Jussie Smollett was released from jail Wednesday night, hours after an Illinois state appellate court ruled he could go free while his lawyers appeal his conviction for staging a hate crime.

Smollett, 39, left jail in Chicago flanked by two of his brothers and three large body guards and said nothing as he was ushered into a light colored SUV that drove away from the Cook County Detention Center around 8 p.m. local time.

I'm going to take the (probably unpopular) position that this is the correct decision. He wasn't charged with a violent crime, there's no evidence he presents an ongoing danger to the public, and if his bail were to be denied, his appeal would be essentially moot. If he's free during appeal, we can always put him in jail if he loses; if he's incarcerated during appeal, we can't give him that time back if he wins.

Disgraced actor Jussie Smollett professed his innocence and insisted he’s “not a piece of s–t.”

Smollett, who was found to have paid two men to pretend to be racist and homophobic Donald Trump supporters and attack him with a noose and bleach, was sprung from a Chicago jail in March after serving a six-day sentence.

The 40-year-old actor addressed his highly publicized trial on Sway Calloway’s SiriusXM show, “Sway in the Morning”, claiming he did not lie about the attack.

“If I had done this, I’d be a piece of s–t. And I don’t think that’s really questionable,” Smollett said in the episode aired on Monday.

“If I had done something like this, it would mean that I stuck my fist in the pain of black African Americans in this country for over 400 years,” he told Sway.

I understand wanting to stand up for your brother and all that, but seriously... all of them need to shut the fuck up for their own sake. It's not helping... in fact, them running their mouths off is only making things worse. It's a lot like the whole Amber Heard bullshit in that regard. In both cases, they keep trying to draw attention to themselves, hoping they can convince people to believe in their bullshit stories. And in both cases, when they fail to convince ANYONE (..which is gonna happen considering the evidence presented against them AND the overall ridiculousness of the bullshit they're spewing..)... instead of acknowledging their guilt/ mistakes, they double down on their bs and talk even louder. In Jussie's case, he and his family are going to burn bridges with any potential supporters they "might" have been able to find by tossing around comments blaming others for not supporting him.

Jussie Smollett is appealing his conviction for staging a racist and homophobic attack on himself and lying to Chicago police about it — nearly a year after he was sentenced to five months in jail.

The “Empire” alum, 40, is seeking a new trial, as he claims “prosecutorial misconduct” in this case was “clear and egregious,” according to the 102-page document filed Wednesday with the Illinois Appellate Court and obtained by The Post.

A jury convicted Smollett in December 2021 of five counts of disorderly conduct. He had claimed that on a frigid early morning in January 2019, two men approached him in the dark, yelled slurs at him, punched him, poured a chemical substance on him and hung a noose around his neck.

“Jussie has had an extremely difficult past few years,” the“Empire” star’s publicist said in a statement to TMZ on Wednesday. “He has quietly been working very hard for some time now and we are proud of him for taking these necessary steps.”
Smollett, 40, was sentencedto 150 days in jail and given 30 months of felony probation after being found guilty of five counts of disorderly conduct in May 2022. He was also ordered to pay more than $120,000 in restitution to the City of Chicago and was fined $25,000.

The“B-Boy Blues” director, who is Black and identifies as gay, was charged for allegedly paying two brothers, Abel and Ola Osundairo, $3,500 to help stage a homophobic and racist attack against him in January 2019.

“There’s a side of you that has this arrogance, and selfishness and narcissism that’s just disgraceful,” Cook County Judge James Linn said while sentencing the actor. “You’re not a victim of a racial hate crime, you’re not a victim of a homophobic hate crime. You’re just a charlatan pretending to be a victim of a hate crime, and that’s shameful.”

“Over six years ago, after it was reported I had been jumped, City Officials in Chicago set out to convince the public that I willfully set an assault against myself. This false narrative has left a stain on my character that will not soon disappear,” Smollett wrote on Instagram Saturday.

“These officials wanted my money and wanted my confession for something I did not do. Today, it should be clear…They have received neither.”
