A Mineral County man has been charged with assault of a minor for slamming a child to the ground during the national anthem at the Mineral County fairgrounds.

The 13-year-old boy was flown to Spokane after receiving temporal skull fractures in the incident that happened at the Mineral County Fairgorunds.

Witnesses tell MTN News that Curt Brockway grabbed, picked up and slammed the boy on the ground because he did not remove his hat during the national anthem.

The parents tell us the child was bleeding from his ear for nearly six hours after the incident.

“It’s just a lot of pain in my head. I don’t remember anything – the rodeo – the helicopter – nothing,” the minor told MTN News.

Brockway was arrested on Saturday night and made his initial court appearance on Monday in Mineral County.

The state requested his bond be set to $100,000, however the judge ruled Brockway can be released on his own recognizance. Brockway had not been released as of 5 p.m. on Monday.

This is not Brockway’s first run in with police. He pleaded guilty to an assault with a weapon charge that occurred in 2011.

In eight short but relatively easy-to-understand rules, the author handily outlinesappropriate cowboy hat etiquette to a “T.” Rule number one is fairly straightforward: “Do not touch my hat.” Identifying that a cowboy hat isn’t a toy and how it’s not okay to randomly take one off of someone’s head, or snatch one up and put it on any old place you’re at, the author makes note of only one exception in this instance. As a fiancé or a grandchild, your boundaries are little broader. Rules two, three, and four deal with where to wear a cowboy hat and how/when to tip it. Respectively, they read: “Do not wear your cowboy hat in mama’s house…Tip your hat like you mean it…Wearing Hats Indoors is complicated.” The protocol for each is clearly defined as best as possible and in the most gentlemanly or ladylike fashion of the day.

And, almost every Texan can understand and appreciate rule number five, which reads: “The Dance Floor Dilemma.” This is, of course, in reference to how or when, or even if, you should wear your cowboy hat while dancing. Our dance halls, bars, and honky-tonks are often filled-to-overflowing with those that have donned their best hat for a night out on the town with their sweetie. Men and women alike will approve of the True West writer’s comments that, “In the old days, cowboys wore their hats to dances and never took them off, especially while struttin’ around the dance floor. But, so many fights broke out when hats got bumped during dances that there are still places—mostly in Texas—where there is a hard and fast rule that you must take your hat off while dancing.”

I think this is a bit outdated. What do you mean 'as a guest'? I mean I'm a 'guest' in my friend's house but I'm not taking off my baseball cap.
Interesting point. When those etiquette rules originated, men wore hats as "outer garments" only. They weren't something you generally kept on once inside. Modernly, we have some hats that people customarily do keep on inside (baseball caps, those ugly knit beanies, etc). Do the old rules apply to those kinds of hats? Should they?

Also, the rules about taking your hat off only ever applied to males. If a woman was wearing a hat, she was not expected to take it off on those same occasions. How, if at all, should that be changed to fit modern times and sensibilities?

Mind your own damn business. If the kid wanted to twerk during the anthem, that’s his goddamn American right. Not his kid, and should not have been his problem.

Looks like he does have a son though, via Facebook. I pity the rest of his life.

I’d give odds, if someone twerked during the national anthem they’d get a foot planted in their ass from someone

Sure, it’s possible but not likely. Most people aren’t this pathetic, but a select few people do manage to achieve a bunch of dumb shit. And any adult who cares SO much about what some random ass 13 year old boy is doing with a hat that he would attack a child is just about as pathetic as they come.

I can’t fathom doing anything more than rolling my eyes at 13 year old weirdos. Guess this is what it must be like to have nothing actually important to bother yourself with.

I said twerking, nothing about the hat
Look the asshole was pathetic, if that was my kid
That dude wouldn’t have made it out of there
But I do feel one would get a nasty reaction from twerking

A Montana man allegedly assaulted a 13-year-old boy who he believed had disrespected the American national anthem at a county fair in the state. Curt James Brockway, 39, of Superior, is accused of assaulting the boy at the Mineral County Fair and Rodeo at around 11 p.m. on Saturday.

"There was a little boy lying on the ground," Taylor Hennick, who was as the rodeo, told Missoulian. "He was bleeding out of his ears, seizing on the ground, just not coherent."

According to KPAX, witnesses saw a man pick up a boy and throw him to the ground. Brockway reportedly tried to justify his actions to nearby fairgoers. Hennick told Missoulian: "He said [the boy] was disrespecting the national anthem so he had every right to do that."

The boy, whom authorities identified only as 13-year-old, was flown to Sacred Heart Children’s Hospital in Spokane, Wash., with temporal skull fractures, KPAX-TV reported. His parents told the station he was bleeding from his ears for nearly six hours after the alleged assault. He has since been released from the hospital and returned home for recovery

Hope this patriotic fuckwad has lots of $ for the medical bills and lawsuit. I saw nothing about the father's reaction when this happened; surprised he didn't punch him out?

I can't really understand from the replies here if some of you were joking or serious. Did someone make it a law that you had to take your hat off for the pledge? Or stand? I don't see the kid as being disrespectful just for standing or sitting there. Please enlighten me.
