Sentenced: 12YO Gives Birth In Lake Charles; 39YO Guardian, Jose Lopez Montoya, Accused Of Rape

A 39-year-old man is being accused of first-degree rape after a 12-year-old girl in his care gave birth at a local hospital Saturday morning.

During the investigation, the victim stated Jose Lopez Montoya, 39, has been having sex with her several times over the last two years. Vincent said detectives interviewed the suspect and he admitted to having sex with the victim and stated the child should be his.

”This was a very unfortunate situation,” said Sheriff Stitch Guillory. “He was responsible for her well-being and her mom and dad were not around, so this is a really disappointing situation. He’s a pretty sick individual.”

Guillory said the investigation is ongoing.

“There is some concern, and we will have to do a follow up investigation, it’s hard to believe that this little girl who’s under the age 13 went a nine month term pregnancy and nobody noticed and nobody said anything,” Guillory told KPLC.

Montoya was arrested on charges of two counts of first-degree rape. He was booked Saturday into the Calcasieu Parish Correctional Center on a $1.5 million bond. He also has an immigration detainer.

A Lake Charles man has been sentenced to 60 years in prison for fathering a child with a young girl in 2024.

Jose Lopez-Montoya, now 41, was arrested after a 12-year-old in his care gave birth. The victim, whose parents were not around, told investigators her guardian had been sexually abusing her for two years, and he said the baby was his.

Lopez-Montoya pleaded guilty to aggravated crimes against nature by incest last week. He was sentenced today to 60 years without probation, parole or suspension.
