A man who allegedly violated terms of his parole in January has now been charged with the rape of a 7-year-old.

Probable cause documents state Joshua Oliver Perez left jail and entered a substance abuse program that he walked away from on Jan. 22. He was charged Thursday for first degree felony rape of a child after the girl woke her parents while crying at approximately 3 a.m. on Jan. 30. The girl allegedly told her parents that Perez touched her and had sex with her. They alerted police and reported what they believed was physical evidence of the assault to police.

The child was taken to a hospital where she told medical professionals that Perez "hurt" her and pointed to her genitals. Evidence was gathered in an examination but the results have not yet been returned.

Perez, arrested for a felony while on probation for a previous felony, is now held without bail "to protect the health and safety" of the victim and "the community at large." Perez was on probation for burglary, violation of a protective order related to domestic violence and giving false information to a police officer. He left the supervised substance abuse program the night before he was to check in with probation and parole.
