Michigan State Police troopers have opened an investigation in Holly Township after a 4-year-old child was found dead Sunday.

Police said the mother’s boyfriend has been taken into custody. No additional details have been released.

The family of a 4-year-old Trinity Chandler said she had severe bruises and internal bleeding.

Trinity’s grandmother. Christine Cunningham said her daughter got a text from her boyfriend on Saturday morning.

“It said, ‘Something’s wrong with Trinity, she’s not getting up.’ So he took her to the fire department,” Christine Cunningham said.

The family said someone had contacted Child Protective Services in the past about concerns over Trinity’s welfare.

“They failed her. They failed her big time,” Ronda Osterberg said. “There were two black eyes, there was a bruise on her cheek -- CPS closed the case.”

The family said they’re devastated.

“She was loved,” Christine Cunningham said.

The fuck, what is this supposed to represent? Will someone get fired for this? They empowered this murderer and let this child die. Why can't they charge the CPS staff for contributing to her death through negligence?

Police say a 29-year-old man is facing torture and child abuse charges after the death of a 3-year-old girl from Holly Township over the weekend.

Michigan State Police say the girl was injured Saturday. he girl was alive and receiving emergency medical treatment at the scene when troopers arrived.

However, the girl later was pronounced dead from her injuries.

Michigan State Police arrested 29-year-old Samuel Smart of Holly. Investigators have not confirmed how Smart is related to the child, who was not identified.

A Michigan State Police investigator told the court that there is video of the little girl being abused. Just a day before she was pronounced dead, Child Protective Services did a welfare check on her.

Trinity Chandler is Ronda Osterberg’s great-niece.

“They failed her. They failed her big time,” Ronda Osterberg said. “There were two black eyes, there was a bruise on her cheek -- CPS closed the case.”

He was denied bond, pending his next court appearance in early January.

Investigators told WWJ they were called to the Groveland Manor Mobile Home Park, just off Dixie Highway Saturday night. They arrived to find a child had died at the scene.

Multiple media reports say the mother’s boyfriend was taken into custody at the home, but investigators have not confirmed that information.

WDIV reported the girl had “severe bruises and internal bleeding.”

“To me, it looked like healing from two black eyes. It was two,” said Ashley Brown, the mother to one of Trinity's friends.
Brown is speaking out to expose facts she says she reported to state police and CPS, including these pictures she gave of multiple bruises on Trinity's face. These are injuries the child allegedly suffered at the hands of Samuel Lester Smart, the boyfriend of Trinity's mother.

“October is when I made a report with MSP, a couple months prior I saw her with marks under her eyes. It was obvious abuse. They could have taken her somewhere safe until the investigation was over,” Brown said.

She says documented abuse goes back to August and October, but somehow Trinity remained with her mother, who would leave her with Smart.

“Nothing was done," Brown said. "She wasn’t taken. We hoped she would be, but we knew she wasn’t.”

During a virtual arraignment on Tuesday, 29-year-old Smart showed no emotion and gave only short answers as he was charged with child abuse and torture, which carries a maximum life sentence. Even more alarming, a detective says they've found video evidence that proves what took place.

Michigan State Police say Smart is the prime suspect in the child's death. Sources confirm the young girl suffered bruises and internal bleeding after being left alone with Smart at Groveland Manor Mobile Home Park.
 
An insanity defense is apparently being planned for the case against a Holly man accused of killing his girlfriend’s toddler late last year.

Samual Lester Smart, 30, faces charges of first-degree murder, torture and first-degree child abuse in the death of Trinity Chandler, 3. The little girl died Dec. 19, 2020 from blunt force trauma to the chest, as determined by the Genesee County Medical Examiner.


Smart lived with Trinity and her mother, Justine Comstock, in a mobile home in Groveland Township at the time of the child’s death. He was Trinity’s babysitter while Comstock worked overnight shifts at a residential facility for seniors. According to police, Smart was a self-described “father figure” to the child.

Court records show Smart’s attorney, Michael McCarthy, filed a notice of insanity defense on June 29.


A request for psychiatric evaluation is anticipated.


