The father of a two-month-old child is facing charges of first-degree murder and child abuse and his wife is facing a charge of tampering with evidence after their infant died at Children’s Hospital on Dec. 20, 2023.
Tony Vigil, 33, and Jaylyn Vigil, 30, were arrested in January by Denver police after their child, TJ was hospitalized for four days and subsequently died of “injuries sustained,” according to an arrest affidavit for the parents. According to the Denver Office of the Medical Examiner, the child died from complications from scalding, which the office said was a homicide.
On Dec. 20, the child died of multiple organ failure, according to officials, leading to an investigation and criminal charges.
The parents told medical staff, and later officers, that the child had needed a bath. Tony initially said he bathed the 2-month-old and checked the water temperature with a thermometer, which read about 50 degrees, and said the water was “lukewarm” to the touch. However, he said after the bath he saw the child’s skin was peeling and discolored, so he woke up Jaylyn.
According to the arrest affidavit, Jaylyn then called a nurse line for advice and was told to call 911 for emergency transport or bring the baby to a hospital. At the hospital, Jaylyn reported concerns that the child had suffered chemical burns from a new shampoo.
However, medical staff said the burns were inconsistent with chemical burns and more consistent with thermal burns caused by hot water. According to the arrest affidavit, around 40% of the child’s body was burned.
Medical staff conducted a CT scan on the child and found he had a bilateral brain injury. On Dec. 18, medical staff reported concerns that the child had a fractured wrist and rib.
When asked about those injuries, both parents said they were previously unaware of those injuries, according to the arrest affidavit.
Detectives viewed texts on Tony's phone between him and his wife. Jaylyn had messaged Tony and told him to clean up the beer cans and baby bath prior to the warrant. She also asked if the apartment looked suspicious, according to the affidavit.
During a short break, Tony allegedly deleted the texts from his phone. Tony claimed Jaylyn must have deleted them from her side of the conversation.
Tony noted that he had lied about having a job, per Jaylyn's request. He said "they didn’t want to lose the baby," according to records.
Jaylyn's story and timelines were inconsistent, police said. She claimed to have lied about Tony going to work and cleaning the home because she was embarrassed. Neither of the two parents were employed.
