If they both can be deported they should be. I get the woman was abused but she will not protect her children from the next dick she picks.

Detectives arrested 23-year-old Johnathan Castillo and 26-year-old Jessica Brusuelas. Castillo is accused of using fentanyl and meth around their two children, whom he allegedly hit and spanked multiple times. Brusuelas is accused of spanking their 4-year-old child and not reporting Castillo’s alleged abuse.
According to a criminal complaint, Castillo hit the 3-month-old child in the head with a closed fist while Brusuelas tried feeding them Monday. The baby fell asleep but was found not breathing hours later.

Brusuelas called 911. When paramedics arrived, Castillo allegedly answered the door, handed the baby to them and shut the door.

Paramedics rushed the baby to the hospital. Doctors found the baby had been exposed to drugs and suffered several skull fractures and hemorrhaging on their head. The baby also showed signs of multiple other instances of physical trauma.
Police noticed “patterned bruising” on the 4-year-old and learned Castillo allegedly whipped the child with a belt. They also learned he allegedly punched and choked Brusuelas multiple times and began abusing the infant when they were just 1-month-old.

Castillo faces two counts of felony child abuse and a count each of aggravated battery against a household member and tampering with evidence. Brusuelas faces charges of felony child abuse – resulting in great bodily harm – and a misdemeanor count of failure to report child abuse.
 
The Albuquerque Police Department has now advised that the infant, who is identified as Mika Castillo, has died, three days after being rushed to the hospital.
The parents, who are facing multiple charges, including child abuse resulting in great bodily harm, will now face upgraded charges due to the death of the infant.

The additional charges are currently unknown.
Brusuelas said Castillo was attempting to feed the baby and he became annoyed with the noises the baby was making. Adding, Castillo struck the baby several times until she calmed down and went to sleep. On Monday afternoon, Brusuelas said she woke from a nap and she said Castillo told her the baby wasn’t breathing and she had blood around her mouth and on her gums. Doctors reported that the bay had suffered severe physical trauma, including several skull fractures, a subdural hemorrhage, and extra cranial hemorrhage.
