Michael William Pelton, 37, according to his arrest affidavit, yelled at a child, 9, before the boy ran, saying he was trying to kill him on March 13, 2024.
Collier County deputies responded and witnessed Pelton screaming at a woman with two children in a car, according to Pelton's arrest affidavit.
Deputies said the child had attempted to contact his mother earlier when Pelton slapped the child multiple times, knocking out the tooth. He also kicked the child in the stomach.
The child left and went to the gate guard house of a neighboring community for safety, the state attorney's office said.
Michael William Pelton was sentenced to the maximum sentence, of 60 months in prison, for Child Abuse. He was convicted in January, following a jury trial in Collier County.
