A 30-year-old mother in Ohio has been arrested after she allegedly threw her 9-month-old child across a room, leaving the infant in critical condition.
Billie Jo Tustin was taken into custody on Thursday and charged with one count of felonious assault resulting in serious harm to the victim, records reviewed by Law&Crime show.

Emergency medical personnel with the Columbus Division of Fire at about 5 p.m. on Wednesday responded to the family's home in connection with an unresponsive infant, The Columbus Dispatch reported, citing court records.
Upon arriving at the address, first responders located the boy and rushed him to Nationwide Children's Hospital for treatment. The infant was admitted to the facility in "extremely" critical condition, local CBS affiliate WBNS reported.
In a criminal complaint obtained by local ABC and Fox affiliate WSYX, Tustin allegedly admitted to police that she threw the child across a room measuring approximately 15 feet. The infant reportedly landed on his head and suffered numerous traumatic injuries.

Tustin also reportedly confessed to throwing the child shorter distances multiple times, spanking him, and even slapping him in the face, saying she did so when she got frustrated. In fact, police said in an incident report that the victim's injuries were so serious that the department's homicide unit was charged with investigating the incident.
The child remained in critical condition and was on life support, a police spokesperson told WSYX.

"We're not sure if he's going to pull through, so we want to make sure we are doing everything we can, if this is in fact a crime scene, that we figure out exactly what happened," Sgt. James Fuqua told the station.

In a 911 call obtained by ABC 6, Tustin can be heard telling dispatchers, “My 9-month-old isn’t breathing." It is unclear how long Tustin waited to contact emergency crews after allegedly assaulting her son. Police said Tustin's 3-year-old daughter also was in the home when the alleged assault occurred, but she was not harmed.
Tustin’s boyfriend, who lives with Tustin and her children, told ABC 6 off-camera she suffers from "severe mental illness." He said she feared seeking treatment because she believed she could lose custody of her children.
Franklin County Children Services confirmed it had prior involvement with the family. Officials said Tustin was attempting to end her affiliation with the agency before Wednesday’s assault. Her 3-year-old daughter is now in the agency’s custody.

“The team at Franklin County Children Services is closely monitoring the condition of this 9-month-old baby boy," FCCS spokesman Scott Varner said. "This alleged abuse by his mother is appalling and heartbreaking. Our agency has been connected to his mother, Billie Jo Tustin, who had been seeking to end our involvement with her family related to custody of her 3-year-old daughter. We will be pushing for the court to deny that."

"Someone had to have known about her mental concerns," Wallace added. "Whether grandmothers, aunts, or uncles, someone should have probably known and stepped up and said something before it came to this. They're helpless, they're defenseless, and it's tragic."

Right. It makes no sense. I’m gonna hug my bub when he gets home from school later on. I understand the fear of losing your kids for getting help with your mental health, as that does happen and would’ve happened to me had I sought help for the severe postpartum depression I had, but I’d rather my son be with someone else while I do so than to do such a monstrous thing.

Anfernee Barthel, Tustin's live-in boyfriend, is also facing charges — one count of involuntary manslaughter and one count of endangering children — due to his "violation of his duty of care to the child as a person in loco parentis (in place of a parent) to the child," the prosecutor's office said.

She also admitted to throwing the child several more times and spanking and slapping him in the face when she got frustrated, according to court documents. Records did not clarify when that happened.
Franklin County Children Services said that Tustin's 3-year-old daughter is now in their care.
