A 74-year-old bedridden woman who was found dead last weekend was “basically tortured and neglected to death” by her adult son, according to a Texas sheriff.

The death of Maria Huerta led to charges against 50-year-old Juan Santos Huerta, who was being paid by the state to care for her, Bexar County Sheriff Javier Salazar said in a news briefing Wednesday. Instead of caring for his mother, Huerta was working as a long-haul truck driver, Salazar said.

“This case is bar none the worst case of neglect of an elderly person I’ve ever seen,” Salazar said.

The woman was found dead at a home Saturday, Salazar said the woman’s injuries were too graphic to describe.

Maria Huerta had several bed sores, parts of her body had exposed bone from flesh that rotted away, and her body was infested by maggots, according to the sheriff.

Salazar said it’s likely the mother was living with some wounds for months or years and had not been treated by a doctor “in some time.”

“I can’t even image the pain and torture that this elderly lady went through,” the sheriff said. “When you factor in that it was at the hands of her son, it makes it that much more heartbreaking.”

Juan Santos Huerta was in charge of his mother’s care, but Salazar said he admitted to working 12-hour days on the road as a trucker.

As a result, according to Salazar, the son left his mother “by herself until she finally succumbed to her ever-worsening wounds and ended up dying as a result of the deplorable condition she was allowed to deteriorate to.”

Every time I read these I don’t buy the excuses, but this guy profited off it. Hey, buddy, they gave you money so you wouldn’t have to work so much. I know you know that, but how could you resist free money and you get out of the house so you don’t have to hear her moans or smell her wounds, right?

I can’t imagine how I would feel if my children treated me like that in the end. It’s your mom. And you took money, stole it from people who needed it to properly care for their elders.
 

Grand Jury indicts Juan Santos Huerta in connection with the September 2021 death of his disabled, elderly mother — who authorities said was neglected for months before she died.​

Juan Santos Huerta is charged with assault – intentionally/knowingly causing serious bodily injury by omission to the elderly. The indictment alleges that on Sep. 4, 2021, Huerta intentionally and knowingly, by omission caused serious bodily injury to Josefina Huerta, an individual who was 65 years of age or older, and whom Juan Huerta had assumed care, custody and control of in that Juan Huerta failed to seek proper medical care for Josefina Huerta, failed to provide adequate nutrition for Josefina Huerta and failed to provide adequate hygiene for Josefina Huerta. The Family Violence Division is prosecuting this case in the 175th District Court. Assault of an elderly causing serious bodily injury is a first degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.

Deputies with the Bexar County Sheriff’s Office interviewed Juan Huerta the following day, and he told them that he was the primary caregiver to his mother since 2013.

He told deputies that he fed and helped bathe his mother, the affidavit states, but he had stopped taking her to the shower more than a year ago because “he was out of energy.”

When investigators asked why he didn’t have enough “energy” to take her to the shower at least once during that time frame, he replied that he “did the best he could.”

He added that he stopped taking her to the doctor’s office two years ago “because of a personal fear of COVID-19,” the affidavit states.

“Juan could not explain why he did not call EMS or police when his mother started to become very ill and had wounds beyond his ability to treat or care for,” the affidavit states. “Juan would excuse his actions by continually saying, he did the best he could with the training and experience given to him by a group of registered nurses he would visit.”

Deputies said the man was being paid by Primavera Primary Home Care to tend to his mother, with some checks paying 40-50 hours a week.

Juan Huerta told investigators that he worked full-time as a trucker but continued to log hours for the healthcare company because he was in ”financial hard times.”

He stated he “was just trying to stay afloat with the bills during the pandemic,” the affidavit states. He would clock in for the healthcare provider by phone, he said.

Authorities said a healthcare representative first reported concerns about the woman’s health in February of 2020.

She had smelled of a urinary tract infection at the time, the representative reported, and she had bedsores and discolored feet.

Deputies said Juan Huerta refused to allow an ambulance to take his mother at the time, telling paramedics to “leave his mother alone.”

He reassured them she was in good care.

When police and paramedics found the woman dead over the weekend, she had several skin ulcers that nearly exposed the bone underneath. Her bed was soiled with bodily fluids.

Juan Huerta told deputies he knew for months that his mother had maggots in her wounds. “God put them there,” he said.

The affidavit states he knew about her large wounds between six to 12 months ago.

Following his arrest on Wednesday, Juan Huerta told media members that his mother died from “being old.”

“My mother passed away of being old. The Lord took her on Saturday at 10:30 if you all really want to know,” he said during a perp walk.

It is unclear when the woman perished.

A man charged with neglecting his bedridden mother until she died from lack of care was sentenced to 30 years in prison per a plea deal.
Juan Santos Huerta in May pleaded no contest to the charge of injury to the elderly and accepted a plea deal.

Maria Huerta, 74, died in September 2021 and was found in an emaciated state.
According to an arrest affidavit, Maria Huerta had several skin ulcers that nearly exposed the bone underneath. Her bed was soiled with bodily fluids.

The affidavit states he knew about her large wounds for about 6 to 12 months and didn’t get any care for her.

Last year, Huerta was found incompetent to stand trial but competency was eventually restored.
In court Friday, Huerta’s attorney told the judge he believed he should get deferred adjudication as his sentence because he had no criminal history and had remorse for how his mother died.

Judge Catherine Torres-Stahl denied that request and did not hold back when she sentenced him.

“This is probably one of the most egregious cases I’ve ever seen,” Torres-Stahl said. “This was your mother. I think you deserve every single one of those 30 years.”
According to court records, Huerta still has a Medicaid fraud charge pending related to this case. He allegedly stole between $30,000 and $150,000 in his mother’s healthcare provider checks.
