Police fear a 7-month-old baby boy is dead after he was kidnapped from an Upper Darby home by the mother's boyfriend who has a history of making threats.

The kidnapping suspect, Ummad Rushdi, dated the child's mother for less than a month. He is accused of taking the infant, Hamza Ali, from Upper Darby to central Pennsylvania, said Upper Darby Police Superintendent Michael Chitwood at a Wednesday morning news conference.

"We don't know where Hamza is, we hope Hamza is alive but right now we don't believe that Hamza is alive," said Chitwood.

Police got a call from the infant's mother Tuesday night and she reported that she, Rushdi and the child had been visiting Rushdi's parents in Upper Darby over the weekend, Chitwood said.

She said Rushdi took the baby early Sunday morning and that she believed he was heading back to York, Pa. where they both live.

"We believe Rushdi then buried the child somewhere up there and we are trying to find that child," said Chitwood.

Police in central Pa, with the help of the FBI, searched for the child with a cadaver dog off Route 30 in Columbia, Lancaster County, where Rushdi's car was found abandoned.

Rushdi, 30, was arrested around 2:30 a.m. Wednesday at 979 Castle Pond Drive in York, the home where he lived with the mother and baby.

Investigators say at the time of arrest, Rushdi had a knife, handcuffs and $800 in cash. He also had a criminal record including serving probabtion in Philadelphia after being found guilty last year of making terroristic threats and disorderly conduct, according to court records.

He also was found guilty of disorderly conduct and defiant trespass for a 2011 incident in York County, according to court records.

Police believe the boy was taken from the home before the mother was awake.

"Apparently they were sleeping inside 6604 Chestnut Street. Rushdi was in the room, by himself with the baby. There was some type of interaction where the baby died and Rushdi did not want to share with the mother that the baby had died so he drove the baby out of that location," Chitwood said, but added this was preliminary information as the investigation begins.

A man accused of kidnapping his girlfriend's 7-month-old son told his brother he killed the crying child by shaking him and then buried him in an undisclosed location, according to a search warrant affidavit released Thursday.

Ummad Rushdi, 30, told Jawwad Rushdi, 32, on Monday that Hamza Ali's killing occurred in a suburban Philadelphia home a day earlier, the warrant said.

Ummad Rushdi told Jawwad Rushdi that he shook the crying baby and that the infant then became unconscious, according to the affidavit.

“Jawwad stated that Ummad told him that he attempted CPR, but was unable to revive Hamza,” police wrote in the affidavit. “Ummad further advised Jawwad that he took the child from the residence and buried him, but did not tell him where.”

Police said Ummad Rushdi is the boyfriend of Hamza's 20-year-old mother, Zainab Gaal. The couple had been together about three weeks, police have said.

“His face was completely white, like he was spooked or something,” Darryl Heverling said. Heverling offered him some leftover hamburger casserole, but he turned it down.

“It was really disturbing,” Heverling said. “He said something about meditating and people with guilty consciences and clearing his mind.”

Police said they believe there's a reason Windsor Township resident Ummad Rushdi won't tell them where he allegedly buried Hamza Ali, his girlfriend's missing 7-month-old baby.

"We believe that the boy was beaten significantly ... (and) that's why he won't say," Upper Darby Township Police Superintendent Mike Chitwood said.

Hamza's mother, 20-year-old Zainab Gaal, has told investigators she and her son lived in "horror" inside the 979 Castle Pond Drive home where Rushdi lives with his brother, other family members and several boarders, according to Chitwood.

"Her word -- not mine," he said, adding Gaal moved to York County from Maine. "She moved down here for a better life, but she moved into hell. ... She was almost held captive by this guy."

Gaal indicated Rushdi dominated her and abused Hamza, according to Chitwood.

"He did not like this baby because the baby was not his," the superintendent said. "He tortured the baby, according to the mother."

Gaal told investigators that when she tried to intervene, Rushdi physically and verbally abused her, the superintendent said.

