A big chunk of the lawsuit filed by the grandparents’ claims Albuquerque police dropped the ball when officers didn't investigate a tip that a man tried to kiss Victoria five months before her death.
In court documents recently filed by the city, it said two of Victoria’s own family members knew about that attempted kiss and did not contact law enforcement.
Instead, it was a nurse who did.
The APD maintains it didn’t investigate the tip because an attempted kiss isn't a crime.

One of the suspects in Victoria Martens’ murder got a significant sentence Thursday morning in a different case.
Jessica Kelley’s attorney argued she’s being treated unfairly.
A judge sentenced Kelley Thursday morning to seven years in prison for a 2015 drug dealing charge after she pleaded guilty. Judge Benjamin Chavez added four years to her sentence because of her criminal past.
The state also brought up Kelley’s felony convictions and the current murder charge against her.
Kelley is one of three people accused of raping and murdering Victoria Martens at a northwest Albuquerque apartment in August of 2016. She was arrested for the murder just days after getting out jail in another case.
“After getting out of custody on that case she was arrested for her involvement in the brutal murder of a 10-year-old girl. That case is still pending. She has not been convicted but it cannot be ignored when sentencing today,” said prosecutor Rachel Eagle.
Kelley’s attorney argued his client is being punished too severely because of the high profile murder case.
“This is piling on,” he said. “To be expected, there’s cameras in the courtroom, everybody knows about the other case and frankly it’s unfair.”
The judge sided with prosecutors Thursday morning and added time to Kelley’s sentence as a habitual offender. Her trial for the murder case is scheduled for next January.
Kelley will be tried after Fabian Gonzales and Victoria’s mother, Michelle Martens, who are also charged in the murder.
Kelley’s attorney was not pleased with that order, worrying prosecutors will be able to use facts against her that may come out in the first two trials.

Worrying about fucking "facts"? What kind of piece of shit attorney worries about a facts? Facts is crucial to justice. They only damn things attorneys need to worry about is that the rules are obeyed, a impartial jury is seated and that they possess the ability to try the case within the bounds of the law.
I have a family member who actually works at the detention center where these evil, fucking shit-stains are being held and if anything like that were to happen I expect prompt notification, if not, Santa will not be pleased.
I feel a little disappointed. Because I was also hoping one of these ass hole got shanked to death or beat beyond recognition.

These three fucks are pretty much placed in limited access areas of the detention center (or are confined to their own cell) and when they are moved out all prisoners and even staff, who are not detailed to guard them, must be cleared from the transit path and destination. The only incident, so far, was back in spring of last year when Fabian's quad was cleared so he could get out of his cell for a bit, but one of the other inmate's door suddenly opened and a dude rushed out and attacked Fabian. He wasn't hurt to bad, but it looks like that dude might have had help getting his door open as Fabian was walking by. Nothing has happened to the mother, Michelle, that I know of and that horrible slut, Jessica, is loathed by the staff (she's a bitchy, whinny cunt) and is relatively feared by the small number of women inmates that are around her.
