Suffolk County District Attorney Raymond A. Tierney today announced the indictment of three defendants stemming from the death of seven-year-old Jor’Dynn Duncan. Emily Kelly, 50, of Bayport, was indicted for Murder in the Second Degree and other related charges. Barbara Renner, 75, Kelly’s mother, was indicted for Manslaughter in the Second Degree and another related charge. Elyssa Seymore, 24, Kelly’s daughter, was indicted for Unlawful Imprisonment in the First Degree and other related charges.

“Today, my office is announcing the indictment against three co-defendants after a lengthy grand jury investigation into the alleged prolonged torture, abuse, and the brutal murder of a defenseless, innocent child who was placed in their care,” said District Attorney Tierney. “This was not an alleged single act of violence. It was months of alleged systematic cruelty and sadistic abuse, meticulously documented. The child was allegedly left to die while these defendants watched her deteriorate. No child should ever endure such horror, and we will seek justice for Jor’Dynn.”

According to the investigation, on December 29, 2025, at approximately 10:30 a.m., Kelly allegedly called 911 to report that the victim was in cardiac arrest. Paramedics found the child unconscious and transported her to NYU Langone Hospital-Suffolk, where she was pronounced dead.

An autopsy determined the victim died from a massive untreated infection, the source of which were sharp force injuries. In total, the Suffolk County Medical Examiner’s Office documented approximately 90 injuries on her body at the time of the victim’s death. The findings prompted an investigation by the Suffolk County Police Department’s Homicide Squad.

The investigation revealed that Kelly is the fiancé of Jor’Dynn’s father. In December 2024, Suffolk County Child Protective Services placed the victim with Kelly at Kelly’s request, and in April 2025, Kelly gained full custody and guardianship of the child. Investigators allegedly recovered extensive photographic and video evidence from Kelly’s cellphone and cloud-based accounts documenting the alleged prolonged abuse and torture of the victim, which included prolonged restraint, physical injuries, and lack of medical care for those injuries dating back to January 2025.

Following her death, it was discovered that Jor’Dynn missed approximately 40 days of school between January 2025 and June 2025. Kelly allegedly provided fabricated excuses involving different illnesses, deaths in the family, and a trip to Disneyworld – all of which were allegedly used to conceal the abuse.

The Incriminating Text Messages

Assistant District Attorney Dena Rizopoulos presented text messages recovered from the defendants' phones that exposed the calculation behind the abuse: []

• Coordinating Face vs. Body Strikes: In one exchange regarding a black eye, Kelly texted, "I think when I backhanded her yesterday, I might have did that to her eyes." Seymore replied, "You definitely did that to her eyes... Talking about allergies, LMAO," and later instructed her mother, "You’ve gotta hit her body if you go to hit her."
• Concealing Injuries with Makeup: Messages between Kelly and Seymore detailed plans to buy heavy cosmetic makeup specifically to cover up deep scars on the child's body.
• Tying the Child Up: In August 2025, texts explicitly suggested the 7-year-old was being held captive in a bathroom. Kelly asked Seymore to make the girl stand up, to which Seymore responded, "How? She's tied up."
• Witness Concerns: Seymore also sent texts expressing worry over the long-term mental health effects the abuse would have on her own infant son, who lived in the home and witnessed the violence

Additional Digital and Autopsy Evidence

• Smart Device Audio: Investigators recovered a recording from an Amazon Alexa smart speaker dated July 27, 2025, at 3:12 a.m. On it, Kelly is heard saying, "Alexa, turn on the bedroom light. Get the [expletive] over here you little piece of [expletive]."
• Bathtub Abuse: Cellular photos and videos showed that a majority of the physical torture occurred inside the home's bathtub.
• 90 Distinct Injuries: The medical examiner documented roughly 90 sharp-force injuries and stab wounds on Jor'Dynn's body. The definitive cause of death was a massive, untreated infection resulting from a torn colon caused by an assault with a sharp object.
• School Attendance Cover-Up: Jor'Dynn missed 40 days of elementary school between January and June 2025. Kelly routinely gave administrators fake excuses—including illnesses, family deaths, and a fictitious trip to Disney World—to keep the girl hidden.

Jor'Dynn Duncan’s father, Derrick Dixon, is currently incarcerated at Sing Sing Correctional Facility in Ossining, New York. According to state prison records, he was sent to prison following a 2024 conviction for attempted burglary. [1]

Because the father was already imprisoned, Child Protective Services (CPS) placed 7-year-old Jor'Dynn into the temporary care of his fiancée, Emily Kelly, in December 2024. Kelly subsequently requested and was granted full legal custody and guardianship of the child in April 2025. [1, 2]