"She was truly scared to death, afraid (he was) going to kill her," he said.

Chitwood said investigators suspect Hamza was buried at a location not far from where Rushdi abandoned a vehicle Sunday near the intersection of Routes 30 and 441 in Columbia. After the vehicle became mired in mud, two good Samaritans gave Rushdi a ride, he said.

Several search dogs have alerted on a spot not far from where police found the abandoned vehicle, Chitwood said.

"We found evidence to indicate that the baby was back there," he said. "We suspect that the baby was buried in the brush there, and we think the baby was moved (later).

The superintendent said even though Hamza's body remains missing, Rushdi will be charged with killing the baby. That will happen after consultation with the Delaware County district attorney, he said.

"We feel very comfortable we have probable cause," Chitwood said. "Next week we'll charge him with murder. But right now our priority ... is to find that body."

This poor baby boy. He was such a sweet child and only wanted to be loved and nurtured. I have no use for the egg donor or the Superintendent. They both knew he was abusing this baby. Neither one had the brains to call the police.. Fuck them. Lock them both up and fry the fucker who murdered this sweet baby boy.

Police say the young mother of a 7-month old baby boy — now missing and presumed dead — had been living a life of horror for the past several months.

"Based on our investigation, this guy was holding that baby and the mother in an era of horror for three months before the baby died," Police Superintendent Michael Chitwood said Friday.

Chitwood, a normally steely veteran law enforcement officer, was so disturbed by the details in the most recent interview with 20-year-old Zainab Gaal that he said, "I nearly started crying."

Investigators said the Somalian-born Gaal and her infant son had left Maine, where they had been living, three months ago in search of a better life. She had become friendly with the girlfriend of Ummad Rushdi’s older brother, Jawwad, who convinced her to move to York County and live with them, Chitwood said.

Gaal, described by police as very articulate, was told she would be cared for and the baby educated here in Pennsylvania.

"She had no job, so she came down here thinking she could change her life," Chitwood said. "But she walked into hell."

Search teams remain in rural Lancaster County looking for Ali, missing since Sunday and believed to be dead.

"We found physical evidence to support our theory that the baby was initially buried up in that area, but we think the baby was moved to another location," Upper Darby Police Superintendent Michael Chitwood said. "We’re covering all of our bases."

Two days of grid searches along Route 30 in Lancaster County and a search in Upper Darby failed to locate the baby. Five Upper Darby police officers are in Lancaster County looking for the missing boy. Two K-9’s from the Delaware County Sheriff’s Office joined the search on Friday.

When asked about a possible co-conspirator, Chitwood said investigators are looking at all angles, then added the baby was missing for three days before Ummad Rushdi was arrested.

A Windsor Township man charged with kidnapping a 7-month-old baby who police say he killed and buried in York County was on the terrorist watchlist, the FBI confirmed.

Edward J. Hanko, the special agent in charge of the Philadelphia division of the FBI, confirmed Ummad Rushdi was on the watchlist and told the Philadelphia Inquirer: “I don’t know why he was placed on the list, or for that matter who put him on the list.”

An unnamed federal law enforcement source confirmed to the York Daily Record/Sunday News that Rushdi had been on the list but was removed some time ago. The source would not provide further details.

So, what does someone do to land on the list?

Specific criteria are classified, according to Trent Duffy, public information officer for the FBI’s Terrorist Screening Center. However, Duffy said there is a tiered process before someone is listed.

“First and foremost, that person must meet what is called the reasonable suspicion standard,” Duffy said, explaining that a person must be “reasonably suspected of having known or suspected ties to terrorism.” He called the process “very rigorous.”

“If you get a tip from someone (who suspects someone is involved in terrorist activity,) the intelligence community looks into it and makes a determination if there’s other information across the intelligence community.”

Duffy said the FBI assesses people wholive in the United States, and the National Counterterrorism Center assesses people who live outside of the country to determine whether those individuals get nominated to the Terrorist Screening Center, which reviews intelligence.

