A judge has ordered the man accused of killing his girlfriend’s son and storing his body in a freezer to return to court “by any means necessary” after refusing to appear Tuesday.

Brandon Toseland, 37, faces a murder charge in the death of 4-year-old Mason Dominguez. Police arrested Toseland on Feb. 22, 2022, after Mason’s mother was able to sneak messages into her 7-year-old daughter’s shoe. Toseland is charged with 12 felonies, including murder, child abuse, kidnapping, and battery domestic violence.

Toseland, who has remained in custody since his arrest, was due to appear in court Tuesday on a motion to continue his trial and replace his lawyers, records said. Toseland refused to meet with his attorneys three times in March and refused transport from jail to the courthouse Tuesday, documents said.

On Tuesday, Clark County District Court Judge Carli Kierny granted the trial delay, ordering the jail to bring Toseland to court next week “by any means necessary” for an April 9 hearing.

Recent court hearings in the case have involved a home security system, which Toseland said could provide valuable evidence in his defense. In court last year, Toseland’s attorneys said his home had five security cameras, which recorded to a server. They have asked Kierny to force prosecutors to hand over all video surveillance in their client’s case, but prosecutors have said Cox Communications, which administered the system, said there was no footage.

Toseland’s attorneys have said they have “compelling evidence that the entire Cox system was funded and operational at the time of the defendant’s arrest in February 2022,” documents said. They added a panel on the server was removed and allegedly damaged.

Also, imho, having a bunch of security cameras in your home on constantly is a huge red flag. It's fucking weird, and 99% of the time seems to be a sign that someone in the house is at best a massive control freak.

No fucking way would I want my every move recorded in my own home.
