A Springdale man under federal indictment on child porn charges is now accused of raping two juvenile girls.

Scott Surgener was indicted Tuesday on four counts of rape, seven counts of unlawful sexual contact with a minor and two counts of gross sexual imposition.

Court documents states Surgener raped two different victims. One was under the age of 13, the other was under the age of 16, the documents state.

One victim was sexually abused in July 2018, prosecutors said.

Investigators said the other victim had repeated sexual contact with Surgener between April 2018 and April 2019.

These charges, filed in Hamilton County Common Pleas Court, follow a federal indictment filed in November on child pornography charges.

Police said the nude images of young girls were discovered on Surgener's phone during the course of a sexual assault investigation.

Springdale police reported that a 12-year-old girl, a friend of Surgener’s daughter, said he grabbed her hand and place it on his genitals during a sleepover.

She “pushed his hand away and got up and (went to) on a dog bed that was in the room,” according to court documents.

Surgener denied to police any inappropriate behavior involving his daughter’s friends.

According to a federal complaint, police found “numerous images that were hidden in a calculator application” of a different girl, a 13-year-old who also is a friend of Surgener’s daughter.

The images show the 13-year-old girl engaging in explicit acts, the complaint says, including sex acts with an adult male. The girl has denied having sexual contact with Surgener.

GPS coordinates embedded in the image data shows they were taken at Surgener’s Springdale home, according to the complaint.

It is unclear if the girls described in the child pornography allegations are the same girls Surgener is accused of raping.

When I was a little girl and the subject of sleepovers started coming up here's how my mom would handle it:

1. If I wanted someone to sleepover, my mom would personally go over to my friends parents home to introduce herself, see if there were any food allergy or medication-taking needs she needed to be aware of, and assure them that there were no males in residence or "dropping by"
2. If I wanted to spend the night at a friends, well, it just didn't happen unless we'd known the family for years, and there were no teenage brothers in the house, and dad was a known milquetoast. (She didn't SAY all this, I only realized later)

But one time in 6th grade, I really, REALLY, wanted to go to a sleepover at my friends farm cause she had a HORSE! My mom didn't know them well, and hemmed and hawwed, but I kept persisting!
Finally she said "OK, you can go, but only if you eat a whole plate of the liver and onions I make the night before".
My mom could barely restrain her laughter the next 48 hours, by the way.
I really wanted to go. "I'll do it!" I said. And I did!!
I woke up with chicken pox the next morning.

My mother didn't stop laughing for the rest of her life about that.

I got chicken pox at a sleepover( I think). I had to leave early.I didn’t have any bumps that morning,got to the sleepover and the parents called my mom and told her I had chicken pox. I was sad, it was my first sleepover at a friends house

According to court documents, from April 2018 through July 2019, Surgener engaged in sexually explicit conduct with a minor in his home for the purpose of taking pictures and videos of the sexual abuse. The pictures and videos were taken in Surgener’s residence while the victim, who was younger than 13, was in his care at child sleepovers.

In total, the defendant produced 28 videos and images of the exploitation.

Surgener was charged by a federal criminal complaint in October 2019 and has remained in custody since. He pleaded guilty in February 2021 to producing child pornography.

Surgener was also sentenced to 10 years of supervised release following imprisonment and ordered to pay $3,000 in victim restitution.
