A woman was raped by a stranger on a commuter train in suburban Philadelphia in the presence of other riders who a police official said “should have done something.”

Superintendent Timothy Bernhardt of the Upper Darby Police Department said officers were called around 10 p.m. Wednesday after the assault on the Market-Frankford Line.

An employee of the Southeastern Pennsylvania Transportation Authority who was in the vicinity as the train went past called police to report that “something wasn’t right” with a woman aboard the train, Bernhardt said.

SEPTA police waiting at the next stop found the woman and arrested a man. The woman was taken to a hospital.

Bernhardt called the victim an “unbelievably strong woman” who provided police with a lot of information. She did not know her attacker, he said.

“She’s on the mend,” Bernhardt said. “Hopefully she will get through this.”

The entire episode was captured on surveillance video that showed other people on the train at the time, Bernhardt said.

“There was a lot of people, in my opinion, that should have intervened; somebody should have done something,” Bernhardt said. “It speaks to where we are in society; I mean, who would allow something like that to take place? So it’s troubling.”

Fiston Ngoy, 35, has been charged with rape, aggravated indecent assault and related counts, according to Delaware County court records. Bernhardt said he is known to both SEPTA and Upper Darby police.

SEPTA issued a statement calling it a “horrendous criminal act” and urging anyone witnessing such a thing to report it to authorities.

“There were other people on the train who witnessed this horrific act, and it may have been stopped sooner if a rider called 911,” the authority said.

Ngoy, who police believe may be homeless, has been charged with rape, incident assault, sexual assault and numerous other charges. He is being held at a Delaware County jail on a $180k bail.

I once mentioned on this site that I nose around any strange noises and oddities around my immediate neighborhood. Someone (not a regular cool person) said “good luck not getting shot for snitching” or something to that effect. First thing, I don’t live in a hood where that’s even a possibility, second that’s the fucked up kind of person who sits around watching a sexual assault. Third, I care about my family, neighbors and community. Damn straight, if I hear a trash can tip over at 2am I’m checking it out. 10 times out of 10 it’s a nasty raccoon, but only once my nosey ass could help someone!
 
Police said Fiston Ngoy, of Philadelphia, through surveillance footage that caught him sexually assaulting a woman Wednesday night aboard a Southeastern Pennsylvania Transportation Authority (SEPTA) train towards Upper Darby.

SEPTA and Upper Darby Township Police investigators said a surveillance camera on the train captured the assault.
Police said Ngoy first sat next to the woman and tried to touch her. The woman pushed him away several times before he pushed her down, ripped her clothes off, and sexually assaulted her, police said.

Investigators said the assault went on for eight minutes, and no other riders tried to stop the attack or call the police. Some may even have videoed the rape themselves, police said.

Upper Darby Police Superintendent Tim Bernhardt said the woman went into shock and was taken to a nearby hospital and treated for her injuries.

or like here in canada i remember a couple of years ago some provinces tried to ban the national enthem from being sang in schools because the words "our home and native land" offended the new comers because it wasn't "their native land" but if i was a new comer in any land that opened their doors to give me a better life i sure would proudly sing "our home and adoptive/ adopted land" and yes taught my kids to sing it with pride also... the parents created such an uproar that "o canada" was once again sang in our schools and assemblies but the new comers can stay sitting down or what ever they want to do during that time...

Passengers did not sit around and record cellphone video of a rape aboard a SEPTA train for their own gratification without contacting authorities, Delaware County’s top prosecutor said Thursday.

The revelation from District Attorney Jack Stollsteimer runs counter to the police narrative of the rape on a SEPTA Market-Frankford elevated train at the 69th Street Terminal in Upper Darby. Police said in that case that passengers took cellphone video without calling 911 before a SEPTA employee called police.

“There is a narrative out there that people sat there on the El train and watched this transpire and took videos of it for their own gratification,” Stollsteimer said using the nickname for the Market-Frankford line. “That is simply not true. It did not happen. We have security video from SEPTA that shows that is not the true narrative.”

In fact, Stollsteimer said, SEPTA security video shows that a “handful” of people who were getting on and off the train as it traveled from Philadelphia to the 69th Street Terminal had observed different parts of the rape, possibly without knowing what exactly was happening.

“This is the El, guys. We’ve all ridden it. People get off and on at every single stop. That doesn’t mean when they get on and they see people interacting that they know a rape is occurring,” he said.

Two people may have recorded video of the attack on their cellphone, one of whom “probably” alerted SEPTA of the attack, Stollsteimer said.

The train car where the alleged rape happened “was not very crowded at all,” Stollsteimer added while noting that the assault happened as the train was moving, meaning it may have been impossible for other people to understand that an attack was taking place.

“[The train] is moving, so this is an incident that’s happening over time. So, people are getting in and out of the car. They may not all have been aware at any time what would happen previously,” Stollsteimer said.

Both SEPTA and Upper Darby Police Department Superintendent Timothy Bernhardt had said people watched the attack and took cellphone video without calling 911. "It's disturbing that there were definitely people on the El and no one did anything to intervene or help this woman," Bernhard said previously.

However, Bernhardt stood alongside Stollsteimer on Thursday, with Stollsteimer placing the blame for misinformation on SEPTA officials, not the police superintendent.

Stollsteimer emphasized that it is not unlawful to avoid intervening when witnessing a crime, and he asked anyone who may have seen the rape to come forward and aid with the investigation without fear of prosecution. Only one witness has come forward thus far, he noted.

“What we’re trying to do is gather everybody who witnessed anything that night – without fear of being prosecuted – to come forward so we can gather whatever evidence could be gotten from that,” Stollsteimer said.

The district attorney added that "people in this region are not, in my experience, so inhuman" that they would videotape a rape "for their own private enjoyment." In fact, he said, people are more akin to the woman who – also at the 69th Street Terminal – heard another woman crying for help and intervened in a separate sexual assault Wednesday.

My opinion is that if you see something you should report it and then record it in the hopes that the footage will help LE apprehend the criminal. Recording a crime is not necessarily callous, especially if you're not in a position to do anything about that crime as it's happening.

The people accused of recording the incident are probably minorities so they don't want to hold them accountable.

It also would look pretty bad if they charge and incarcerate someone for recording an incident and allow actual thugs who beat and rob people to go unprosecuted.