Smart’s next scheduled court appearance is for a pretrial hearing on July 28 before Judge Michael Warren.
 
i am wondering if the egg donor was ever charged? if not WHY NOT? That poor little girl's face! There is no way in hell mom didn't know or couldn't figure out what happen to this little one. And what about children's protective services? Wow give me a break.. I worked for cas (canada) both as a social worker and then a foster parent and believe me parents that have nothing to hide were more than willing to let me talk to the child privately, do play therapy (watching behind a mirror play with dolls with all settings) while said child is alone at play, in other words make sure that the child is safe. If we doubted that bruises etc were caused as parent and yes the child at times (you could tell when a child was trying to cover up) explained we took the child in protective custody for at least 48 hours while we did investigation, dr's check up etc. because our moto was : better be sure than sorry. Yes lots of paper work , going to court etc etc but imagine the consequences.. then i went from social worker to foster parent/emergency receiving cuz who else was better qualified to work with them.
 
Imagine what the CPS reps feel like after realizing they could have and should have removed this child from the home. The intense guilt. The self-hatred. The gnawing anxiety in their guts. Don't you feel bad for them? Me neither. Hope they get hit by a bus.
 
He’s an accused child killer facing life in prison, but is 29-year-old Samuel Lester Smart the only person who could be responsible for the death of a 3-year-old girl? For six months, Simon Shaykhet has been uncovering new twists in the death of Trinity Chandler.

We have confirmed CPS workers are under investigation, meaning they could potentially face criminal charges after the death of 3-year-old Trinity Chandler. An autopsy has found that the child died as a result of blunt force trauma to the heart, and prosecutors have added an open murder charge in addition to torture and abuse.

“He killed her. We know he killed her. You deserve that charge,” says Trinity's aunt Ronda Osterberg. State police have confirmed that at the time of the killing six months ago, both MSP and child protective services already had an open case into reported injuries suffered by Trinity. Even worse, we’ve learned child protective services visited the home in Groveland Township where Trinity lived with her mother and her mother’s boyfriend Samuel Smart one day before her death, but chose not to remove her for her safety.

“There’s supposed to be mandatory reporters or anchors to remove children," Osterberg said. "That’s evidence right there.”

State police have testified that Smart made a cell phone video of himself attacking Trinity, then deleted it. The footage was later recovered by detectives.

As a parent, prosecutor – as a human being – it’s the absolute worst thing I’ve ever seen and it’s impossible not to have a serious reaction to it,” said prosecutor Karen McDonald. Both CPS and the state Children’s Ombudsman investigating have refused to tell us if those caseworkers remain on the job, or even what criteria determine when a child is removed.

“No question it’s a derelict of duty and indifference at the very least. But, it’s more gross negligence of someone just not caring,” said former prosecutor Todd Flood speaking about the caseworkers at CPS. He adds that both Trinity’s mother and the CPS workers could still be charged as well.

“Prosecutor McDonald is going to look at this and make sure she does everything right,” Flood said.

Trinity’s aunt Ronda adding, “He did this on the 14th. She died on the 19th. There are five days. Five days. You come home from work and see she’s being sluggish.”

In the meantime, Samuel Smart remains locked up at the Oakland County Jail facing life behind bars.

Less than two weeks before his trial was to start in Oakland County Circuit Court, Samual Lester Smart, 31, made a deal with prosecutors, pleading no contest to second-degree homicide for the death of Trinity Chandler, 3, as well as first-degree child abuse and torture. A first-degree homicide charge was dismissed.

The vicious murder of 3-year-old Trinity Chandler in Groveland Township has left a family devastated for more than two years.

Her brutal death at the hands of her mother's boyfriend still leaves many questions unanswered.
Now, we're uncovering new information on a sentence agreement and exposing what Child Protective Services is still keeping hidden.
"Why did he have to take my granddaughter?" Christine Cunningham, Trinity's grandmother, said.

She's living in pain and left wondering how a system designed to protect children, failed to keep Trinity safe from an abuser for months.
“She had marks on her from October to December," Cunningham said.

