Emergency crews responded to a home on Redfield Avenue just after 9 p.m. Sunday.

When they arrived, they found the infant unresponsive after being left alone in a bathtub, police said.

Medics attempted to perform life-saving measures at the scene before rushing the baby to the hospital.

Despite their efforts, the 7-month-old later died at the hospital. He has been identified as Angel Josiah Rodriguez.

Rodriguez was reportedly in the care of family members in East Haven at the time. Investigators said Rodriguez's primary home was in Ansonia with his mother, who was not on scene and was not involved in the incident.

Police said everyone that was involved remained at the scene and have been identified. Officers previously said they don't suspect foul play.

A Connecticut mother is calling for justice after police said her seven-month-old baby was found unresponsive in a bathtub while under the care of others last weekend.

“Me, as his mom, if it’s the very last thing I have to do on this earth, I’m going to get justice for both of my kids, both of them,” said Elizabeth Portocarrero, the mother of Angel Josiah Rodriguez.
Just after 9 p.m. on Sunday, Oct. 6, Portocarrero got a phone call while at work saying Josiah was being rushed to the hospital.

“I did everything I could to give them the absolute world. And I’m so sorry my son had to go that way,” Portocarrero said.
Portocarrero said Josiah and her other three-year-old son were under the care of their father and other family members at their home when this all happened.
East Haven police said when they got to the scene, the baby was found unresponsive after being left unattended in a bathtub. He was later pronounced dead at the hospital, as Portocarrero rushed to see him.

“We’re supposed to care for them. Us. Other people are questionable but us? We’re the parents. And whatever was more important that you felt the need to step out of that bathroom cost us our beautiful seven-month-old child’s life,” Portocarrero said.
As Portocarrero fights for justice for both of her children, her niece has had to fight off insensitive comments online. She said people have been placing blame on a GoFundMe she created for Josiah.

“Being the one in charge, [it] is not easy to see what people are saying. But I’m trying to be strong for both my aunt and my mom because we all loved Josiah so much,” said Leslie Baca, Elizabeth’s niece. “I feel like her character was questioned so much. And I had so many people even writing to me, so much disgusting things about her.”
But after East Haven police sent out a statement Wednesday morning, clarifying that Portocarrero was not there at the time of the tragedy, the messages from the community have begun to soften.

Angel Marcus Rodriguez, 29, was charged with manslaughter in the second degree, two counts of risk of injury to a minor, and two counts of reckless endangerment in the second degree.
An investigation revealed that Rodriguez left two young children, one of whom was the victim, unattended in a bathtub. The child was found unresponsive in the bathtub by another family member, police said.

Rodriguez was allegedly in a bedroom down the hall on the phone. He told police that he had left the bathroom briefly while Angel was reclining in an infant bathing chair and that the faucet was on a trickle, authorities said.
Police said the family performed CPR on the infant until East Haven Fire Department medics arrived and took over.
 
A man was sentenced to five years in prison on Wednesday for leaving his 7-month-old and a toddler unattended in a bathtub at his East Haven home in 2024, when the infant drowned.
Angel Marcus Rodriguez, 30, faced sentencing in New Haven Superior Court where a judge ordered he serve three years of probation once he is released from prison, according to Judicial Branch records.

While on probation, a violation would expose him to an additional 10 years in prison, court records show. The sentencing came after Rodriguez pleaded guilty to charges of second-degree manslaughter and risk of injury to a minor in connection with the death of his infant son, Angel Josiah Rodriguez.

Angel Marcus Rodriguez addressed the court during the hearing, acknowledging what he described as his failure to look after the infant.

“We are here because I failed him,” Angel Marcus Rodriguez said. “I would give anything to have him back or even trade places with him.”
