The contract Fedex driver has admitted killing her.
 
Prosecutors charged the FedEx driver, arrested earlier this month and accused of killing a 7-year-old girl, with the alleged sexual assault of a minor, jail records in Texas revealed.

Tanner Lynn Horner, 31, had been booked into custody and charged with alleged capital murder and aggravated kidnapping, but Wise County jail records now show he's also facing three counts of sexual assault on a child.

The new charges appear to challenge Horner's alleged explanation to investigators for his killing of Athena Strand.

Horner had told investigators the little girl was not seriously injured when he accidentally backed his truck into her, according to an arrest warrant affidavit.

The suspect told investigators that he “panicked” and feared “she was going to tell her father about being hit by the FedEx truck the Defendant was operating,” leading him to strangle her, the affidavit said.

WISE COUNTY, Texas - The man accused of killing Athena Strand is now facing three counts of sexual assault of a child in unrelated cases out of Tarrant County.

Tanner Horner, who was already facing charges of capital murder and aggravated kidnapping in Strand's death, had the additional charges filed Wednesday, but court records show the incidents are from 2013.

No further details have been released about what led to these charges being filed against Horner.

That's excellent news. The girl he raped 9 years ago has been trying to get justice all this time, but she wasn't believed. Now they are finally doing something about it. Better late than never, I guess, but if they'd acted when he raped the first girl, he'd be in prison and Athena would still be alive.

The three molestation charges are not related to last month’s horrific killing of Athena, Wise County Sheriff Lane Akin told WCMessenger.com.

A Wise County grand jury indicted Tanner Horner, 31, Thursday on two charges of aggravated kidnapping and capital murder of a person under 10, NBC5 reported.

Horner could face the death penalty if convicted on the capital murder charge. Police have requested that prosecutors pursue the death penalty.
Athena’s mother, Maitlyn Gandy, thanked the grand jury and called Horner’s indictment “the beginning of a long road through the justice system.”

The mom is in favor of the death penalty in Horner’s case, she previously told WFAA.

“I support the death penalty,” Gandy says. “Every breath he takes is one my daughter doesn’t.”
 
WISE COUNTY, Texas - Maitlyn Gandy, the mother of Athena Strand, has filed a wrongful death lawsuit after her 7-year-old daughter was allegedly killed by a delivery driver who was delivering a Christmas present.

The lawsuit names the accused killer, Tanner Horner, as well as FedEx and Big Topspin, the contracting company that hired Horner.

The lawsuit, filed in Wise County Court on Friday, is a part of a lawsuit previously filed by Strand's father, Jacob Strand in December.

The lawsuit says FedEx and Big Topspin were negligent in their hiring of Horner, failing to properly investigate his criminal history, mental history and prior employment among other things.

"It is about implementing better hiring, training, and supervising practices to prevent vicious killers from arriving at our doorsteps bearing an insignia that has been cultivated to instill trust. It is about preventing billion-dollar organizations from insulating themselves from liability by using fly-by-night contractors instead of acknowledging the responsibility they bear when we trust them to come onto our property, to our doorsteps, and even inside our homes," the lawsuit reads.

The lawsuit also points to several other instances of violence committed by FedEx drivers across the country.

"FedEx has a problem – a big one," said Benson Varghese, Strand's lawyer, in a statement. ""There is a pattern that can no longer be ignored. The company has the resources to ensure its drivers and contractors are properly vetted, trained, and supervised. No parent should have to bury a child because of gross negligence. Tanner Horner should have never been given a FedEx uniform or a delivery van."

The suit also accused FedEx of negligently hiring Big Topspin, and claim the company failed to look into the contractor's hiring practices.

Gandy and Strand are seeking "fair and reasonable" compensation for mental anguish, loss of companionship and more.

In January, FedEx responded to the original lawsuit from Strand, denying liability.

In it, the company says Horner "was not acting as an agent of, nor was he in any course and scope of any employment of, FedEx Ground at the time of said criminal acts."

I definitely think he was acting as an agent of FedEx since he was delivering packages for FedEx. Doesn't matter if he was working thru another company, He still needed to be vetted by both companies, and it seems neither took responsibility. He was wearing a FedEx uniform, driving a FedEx van, what would a reasonable person think, I'd say, they'd think he was employed by FedEx.

I’m just astonished, too bad his charges for the SA on the 7 year old victim were so delayed, Once they are convicted they should have no remain in prison! can society take the real chance that he will re offend and hurt yet another child! ? This should be a death penalty case
 
A delivery driver has pleaded guilty in connection with the kidnapping and death of a 7-year-old child, according to KDFW.

KDFW reports Tanner Horner entered a plea before his trial began Tuesday. The punishment phase of the trial is now underway.
Arrest affidavits show Horner told investigators he killed Athena in December 2022 because he accidentally struck her with his delivery truck and was afraid she would tell someone.