“She was a very happy girl before all this started," her aunt, Ronda Osterberg, said.

Osterberg and Cunningham recall her beautiful smile, taken away by a real-life monster CPS case workers were warned about.
Photos shared with us by Osterberg show bruises Trinity suffered from abuse by her mother's boyfriend, Samuel Smart. They were also sent to CPS before Trinity's death.

The images didn't raise enough red flags to keep her safe from Samuel.
“I want to make sure he gets natural life in prison because he took my granddaughter," Cunningham said.
Smart had a history of violent behavior and drug abuse and was babysitting Trinity the day she died. To this day, one burning question still plagues the county's top law enforcement official.

“Did we do everything we possibly could to protect this little girl?” Oakland County Prosecutor Karen McDonald said. “Particularly a very small child with a bruise on her face. We need to ask those questions and not be afraid of the answers.”
Black eyes and bruises were all documented in a Michigan State Police report we obtained through the Freedom of Information Act.

Smart opted to avoid trial and plead no contest to second-degree murder, torture and child abuse, agreeing to a minimum of 40 years in prison.
“This is the kind of suffering and torture that every single one of us want to make sure doesn’t ever happen again," McDonald said.
McDonald also said Smart used his cell phone to videotape his "sickening" murder, and that it was the worst child abuse cas she's ever seen.

An autopsy found blunt force trauma caused Trinity's death in December 2020.

Our reporting first exposed caseworkers from Child Protective Services came to check on Trinity at her mobile home in Groveland Township the night before her death. Only, they chose not to remove her.

“As a community, we are accountable for not protecting that child," McDonald said.


Digging deeper, records show CPS had spent months investigating child abuse, yet the alarming bruises and filthy living conditions spelled out in police reports never led to a 911 call. CPS workers simply left Trinity with Smart.

"Do you still have any questions about why those workers left?” I asked the prosecutor.


“We failed this little girl. Of course, I want to know how and why," McDonald said.

“He got mad and lost control of his temper and we’ve lost her as a result," Osterberg said.

She's appalled by a lack of answers. In the report, police don't focus on whether or not CPS broke the law by leaving Trinity with Samuel. The Office of Children's Ombudsman has done a separate review, but won't release their results for another 2-3 months.

Despite several calls to Director Suzanna Shkreli appointed by the governor, our interview requests have been denied.

“I did to what I’m obligated to do. I referred this to the correct office for investigation and that took place over a year ago," McDonald said.

The Michigan Department of Health and Human Services, which oversees CPS, has also declined an interview.


In another bombshell, the department confirms two of the CPS workers who went home that night are still on the job. They won't say if they violated policy, were ever disciplined, or if any policies changed after Trinity's death.

“When they went over there the day before and she had marks on her, they could have removed her. But they didn’t," Cunningham said.

Furthermore, reports show CPS failed to take Trinity to the hospital to be examined for internal injuries the night before she died. State law speaks to the role of CPS having the authority to do so by saying, “The department shall have a medical evaluation made without a court order if the following occurs… The child's health is seriously endangered and a court order cannot be obtained…” -

“I believe they should be charged too because this went on from October to December. They kept leaving her there and could’ve called me," Cunningham said.

“I will continue to press for that investigation. Whether that’s a criminal investigation, I don’t direct," McDonald said.

Our reporting has grabbed the attention of State Sen. Jim Runestad, who is calling for a new law to hold CPS to a higher standard for transparency.
So far, there are no charges against Trinity's mother, who cooperated with police.

Mom would have to have seen the black eyes and bruises and should be charged.
 
On Feb. 22, an Oakland County Circuit Court judge sentenced a 31-year-old Holly man for the torture and homicide of a 3-year-old girl. The daughter of his former girlfriend.
Circuit Judge Michael Warren sentenced Samual Lester Smart, 31, to serve 40 to 99 years in prison for the second-degree murder of Trinity Chandler, who died Dec. 19, 2020 from blunt force trauma to the chest. Smart was also sentenced to 225 months to 99 years for child abuse first-degree for beating Chandler.
