An Indianapolis man is accused of raping a 3-year-old girl and attacking the girl’s mother after being confronted with video proof outside a Muncie business.

Kevin Davis, 29, was arrested on various preliminary charges including child molestation, a Level 1 felony; rape, a Level 3 felony; possession of child porn and obstruction of justice, both Level 5 felonies, and domestic battery, a Level 6 felony.
According to court documents, the victim’s mother recently discovered videos on Davis’s phone that showed him molesting and forcibly having sex with the 3-year-old girl. The mother ended up sending the videos to herself and then confronted Davis outside of a Muncie business.
After showing Davis the videos and asking him how he could commit such a heinous act, Davis is accused of snatching the phone away from the victim’s mother and slamming it on the ground. Davis then reportedly assaulted the victim’s mother, punching her over a dozen times. Police said other individuals witnessed the attack.
Police arrived at the scene a short time after the attack and located Davis walking in a nearby field. Davis ended up admitting to “whooping her a–,” when police questioned him about assaulting the mother, according to court documents.

Court documents reveal that a search of Davis’s phone uncovered the videos in question which allegedly show Davis forcibly committing sex acts on the 3-year-old. Police said Davis also admitted to committing the acts inside a Muncie home in late November.

I have a feeling that the mother would not have reported him to the police if he had not assaulted her.

There was no reason to confront or give this man a chance to destroy evidence or defend himself.
 
Davis is also accused of battering the child's mother, who had been his girlfriend. According to an affidavit, when the woman confronted him after seeing the video, Davis slammed her cellphone to the ground and then punched her up to a dozen times.
Davis was reportedly convicted of armed robbery in Marion County in 2013.

and of course she didn't call the cops... i would certainly have called the cops but only after i was done dealing with him and yes the hospital and the cops could have what would have been left of him after i was done

ah...maybe that was her line of reasoning. Didn't work out so well. Straight to the cops and hell certainly get his in prison. No way would I confront at least without backup

well stupid woman comfronted him on the street i wouldn't have been that stupid ...first i would make sure my kids were not in my house and were well looked after and tell him it is our time alone just the two of us... then i would wait till he is asleep and i was well armed.. like baseball bat,marble rolling pin, cast iron frying pan etc to knees first , then i would really let loose on him when, like my child he raped, he couldn't defend himself... am i would have really whopped him good , then called the cops and yes officer i just found that on his phone and i snapped .... didn't say if they were in any kind of relationship or not but obviously she could access his phone so i guess they had some kind of relationship...

When Davis was arrested last December, Delaware County sheriff's deputies said he was being confronted by relatives of his 4-year-old victim, who had just become aware of the allegations against him.

According to an affidavit, Davis had used a cellphone to record his efforts to sexually abuse the child.
The guilty pleas came after Davis had signed a plea agreement that saw four other charges — child molesting, child exploitation, performing sexual conduct in the presence of a minor and possession of materials showing juveniles involved in sexual activities — dismissed.

Judge Judi Calhoun imposed a 33-year sentence — 30 years in prison, followed by three years on probation.
At the sentencing hearing, Davis offered an apology to the victim and her family.

"This wasn't supposed to happen at all," he said.
The domestic battery conviction stemmed from allegations Davis had punched the victim's mother up to a dozen times when she confronted him after finding the videos of his crimes.

When he said this was not supposed to happen he really meant he was not supposed to be caught.
