MEMPHIS, TN (WMC) - Efforts to remove multiple children from the reach of a couple who is now accused of sexual misconduct began long before the couple was arrested, according to the victims' attorney.
"This is one of the more disturbing cases I've run across in my career," attorney Brice Timmons said.
John and Dava Henley were indicted Monday on charges of child rape, aggravated sexual battery, and others too disturbing to publicize.
The victims in the case are now 9 and 12 years old, according to their attorney.
Timmons said the victims were abused over the course of several years.
A lengthy court battle eventually freed the children from being in contact with the Henleys. Timmons said that's when the children began to tell adults about the horrors they had endured.
"For weeks they behaved very strangely," Timmons said. "They’d alternate between appearing terrified these caretakers would come get them and being relieved to be away from them."
Tipton County authorities received a related report of misconduct involving children in June 2017. They passed the report to Shelby County investigators because it reportedly happened in their jurisdiction.
Tennessee Department of Children Services confirmed it is investigating the case.
Both children are in a safe environment in Middle Tennessee. Timmons said the children are making progress thanks to counseling, but they are both still reeling from the trauma.
"One of the children, the older child is doing well in therapy. She’s showing a great deal of promise; she’s rapidly catching up on her studies," Timmons said. "The younger child is in a therapeutic environment. There is progress--the younger child was exposed to this from almost infancy, so it’s going to take a lot longer to deal with those problems."
John and Dava Henley are being held at 201 Poplar. Both are scheduled to appear in court Friday.
