots. They may never prosecute her officially but she was involved up to her eyeballs.

Prosecutors to seek death penalty for ‘Doomsday’ mom Lori Vallow​

Prosecutors will seek the death penalty for “Doomsday” mom Lori Vallow, the Idaho cultist charged with killing her two children.

Vallow, 48, and her husband, Chad Daybell, 52, both face murder raps in connection with the 2019 deaths of her kids Tyree Ryan, 17, and 7-year-old Joshua “JJ” Vallow.

If Vallow and Daybell are convicted of any of the first-degree counts against them, prosecutors will ask for capital punishment as a sentencing option, they said in court papers Monday.

The couple embraced an apocalyptic cult named Preparing a People in 2018 while they were each still married to other people.
 
Lori Vallow will not face the death penalty if she is convicted, a judge ruled in a hearing Tuesday.

Seventh District Court Judge Steven Boyce said there was late disclosure of evidence by state prosecutors, not in a malicious way, but the case could be turned over on an appeal if there was a capital conviction.

The defense requested the death penalty be dismissed due to Vallow's mental health, media coverage and late discovery disclosure by the state -- and as a 'punishment' for the late disclosure, the court should sanction the state by ruling against the death penalty.

Boyce said there is a heightened level of scrutiny with a death penalty case.

"The court determines that the late disclosure of discovery has materially prejudiced (the right to prepare for a death defense)," Boyce said. The state turned over evidence they had to the defense on March 13, which Boyce said was too late for preparation in the midst of Vallow's trial, set to take place April 3 in Ada County.

"The court is required to fashion a remedy that honors the fundamental right to a fair trial," Boyce said. "As an appropriate discovery sanction, the state will be precluded from seeking the death penalty at trial."

Boyce said he is not punishing the state -- he doesn't believe that prosecutors intentionally kept evidence -- but rather said he is ensuring the rights of Vallow are protected so a reasonable defense can be prepared.

The murder trial in the case against Lori Vallow, aka Lori Vallow Daybell, has begun in Ada County.

Vallow is charged with murder, conspiracy and grand theft related to the deaths of her two children, Joshua "JJ" Vallow and Tylee Ryan, and her husband's late wife, Tammy Daybell in eastern Idaho. Her husband Chad Daybell is also charged in the murders and will be tried separately in Ada County at a date still to be determined. Prosecutors were previously seeking the death penalty against Vallow but it was later taken off the table by a judge as a way to sanction the prosecution for late discovery disclosure.

Monday starts with jury selection -- 1,800 jurors in Boise were given instructions and a 20-page questionnaire, according to Ada County Administrative District Judge Steve Hippler. Some were disqualified, so the remaining jury pool is summoned to the courthouse for voir dire -- a preliminary questioning session by the defense and prosecution in order to slim down the jury. This could take multiple days. The process will leave a panel of 12 jurors and six alternates.

The trial is expected to last 10 weeks. There are no cameras or audio recording allowed in court, per a court order.


I read sometime back that Lori and Chad had started to point their finger at each other. I wonder how they now rate each other on their whack- a- do 'dark spirit' scale?

Lori Vallow murder trial day 3: Potential jurors removed, selection continues​


Jury selection is still underway for the murder trial of LorI Vallow, an Arizona mother accused of killing her two children shortly after she left the state.

After two days, 30 potential jurors have been chosen. An Idaho judge wants 42 total.

Once 42 jurors are ready, both prosecution and defense will each get 12 strikes to narrow the pool down to 18 jurors - 12 jurors for the trial and six alternates.

Opening arguments could begin as early as Friday.

Inside the courtroom, Vallow wrote notes and watched the potential jurors being questioned.

Most of those who were removed appeared to have known about the alleged victims, co-conspirators, and formed opinions about the so-called "Doomsday mom" accused of killing her kids and her husband's first wife.

Her husband, Chad Daybell, is being tried separately.

BOISE, Idaho (AP) — The investigation started roughly 29 months ago with two missing children. It soon grew to encompass five states, four suspected murders and claims of unusual, doomsday-focused religious beliefs involving “dark spirits” and “zombies.”

On Monday morning, an Idaho jury will begin the difficult task of deciding the veracity of those claims and others in the triple murder trial of Lori Vallow Daybell.

Prosecutors charged Vallow Daybell and her husband, Chad Daybell, with multiple counts of conspiracy, murder and grand theft in connection with the deaths of Vallow Daybell’s two youngest children: 7-year-old Joshua “JJ” Vallow and big sister Tylee Ryan, who was last seen a few days before her 17th birthday in 2019. Prosecutors also have charged the couple in connection with the October 2019 death of Chad Daybell’s late wife, Tammy Daybell.

The investigation garnered worldwide attention and was closely followed in the rural eastern Idaho community where the bodies of the children were found buried in Chad Daybell’s yard. As a result, Seventh District Judge Steven Boyce moved the trial more than 200 miles (320 kilometers) west to the city of Boise.

Both defendants have pleaded not guilty, but only Vallow Daybell’s trial begins Monday. The cases have been separated, and Chad Daybell’s trial is still months away. Vallow Daybell faces up to life in prison if convicted.

In the hour before opening arguments were set to begin, television news crews and photographers stood outside the front of the courthouse as workers, jurors and onlookers made their way through a security point just inside the building.

