The initial handling of allegations that former “Empire” actor Jussie Smollett staged a fake attack in Chicago was a “major failure” by the local prosecutor’s office, according to a damning investigative report released Monday.
The 60-page report by special prosecutor Dan Webb, who was appointed to review the case, detailed several instances when Cook County State’s Attorney Kim Foxx and others in her office made false statements in 2019 when they first prosecuted Smollett and then abruptly dropped the charges weeks later.
Jussie Smollett will be sentenced on March 10 after he was convicted of five of six counts in his hate crime hoax case, Fox News Digital can confirm.
There will also be a status hearing on Thursday, Jan 27.
Actor Jussie Smollett filed paperwork seeking either a new trial in Chicago or a not guilty verdict two months after he was convicted of falsely reporting a hate crime against himself in 2019.
The former "Empire" star filed the 83-page document claiming his constitutional rights were violated when the court prevented his legal team from actively participating in the jury selection process. The story was first reported by TMZ.
In documents obtained by NBC News, Smollett and his attorneys argue that the court "made numerous trial errors leading up to the trial and during the pendency of the trial."
They say that they were not allowed to ask questions of the potential jurors which prevented them from discovering any possible biases or "questionable impartiality" toward Smollett given the case being high-profile.
The filings describe one instance where a juror informed the court that several of her family members were either current or former law enforcement. The court did not inquire further into her statements and did not allow Smollett's attorneys to do so, the document states.
The actor's defense team also said the evidence presented by prosecutors during the trial was "insufficient and inconsistent so that no reasonable trier of fact could have found Mr. Smollett guilty beyond a reasonable doubt and thus there is evidence that the jury verdict was contrary to the manifest weight of the evidence."
“As such, the Defendant now respectfully requests that his convictions be vacated or in the alternative, that the Court grant the Defendant a new trial," the filing says.

CHICAGO – The curtain is closing on Jussie Smollett’s hate hoax saga.
The disgraced actor, 39, will be sentenced Thursday at the George N. Leighton criminal courthouse in Chicago three months after a jury found him guilty of lying to police following his eight-day trial in December.
Smollett, who was convicted on five counts of felony disorderly conduct and acquitted of a sixth, is facing up to three years in prison, but it’ll be up to Judge James Linn if he gets any time at all.
Legal experts have said it’s unlikely Smollett will be given a prison sentence considering his mostly clean criminal record and the non-violent nature of the charges, which are low-level, Class 4 felonies.
Jussie Smollett maintained his innocence during his sentencing hearing Thursday after a judge sentenced the former “Empire” actor to 150 days in jail for lying to police about a racist and homophobic attack that he orchestrated himself.
Cook County Judge James Linn sentenced Smollett to 30 months of felony probation, including 150 days in the county jail. Linn denied a request to suspend Smollett's sentence and ordered he be placed in custody immediately.
Smollett was also ordered to pay $120,106 in restitution to the city of Chicago.
Smollett loudly declared innocence after the sentence. “I am innocent. I could have said I am guilty a long time ago,” Smollett shouted as sheriff’s deputies led him out of the courtroom, capping an hourslong sentencing hearing.
Linn excoriated Smollett prior to delivering his sentencing decision and pronounced himself astounded by Smollett’s actions given the actor’s multiracial family background and history working on behalf of social justice organizations.
“For you now to sit here, convicted of hoaxing, hate crimes ... the hypocrisy is just astounding,” Linn said.
Before Linn handed down the sentence, Smollett’s defense attorney Nenye Uche asked Linn to limit the sentence to community service. He said Smollett “has lost nearly everything” in his career and finances and asked that Linn give him time to make restitution if that is part of the sentence.
Witnesses for both the state and Smollett testified at Smollett’s sentencing at the Cook County Courthouse. Chicago Police Supt. David Brown, who was called by the state, submitted a statement that was read aloud by Samuel Mendenhall, a member of the special prosecution team.

“One of Smollett’s siblings received the alarming call Friday morning on the number that was given as his emergency jail contact when he was taken into custody Thursday night following sentencing for his hate hoax conviction, a Smollett spokeswoman says,” the magazine said. “‘I hope what they do to that guy in jail — here’s what they’re going to do, right.
