"Yesterday, Timothy Brooks entered pleas of guilty to 2nd Degree Murder and Aggravated Child Abuse. He received a sentence of 40 years to serve in the penitentiary. While 40 years isn't enough for the death of 35 month old Daviion Tripp, it is a reasonable outcome based on all of the circumstances surrounding this case. Columbia Police Detective Doug Faulkner conducted a thorough investigation which resulted in this plea agreement.

A babysitter charged with a Columbia 2-year-old’s murder says he’s not guilty.
Timothy Brooks Jr. spoke to News 2 from jail on Friday, one day after he was arrested in Rutherford County for Daviion Tripp’s murder.
When asked if he was guilty of what he has been charged with, Brooks replied, “No, sir. I love kids and all that stuff.”
Brooks, in a soft-spoken voice, told News 2 he cared for the toddler a lot.
“I did. really, really did,” he said.
Brooks maintains that he did not hurt Daviion and that he took care of him on Monday.
“We played and everything and, guess maybe got a little too rough with him. But played with him,” he said.
Gary Powell is a family friend. He said he was there when Brooks brought Daviion home.
“He literally said, ‘Hey, this little guy’s going to be knocked out for a while.’ He took the little baby to eat some breakfast, and then went to the park, so he said, he will probably be asleep for a while,” Powell told News 2.
When asked if it looked like Daviion had been beaten or hurt, Powell said, “No, when he first brought him in he laid him on the couch and he was facing toward the wall.”
Investigators though said the little boy died of severe injuries that would have been noticeable.
Brooks told News 2 he doesn’t know how the toddler got the injuries.
Brooks admitted he and the 2-year-old were rough-housing earlier in the day.
A lot of questions on how Daviion died still remain unclear. Investigators are still looking into the relationship between Brooks and the child.
“It really hurts,” Brooks said, adding, his apologies to the family, “I’m sorry, man.”
He is charged with aggravated child abuse, murder and driving on a revoked license.
