Kristina Gensheimer, 35, was convicted last month of neglect of a dependent as a Level 6 felony. She was sentenced on Thursday to 40 days in prison after getting 110 days suspended and 380 days of good time credit.
The charge against Gensheimer stems from the death of her 4-month-old baby girl Emma, who died in August 2024 after being found unresponsive inside her near north Indy home.
EMS and police crews were called around 11 a.m. on Aug. 25, 2024, for an unresponsive infant. Upon arrival, they found Emma with “no signs of life” and took her to Riley Hospital in critical condition.
The child’s mother, later identified as Gensheimer, told officers that she had woken up to find Emma on the floor of the bedroom. When officers arrived, they found Emma with a badly soiled diaper and a limp body.
The child was later pronounced dead at the hospital. However, no trauma was visible and the only outward sign of injury was a severe diaper rash. An autopsy later concluded that Emma died from “sudden unexplained death of an infant, with intrinsic and extrinsic factors,” including:
- Cytomegalovirus (CMV) infection (related to herpes simplex)
- Co-sleeping with her mother
- Falling from an adult-size bed
The child’s manner of death was undetermined.
During an interview with Gensheimer, she stated that she was in recovery for drug abuse. She reportedly did not have any complications during pregnancy, but the mother admitted to using heroin, methamphetamine and nicotine vapes “daily” in the months leading up to Emma’s birth.
Emma was born approximately six weeks early, weighed 5 lbs., 6 oz. and was 27 inches tall. The child was also reportedly in withdrawal from heroin when she was born, spending over a month in the hospital due to her drug-related symptoms. She was discharged on May 5.
Gensheimer went on to say Emma was in foster care approximately six weeks after being released from the hospital, but that the baby had been living with her for the past 2.5 months. Emma had reportedly been sleeping in bed with her mother, not in her bassinet.
When asked about what had happened on the morning of Aug. 25, Gensheimer said she woke up at 6 a.m. and fed Emma a bottle. She then reportedly took GHB, better known as “liquid ecstasy” or the date rape drug “roofies,” and went back to bed next to Emma.
Gensheimer said that when she woke up, both she and Emma were on the floor of the bedroom. The infant child was reportedly lying on her back facing the ceiling, her body cold and her lips purple. Gensheimer said she then called 911 and began doing CPR on Emma.
Witnesses who were close with the mother and daughter told officers that, in the days leading up to her death, Emma was very fussy and had a fever. Gensheimer had reportedly tried to give Emma some Tylenol, which did not seem to help.
If the baby was never returned to her she would still be alive. How this cunt could get a slap on the wrist is disgusting.
She could actually be out in twenty days if she receives good time on the 40 day sentence.