“It’s the Terrorist Screening Center that makes the ultimate decision,” Duffy said.

Although there are “hundreds of thousands of people on the list,” Duffy explained, each of them was listed after thorough examination.

“If somebody calls and says ‘My neighbor’s a terrorist, does that get them on the list? The answer is ‘no,’” Duffy said. “That (tip) gets looked into, and there’s a lot of rigor that goes into that.”

Duffy said the way someone would be removed from the list is the same thorough process but in reverse.

Gilliam said that in his experience, some of Rushdi’s alleged behavior, as described by his former defense attorney, “would definitely put him on a list.”

After he was charged in connection with a November 2008 hit-and-run crash in Springettsbury Township, Rushdi’s lawyer, Kelley Black, asked a judge to schedule a competency hearing for her client.

Black wrote that Rushdi “had bizarre outbursts in front of his attorney when trying to prepare for his pre-trial conference,” and further noted he “is religiously preoccupied.”

She said his parents had noticed “bizarre behavior ... upon his return from a recent trip abroad,” and noted he “spoke in a foreign language in front of the court, despite speaking English.”

She also said Rushdi “has evidenced signs of mental illness/mental incompetence via his actions and statements,” and argued Rushdi may not be able to stand trial because of his “apparent on-going mental illness.”

A hearing was scheduled, but it was canceled, and the charges in the case were not prosecuted.

A man accused of snatching a 7-month-old boy is now accused of killing the boy and trying to conceal the death.

“This is a barbaric act committed by a barbarian,” said Upper Darby Police Superintendent Michael Chitwood at a Tuesday press conference.

On Tuesday, charges were upgraded against Ummad Rushdi despite authorities not finding a body of Hamza Ali.

“We will move forward now without the body,” said Chitwood.

Rushdi was arraigned Tuesday morning on not only the existing kidnapping charge but also criminal homicide, first-, second- and third-degree murder charges, concealment of a child's whereabouts, tampering with evidence and abuse of a corpse, according to court documents.

Magisterial Judge Harry Karapalides revoked Rushdi's bail as well.

Chitwood said investigators believe that Rushdi beat the baby to death because the baby interfered with Rushdi's life. Investigators believe that Rushdi murdered the baby and disposed of his body because he felt the child was hindering his relationship with the mother.

Chitwood said that Hamza's mother, Zainab Gaal, wanted to take the boy for hospital treatment a few days before he disappeared, because Rushdi apparently injured his arm or shoulder. Police said Gaal was prevented from doing so by Rushdi's family.

Police suspect Rushdi may have first buried Hamza near the Susquehanna River town of Columbia, as his brother's vehicle became stuck there on Aug. 4. They think he may have then exhumed the boy's remains and given him a religious burial in another location.

Police asked for information about either Ummad or Jawwad Rushdi, as well as a leased cab that Jawwad Rushdi drove. They asked people for information related in particular to the time period Aug. 4-6.

“We definitely need some luck but we also want people to pay attention to what they might have seen that could help in this investigation,” said York Police Captain Tom Gross.

Police have said Jawwad Rushdi has been cooperative, and he hasn't been charged with a crime.

The brother of the Windsor Township man facing the death penalty for allegedly kidnapping and killing his girlfriend's son has been arraigned on charges for an incident at the courthouse Wednesday afternoon.

Jawwad Rushdi, 33, of the 900 block of Castle Pond Drive, Windsor Township, is facing criminal charges for allegedly going "ballistic" in a courthouse hall and attempting to attack the lead investigator in the murder case, police said.

"(Criminal Investigator Edward) Silberstein was at the courthouse for a grand jury," Police Supt. Michael Chitwood said of Wednesday's incident with Jawwad Rushdi. "Rushdi had just visited his brother at the prison and came to the courthouse to hook up with his family. (Silberstein) greeted him and held out his hand and (Rushdi) started threatening him. He went ballistic."

