"Just take me to jail." That is what Nichole Lynn Boyer reportedly told the Beaverhead County undersheriff on Thursday, after reporting that her almost-three-year-old son had been sick for months and now was dead.
According to charging documents, When law enforcement entered the home, they noted the smell of decomposing human remains.

Describing the entirety of the home in poor condition, with the floors and surfaces throughout the home covered in trash and rotten food, as well as animal urine and feces, EMS was directed to an upstairs bedroom where the deceased child was located on a pile of laundry, bedsheets, trash, and other items next to a mattress. The boy was covered with a sweatshirt and reportedly appeared to be in "an advanced state of decomposition."
The boy reportedly suffered from spina bifida, club feet, and hydrocephalus, a condition in which fluid accumulates in the brain. Boyer allegedly indicated the boy could only "army crawl" as a result of his medical conditions.

Court documents state the bedroom where the boy was found was "filthy," covered in trash, diapers and other items. Law enforcement noted that an air conditioning unit was running in the bedroom.
When interviewed, Boyer reportedly indicated that her son had fallen ill during the summer with a fever, but she attributed it to teething. She allegedly stated that she would check on the boy three to four times a day, delivering food and water at that time. Boyer reportedly stated that she did not remember the whole month of September and made several comments about needing to go to jail.
During an interview with investigators, Boyer reportedly said that her son could sit up on his own, but could only "army crawl" around due to his medical conditions, adding that he had the speech development of a 1-year-old child, despite being almost three years old.

Boyer allegedly told investigators that she became "overwhelmed" in August with tending to the three other minor children, ill, in the home, as well as her father, who was also sick. She also reportedly said at some point in September, she got overwhelmed and stopped caring for the child, stating, "I believe I should have done more," and agreed that her lack of care led to the boy's death.
She allegedly added that she knew the boy "had passed in September, but convinced herself that he was still alive. She didn't want to accept his death, until that morning (October 16) when she finally 'called the police on myself.'"

A 28-year-old mother in Montana is accused of fatally neglecting her special-needs toddler, allegedly telling police she became "overwhelmed" and just stopped bringing the 2-year-old food and water several weeks earlier. Nichole Lynn Boyer was taken into custody earlier this month and charged with one count of deliberate homicide in her young son's horrific death, court records show.
The victim was said to be "significantly disabled," as he suffered from spina bifida, club feet, and hydrocephalus (a condition that causes significant pressure on the brain).
According to a probable cause affidavit obtained by East Idaho News, deputies with the Beaverhead County Sheriff's Office responded to a call on Oct. 16 about a deceased child. The caller identified herself as Boyer, who said her son had been "sick for months and was now deceased."
Upon arriving, first responders said Boyer made a statement to the effect of "just take me to jail." Deputies said they quickly "observed the smell of decomposing human remains" when they went inside the home, which was also covered in "trash and rotten food, as well as animal urine and feces."
EMS directed deputies to an upstairs bedroom where they found the boy "on a pile of laundry, bedsheets, trash, and other items on the floor next to a mattress."

"The child was covered up with a sweatshirt that Boyer later indicated belonged to her," the affidavit said. "The child appeared to be in an advanced state of decomposition."

The bedroom where the boy was located was described as "filthy" and had the air conditioner running even though the temperature outside was about 44 degrees.
When questioned by police, Boyer said she used to check on her son three to four times per day, but added that she "did not remember the whole month of September" before making "several comments about needing to go to jail."

As the questioning continued, Boyer said she kept the victim in a "padded area" of the upstairs bedroom and would typically set his food on the ground and let him "army crawl" to it when he was hungry (as his medical condition prevented him from walking). However, she said she "became overwhelmed in August" with caring for her three other children and her father.
Boyer said that she didn't know the last time she actually remembers [her son] eating, and that she stopped giving him water sometime in September. Boyer was unclear whether she stopped giving S.B. food and water before or after he was deceased. When asked if S.B. starved to death, Boyer said she didn't know. When asked if S.B. froze to death, Boyer stated that she didn't think so.
Boyer stated that she knew S.B. had passed in September, but she had convinced herself that he was still alive. She didn't want to accept S.B.'s death until that morning, when she finally "called the police on myself."

This woman knew she wasn't capable of keeping this child alive at the time he was born, I'm also sure that everybody at the hospital where he was born knew she couldn't handle all that, why did they allow her to keep him, why did she want to keep him, why not give him a better life, hell, just life itself by giving him to someone capable who wants to care for him?
 
A 48-year-old grandfather in Montana is accused of fatally neglecting his disabled grandson, allegedly refusing to help the toddler even when the victim's mother stopped bringing him food and water.
Christopher Michael Cox has been charged with felony negligent homicide and misdemeanor child endangerment in the boy's horrific death.

In court documents filed late last month, prosecutors alleged that Cox caused the toddler's death by failing to provide him with the basic needs necessary to sustain life, according to a report from Butte CBS affiliate KXLF.

The latest filings reportedly confirm that the victim was born with spina bifida, a disability that left him immobile. Those documents also asserted that the family's home was "squalid and unsanitary."
Cox is the second person charged in connection with the 2-year-old's death. The toddler's 28-year-old mother, Nichole Lynn Boyer, was arrested in October 2025 on one count of deliberate homicide.
