The timeline seems to leave out the anal rape. When the hell was that supposed to have happened? Plus she had a STD too. This case is just so fucking sketchy no matter what the fuck really happened. Like the "cleaning up the crime scene" part. She was 10, not that big. Why the hell did anyone think it was necessary to cut her arms off and remove internal organs??????? That just seems like making a huge fucking mess out of things. I understand meth junkies are messed up in the head but seriously what the fuck?
 
Sounds like the “mysterious man” (if he exists) is part of a rival gang.
 
At this point, i wouldnt be surprised if EVERYBODY walks on this, or at least gets some very sweet plea deals/significantly lesser charges.

Shit now im confused again. I thought the mom, who was out buying drugs, was the one they were trying to plea down with the child abuse thing.

I thought this Jessica Kelley bitch was still thought to of been fully involved in the rape/murder/etc. the entire time?

Or are authorities desperate to find out who the male DNA found after 2 years belongs to and are just futilely trying to get to the bottom of that?

An emergency motion hearing is set for a suspect in the murder of 10-year-old Victoria Martens.

Jessica Kelley is expected to go before a judge Tuesday morning as a part of a motion for the court to reconsider her plea deal that would allow her to testify against the other defendants in the case including her cousin, Fabian Gonzales.

Earlier this month, District Court Judge Charles Brown rejected the deal saying prosecutors didn't effectively make their case after asking Kelley about the night of the murder.

According to Kelley, she let an unknown man inside the apartment who was looking for her cousin Fabian Gonzales. She says that man then killed Victoria as gang retaliation against Gonzales.

Judge Brown said that wasn't enough for the charge of child abuse resulting in death because Kelley did not know what was going to happen.


"There's no indication she knew or should have known the person intended to commit intentional murder," said Judge Brown.


The District Attorney's Office says Kelley's admission of guilt should be enough and that without the plea agreement their ability to prosecute Gonzales is limited.


His trial is set to begin in October. Kelley's trial is slated for January.

if this time line is true, it seems the only person that was with Victoria when she died, and without an alibi, was Kelly. Kelly is saying that some mysterious gangster came in looking for Fabian and murdered (and raped?) Victoria... I assume the reason the State is buying this allegation by Kelly and not charging HER with the murder is because they have found DNA that says there was a male there? Still though, seems to me that Kelly is involved.

and yet, they are trying to reach a plea deal with Kelly to prosecute Fabian. But prosecute him for what? Sounds like his alibi is pretty solid. perhaps for tampering with the body? mutilation of the corpse?

He told Kelley that Gonzales f****d up and knew he had done so. He instructed Kelley that she and Gonzales needed to clean up “the mess” or she and her kids would be next.

· 8:48 p.m. Gonzales and Martens returned to the apartment. They both appeared high, paranoid and “tweaked out” when they returned. They were sitting in Michelle’s car in the parking lot, singing to loud music.

· During this time Kelley carried Victoria’s lifeless body down the steps outside the apartment. Victoria was wrapped in a blanket.

· Kelley returned upstairs with Victoria’s body. Gonzales and Michelle followed a short time later.

· Kelley and Gonzales had a private conversation where Kelley told Gonzales that Victoria was dead. They decided to conceal the homicide, clean up the crime scene and bury Victoria’s body.

Something I'm failing to understand here is they seem to be saying Gonzales couldn't have killed her because he didn't rape her??? I mean someone was raping her, not one of these 3. I just find it way too convenient that this mystery guy just happened to show up and murder the girl during a way too convenient time when 2 of the 3 arrested were not there.

On a side note, I am not forensic expert but for how long would the evidence of the rape in the autopsy report remain? Meaning was she raped around the time of death or could it have been from hours or days before?

Gonzales was with Michele. Kelly was the one who was at home with Victoria. I think Kelly is a junkie and a whore ... boys love junkies and whores ... its true ... they'd put money into her account for canteen, hook up when she got out. I think one of her tricks did it ... that semen came from someone that she knew. I just don't understand why she isn't giving him up ...unless she is scared of more charges. I don't think she is worried about her kids ... and I don't think Fabian "FUCKED UP, and the gangsters were after him or he would have really gotten it in jail and more ... Fabian has never said I fucked over so and so ... this is retaliation ... and I think if it was true he would say so ... but all he has said was I never raped Victoria the night she was murdered ... I had sex with her mother, and we woke up to Jessica hitting and kicking us and screaming about GOD. I do not know who called the police but I recall that when they arrived she (Michelle) was outside the apartment, and told the police that Her daughter was in there, seeming to believe that she thought Victoria was alive and in danger, Which makes sense if you think your daughter is sleeping and someone like Kelly just beat you awake and you left your apartment.

I think prosecutors should go hard with the Death Penalty, and only take it off the table if she gives up the identity of the guy who left his semen all over Victoria's body.

I hope LE finds that asshole though ... I wonder who is putting money in her account now ... I would bet my dog its someone she's got something on and that the moment they miss a week she tells.

I don’t believe that theory either. It’s a strange retaliation. A big crime to commit in retaliation, plus you need someone ok with child killing, and it wasn’t even his child but a new gfs?
I think it’s more likely that Kelley had people over and one of them abused Victoria and strangled her when she made noise or threatened to tell. Kelley isn’t saying who because she probably doesn’t know. Too wasted.
 
I think all three sold her to someone for drugs who ended up killing her just like what happened to Shaniya. It is probably someone that Kelly knew and she convinced the other two junkies to go along with it.

Victoria's autopsy showed she had an STD and Kelly did state that she would offer Victoria to men she met on "Fishes in the Sea". Kelly may have not murdered her daughter, but I believe there is evidence she allowed her daughter to be raped, repeatedly.

You are correct and I should have posted that link with an "*". Other than the update that there is still a judge willing to hear a plea agreement the whole rest of the article is a mess. Very poor journalism that brings up a lot of things that have since been disproven and/or updated.

Prosecutors dropped three charges against Jessica Kelley, the main suspect in the death of 10-year-old Victoria Martens.

All three dropped charges are related to the rape of Victoria.
“After detailed forensic analysis by expert pathologists there is not sufficient evidence to connect Jessica Kelley to the charge of criminal sexual penetration. Kelley remains charged with murder and child abuse resulting in death,” said Michael Patrick, spokesperson for the district attorney’s office.

I read the report (REALLY wish I hadn't) but unless she tripped and fell on a dick I don't see how they can say those injury's weren't caused by a sexual assault.
 
In a nearly empty courtroom Monday – watched only by the media, a couple of investigators and Victoria’s crying grandparents – 34-year-old Kelley pleaded no contest to child abuse recklessly caused resulting in death, tampering with evidence and aggravated assault.

The plea was accepted by Judge Charles Brown.

She faces a total of 50 years in prison. Since she has two prior felony convictions, she will be sentenced as a habitual offender, which adds 20 years in prison to the sentence.

But Kelley has the possibility of cutting her time in prison down to 20 years total with good behavior.

I hate that she wasn't convicted of murder. But at least this keeps her behind bars for a time. Not a long enough time, but we don't always get what we want.