Silberstien tried to calm down Rushdi, Chitwood said, but could not.

"He was out of control," Chitwood said.

According to the affidavit, Rushdi yelled at Silberstein saying, "You are corrupt, the system is corrupt, Chitwood is a liar, and you and the FBI have been harassing me and my family." He added, "You and your people have been killing people overseas and nothing happens to them ... You're a terrorist."

Investigators have said Ummad Rushdi allegedly told Jawwad Rusdhi he had shaken Hamza to death when the boy would not stop crying and then buried him in an undisclosed location.

The baby never has been found despite extensive searches in wooded areas in York and Lancaster counties.

According to Chitwood, Wednesday's incident occurred 4:30 p.m. outside Courtroom 12. A woman with a black eye, who had come to the courthouse for a protection from abuse order, heard the commotion and told Rushdi to "take it easy," and not to talk to the officer like that. "He told her to shut her mouth or he would blacken her other eye," Chitwood said.

Chitwood described Rushdi's outburst as "unacceptable behavior."

"He can't terrorize the lead investigator in a homicide investigation," Chitwood said. "We have zero tolerance for any threats. So he got locked up in the same prison his brother is being held."

Rushdi was arraigned on charges of disorderly conduct for attempting to engage in fighting and two counts each of terroristic threats and harassment. Bail has been set at 10 percent of $50,000 pending a preliminary hearing Nov. 25 before Magisterial District Judge Stephanie Klein.

Cute. What kind of woman gets involved with a guy like this? Moreover, what shitty sort of mother entrusts her infant to a man she's known for three months? I get that he didn't have "permission" to leave with the babe, but the fact remains that this man was permitted unrestricted access to her baby.

And I don't buy that he just up and decided to visit the baby in the middle of the night while mom allegedly slept and then shake him when he wouldn't stop crying. I'd wager the baby woke up crying and Rushdi ended up "taking care of him."
 
I applaud the restraint of those who witnessed him telling an abused woman that he would give her another black eye if she didn't keep quiet. I cannot say that I could have showed such restraint but I can say that I would be facing some nifty aggravated assault charges had I witnessed that.

Accused baby-killer Ummad Rushdi has been deemed incompetent to stand trial for the 2013 death of 7-month-old Hamza Ali.

Delaware County Common Pleas Court Judge James Nilon indicated Rushdi, who faces charges of first-, second- and third-degree murder, kidnapping and abuse of a corpse, would be under lockdown at Norristown State Hospital until that designation changes.

Attorneys in the case are under a gag order and are not allowed to discuss Rushdi in any way, said defense counsel Mike Malloy Tuesday.

The only substantial testimony in the case to date came during a 2014 suppression hearing, in which Upper Darby Detective Ed Silberstein testified that Rushdi confessed as Upper Darby Capt. George Rhoades was trying to advise Rushdi of his rights.

“Ummad began blurting out he’s sorry for what he did,” Silberstein said. “(Rushdi said), ‘The baby, he was crying. I shook him, I took him upstairs, maybe a little bit too hard, he stopped breathing. I gave him CPR. I wrapped him in a sheet. I put him in the car. I took him to York. I buried him under branches. When I get out of jail, I will dig him up and I will bury him in my backyard.’”

Rushdi was taken into custody in York County Aug. 7, 2013. As he was being retrieved from York, Silberstein said Rushdi told him, “Hamza is with God and that’s where I should be.”

Silberstein said Rushdi also told him at the Upper Darby Police Department that he “could only be judged by God” and that “we (police) would not be able to find the body.” The alleged confession at the prison took place the following day, said Silberstein.

The child’s mother, Zainab Gaal, also testified at the 2014 hearing that she was forced into an illegal marriage with Rushdi, who did not allow her to work, go to school or leave the house alone. She said Rushdi also made several threats against her child, including one conversation the day before Ali’s disappearance.

