A man in B.C. received no jail time after he killed his cat and assaulted his wife when he got angry that no one threw him a birthday party.
The decision from the Provincial Court of British Columbia said the man, Brendon Nguyen, pleaded guilty to assaulting his spouse, Tashina Matilpi, and killing his cat named Vesper.

The disturbing events occurred after Nguyen's birthday on July 15, 2020. The next day he started arguing with Matilpi about the fact that he did not get a party for his birthday.

According to the verdict, he had been drinking when they argued, and it became loud enough to possibly disturb the couple's two-week-old child. When Matilpi tried to get him to be quieter, he "became physical and pushed her with an open palm causing her to fall backwards onto an air purifier in their apartment."

Matilpi and Nguyen had two cats together, Vesper — who was killed — and Macey. On the same day that he assaulted Matilpi, Nguyen tried to take his cats from their balcony. According to the court's write-up, he then walked into the living room and asked Matilpi where the cats were, even though he was just with them.

Matilpi later said to the police that this lead her to believe that her husband was in a blackout from drinking. She specified that it was not the first time that she had seen him in that state.

Nguyen then left the apartment and Matilpi searched for the missing cats, finding Macey "in the closet wrapped in a towel inside of a small bucket with the lid on. Macey was alive, but scared," the report said.

When Nguyen returned home he said that he'd been with Vesper downstairs for about 45 minutes. He then asked Matilpi to "get the building manager to check the building security cameras."

After finding out that Vesper had been killed, Matilpi noticed that Macey had injuries. "She took her to the SPCA in hopes of treatment, but ultimately was unable to afford the medical bill, so Macey had to be euthanized," the document states.

Nguyen said that he had no memory of the events. The decision describes that he was "under the influence of extreme intoxication by alcohol and/or drugs and that this tragic incident was not premeditated," which was one of the reasons the judge gave to explain why he did not receive any jail time.

He received a 12-month conditional sentence and one-year probation.

big ty :) and if this female takes him back what next? the next time he drinks or do drugs his next victim might be her baby... the law in this case sure is telling him it wasn't his fault that he killed their pet and injured the other one so badly that it had to be paste... this could happen only in canada :( ... wake up canada supposedly justice and make people responsible for their own actions... he chose to drink or do drugs till he was supposedly in a stupor so his actions and should have the full consequences of his cruelty ...

Here's a bit more info about how he killed the cat.
Looking for the cats, she found Macey in a closet, wrapped in a towel inside of a small bucket with the lid on.

“Macey was alive, but scared,” Stanford said.

Matilpi later examined Macey more closely and found she had a bleeding nose and scratches. She took her to the SPCA in hopes of treatment but ultimately was unable to afford the medical bill. Macey was euthanized.

At 3:45 a.m., Nguyen called saying Vesper had run away and that he wanted the building manager to look at the building's security cameras. What those cameras recorded was “Mr. Nguyen stomping on Vesper."

The tape was not viewed in court.

The assault lasted about 11 minutes, "from the first kick to Vesper's last sound."

The cat was later found by the building manager wrapped in a pink sweater in a nearby dumpster.

“I find that the imposition of a jail sentence appropriate in light of the circumstances of Vesper’s prolonged multiple assaults and ultimate death,” Stanford said.

“However, I am mindful there were clear signs, on the agreed facts, that Mr. Nguyen was under the influence of extreme intoxication by alcohol and/or drugs and that this tragic incident was not premeditated. In my view, this lowers Mr. Nguyen’s moral blameworthiness.” https://www.vancouverisawesome.com/...e-after-he-didnt-get-a-birthday-party-4914082

Did he purposefully pursue a course of action that led to his inebriation? If he did then he owns this. If he didn't then he doesn't. The court in BC fucked up.

expecting to see lots of slap-on-the-wrist sentences for lots of DUIs

Was this Nguyen's fourth or fifth birthday? Hard to tell as he was behaving like an overgrown toddler.

Intoxication shall not excuse this. He was pissed that a two-week old child was demanding its mother's attention (the nerve!) and he wasn't getting any ... especially in the sack.

The kitties were probably the most mature creatures in the household.

His next birthday should be spent in a homeless shelter. I'm sure his roomies will be very happy to celebrate with whatever government funding he may be able to apply for.