The judge has banned cameras from the courtroom and the proceedings are not being streamed, but widespread interest in the case prompted court administrators to set up a separate “viewing area" to allow seating for media and members of the public. About 50 people were sitting in the viewing room.

Eighteen-hundred people were called as potential jurors, and the pool whittled down to 10 men and eight women last week.

All 18 will hear the case, but only 12 will actually take part in deliberations to decide Vallow Daybell’s guilt or innocence. The other six are alternates and will be released from service before deliberations begin. Jurors will not be notified they are an alternate until it is time for deliberations in order to ensure they all stay engaged throughout the trial.

Prosecutors say the Daybells espoused strange doomsday-focused beliefs to further their alleged plan to kill the kids and Tammy Daybell to collect life insurance money and the children’s social security and survivor benefits.

Police documents detailed interviews with friends and family members who said the couple led a group that believed it could drive out evil spirits by praying and that they sought revelations from “beyond the spiritual veil.” Vallow Daybell’s close friend Melanie Gibb told investigators that the couple believed people became “zombies” when they were possessed by evil spirits.

The group would spend time praying to get rid of the zombies and believed, if they were successful, the possessed person would physically die — freeing their trapped soul from “limbo.” Vallow Daybell called JJ and Tylee “zombies” several times before they died, Gibb told investigators.

Idaho law enforcement officers started investigating the couple in November 2019 after extended family members reported the children were missing. During that period, police say the couple lied about the children’s whereabouts. The children’s bodies were found buried on Chad Daybell's in rural Idaho.

Tammy Daybell was killed by asphyxiation prosecutor reveals​


Tammy Daybell died “at the hands of another and died of asphyxiation,” according to Utah medical examiner. This is the first time that information was made public.

After Tammy died, Alex Cox said, “I hope I’m not their fall guy” (referring to Chad and Lori). Alex died the day after he said that.

The case of Lori Vallow Daybell is one of money, power and sex.

That’s according to prosecutor Lindsey A. Blake, who gave the state of Idaho’s opening argument Monday in the trial of Vallow Daybell, who is charged with conspiracy, murder and grand theft in the deaths of her two children, JJ and Tylee.

But attorneys for Vallow Daybell say it’s a story of unanswered questions.

Vallow Daybell also faces charges in the death of her new husband’s first wife, Tammy Daybell, whose cause of death was revealed for the first time as prosecutors laid out a map for the case jurors will hear over the next several weeks.

Chad Daybell, who is also charged in the three deaths, has pleaded not guilty and will face a separate trial.

“The defendant Lori Vallow Daybell used money, power and sex, or the promise of those things, to get what she wanted. What she wanted, was money, power and sex,” Blake told the jury. “It didn’t matter what obstacle she had to remove to get what she wanted ... if it was a person, it didn’t matter who.”

Her children, Blake said, were in the way. JJ, a 7-year-old, special needs child, required time, effort and energy. “That took away from what Lori wanted, which was spending time with Chad.”

Tylee, 17, was receiving Social Security benefits from the death of her father — Lori wanted that money, and now Tylee is gone, the prosecutor said.

And Tammy Daybell had a life insurance policy of which Chad Daybell was a beneficiary. “Lori wanted those things,” Blake said.

Tammy Daybell, it was revealed Monday, died by asphyxiation at the hands of another person, the prosecutor told the jury. Chad Daybell originally told police that Tammy Daybell had died in her sleep after she went to bed with a cough. Prosecutors also said that Chad had moved her body by the time first responders arrived.

Vallow Daybell’s attorney, R. James Archibald, countered with a brief opening argument emphasizing to the jury that they are to consider the specific allegations against his client and no one else.

The publicity that has tainted so many people in the county, state and country, is not evidence, he said.

During his statement, Archibald read an alibi filed on Vallow Daybell’s behalf, which claims she was in her own Rexburg apartment with her friends Melanie Gibb, David Warwick “and/or” Chad Daybell when the children were killed in an apartment belonging to her brother, Alex Cox. The statement also asserted that Vallow Daybell was in Hawaii when Tammy Daybell was killed.

Archibald also challenged jurors to consider whether prosecutors have established beyond a reasonable doubt what happened to JJ, Tylee and Tammy Daybell, and what Lori Vallow Daybell’s alleged involvement is.

“You’re here to determine if there even was a conspiracy. Cases, again, can be solved with evidence, they can be solved with a lack of evidence,” he said.

Vallow Daybell wore a black blazer-style jacket and black rimmed glasses to court. Her bright blonde hair, pictured in the now famous mugshot and subsequent news stories, is fading. She appeared emotionless for much of Monday morning, even as grisly images of her two children were displayed on the screen.

Prosecutors say both JJ and Tylee’s bodies were burned — an image of Tylee’s body shows what appears to be charred remains in a shallow grave, hardly recognizable as human. Her DNA, Blake said, was discovered on a pickaxe and shovel on Chad Daybell’s property.

“That’s what was left of this beautiful young woman, the defendant’s daughter,” Blake said.

And JJ was found bound by duct tape and wrapped in a black trash bag.

“Even the most veteran law enforcement officers that you’ll hear from were disturbed by the scene,” Blake said.