“He told me he wanted to take Hamza to my mother’s house in Maine,” she said. “If not, before he gets there, he’ll throw him out of the bridge. Five minutes later he said he could get away with murder.”

The child has never been found, but a pillowcase allegedly containing his DNA was located.

Nilon said he based on his decision on the findings of two psychiatrists, one of whom, Dr. Stephen Mechanick, testified at a hearing last month that he had diagnosed Rushdi with schizotypal personality disorder.

“His judgment about his ability to prevail, about the case, about what he would be presenting as a defense are so severely impaired that he lacks the sufficient capacity to stand trial,” Mechanik said during that hearing.

Mechanick’s conclusions differ from that of forensic psychologist Dr. Drew Atkins, who opined that Rushdi suffers from schizophrenia based on his delusional beliefs, his inability to care for himself and his inability to hold steady employment, according to testimony last month.

Mechanick said Rushdi’s inability to provide Malloy and Galloway with any meaningful assistance is not based on an intellectual disability or delusion, but rather from his belief structure.

“I think he has the capacity in the sense he has the intellectual capacity – he has the overall capacity – but his preoccupation with his spiritual beliefs is where he puts his time,” said Mechanick.

Rushdi has consistently spoken out of turn at many court hearings over the past three years about God, his inability to get an impartial trial and a belief that the devil is manipulating events against him.

Mechanick said Rushdi believes himself to be a spiritual being on the “highest end of a pyramid of spirituality” that is tied to the points on the Star of David and that the devil or an evil spirit used him as a “vessel” in Ali’s death.

In this sense, Mechanick said, Rushdi does not believe “the devil made him do it,” but rather that it was the devil and not Rushdi at all. Rushdi also believes that he would prevail at trial with God on his side, Mechanick said, but the devil would cause a conviction.

“The devil is attacking me like the devil attacked Job,” Rushdi interjected at one point during last month’s hearing. He also told Wills the basis of her case is deceit and that is how she would win.

I hadn't been in Lewiston for years and 2 years ago I was shocked as I drove through the city. Woman in full on Burkas and others in headscarfs and of course the disgusting unemployed men hanging out in their Tommy Hilfiger designer American clothes. I felt so badly for the woman. Schlepping along in the heat and humidity loaded down with groceries and kids. Gotta love that sharia law. Stupid religion. I have no use for religion. So much misery. Doctors from Norristown State Hospital testified at a Delaware County hearing late last month that the mental illness of 30-year-old Ummad Rushdi is not improving, making him unable to participate in a trial or accept a plea deal from prosecutors.

Rushdi was admitted to the hospital in 2018 after he was ruled incompetent for trial after five years in the county jail, and court-ordered medication hasn’t changed his condition, officials said. He has been charged with murder, kidnapping and abuse of a corpse since the 2013 disappearance of 7-month-old Hamza Ali.

Psychologist Jared Moore testified that Rushdi has paranormal and supernatural delusions and believes the “devil is trying to use the system to break him down.” Moore said it would be best for Rushdi to stay at the state hospital. Assistant District Attorney Stephanie Wills agreed and said that while the criminal case will remain active should his condition improve, the state hospital is the safest place for him to be.

Authorities said the child was kidnapped in August 2013 from the Upper Darby home of Rushdi‘s parents, and they allege he killed the boy and disposed of the body. The remains were never found despite a search of the borough and the rural York County area where the defendant shared a home with the boy’s mother and other relatives.

In 2014, a detective testified that while being advised of his rights, Rushdi blurted out that he was sorry for what he did, that he had shaken the crying baby, who stopped breathing, the Delaware County Daily Times reported. He said he tried to give the child CPR, then buried him in York County, the detective said. He refused to say where, saying he “could only be judged by God,” authorities said. Retired Upper Darby Police Superintendent Michael Chitwood said the effective conclusion of the case didn’t surprise him given the defendant’s mental health issues, but he expressed frustration over the child’s disappearance.
