A Chocorua father is accused of assaulting his 2-year-old son earlier this month, leaving the boy with injuries so severe that he is now in a medically induced coma.

The details of the case revealed in court documents are so disturbing that they're difficult to stomach even for veteran investigators.

Detectives wrote that 23-year-old Ryan Upson took his son to a local emergency room, claiming the child was hurt after falling from a high chair.

But multiple injuries to the boy's head and chest did not add up for doctors, so they called the police.

While talking with officers, Upson changed his story and said he hit the boy once in the chest, causing him to fall and hit his head.

The boy was eventually flown to an out-of-state hospital, where he underwent neurosurgery and is recovering from several strokes related to his injuries. The child is also unable to move one side of his body.

According to court documents, Upson returned home to clean up blood and vomit that was left behind after his son was flown to the hospital.

Upson was arrested Wednesday and charged with first-degree assault and falsifying physical evidence.

News 9 learned that the Division for Children, Youth and Families received calls about the home prior to this investigation, most recently in October.

2 and 3 year olds are the best.y favorite age range. So adorable, needy yet independent.
 
I have a 2 year old and he's just freaking gorgeous. Love this age. No terrible twos for us. Everything is a huge exciting discovery for him.
My daughter was the best baby and an even better 2 year old. Once she turned 3 and then 4 its been one hell of a ride. So you better knock on some wood! Lol!
 
The age of the child is not the problem it is the piece of shit that is too stupid and unprepared to be parent.
 
According to the affidavit the child’s mother had abandoned him, and his paternal uncle and wife had custody of him in Maine from the time he was about 7 months old until August of this year, when DCYF allowed Upson to take custody of the child in New Hampshire.

During a Dec. 13 interview with state police, Upson provided the same account of being mad at his son for not eating and then forcefully pulling him out of the highchair, striking him and knocking him to the ground in the kitchen, causing the severe head injury, according to the affidavit.

The falsifying physical evidence complaint charges that after Upson took his son to the hospital, he returned home and cleaned the area where the boy struck his head with the purpose of impeding the police investigation.

The prosecutor in the case has filed notice that he intends to seek enhanced penalties against Upson, citing state law that allows for a sentence of 25 years to life if a jury finds that he purposely, knowingly or recklessly and with extreme indifference to the value of human life committed first-degree assault against a person under 13 years of age where the serious bodily injury has resulted in brain damage or physical disability to the child that is likely to be permanent.

Thanks court system for taking a child from a home that he was probably loved in and placed with a sperm that has essentially destroyed the boy's life.

If a guy looking like him walks into a hospital with a child that is injured in any way shape or form you know damn well it's child abuse!
 
Do any of these Children’s agencies actually have staff with Grey Matter or they just accept a Uni Degree as qualification.
 
The probable cause statement also contains an interview with Melissa Marshall who is the boy's great aunt on his mother's side. She explained that the boy's mother abandoned him. Marshall said she and her husband, Andrew, had temporary custody of the boy from when he was 7 months old until August of this year when the Division for Children, Youth and Families allowed Upson to have custody.
Marshall said she had seen bruises on the boy "on numerous occasions" but at first she thought they were just normal childhood injuries. She also recalled Upson telling her about a time that the boy fell down the stairs while in Upson's custody.

A Tamworth man who struck his toddler son causing a severe traumatic brain injury received the maximum sentence for first-degree assault and will spend the next 7½ to 15 years behind bars.

Ryan Upson, 24, plead guilty and accepted the terms of a naked plea without the protection of a fully negotiated sentence.
“It’s all but a miracle that the child didn’t die and that you aren’t facing an even more serious charge,” Judge Amy L. Ignatius told Upson. She credited the victim’s fighting spirit and excellent medical care with allowing him to survive.

Defense Attorney Wade Harwood had argued for a two- to four-year state prison sentence saying the incident occurred “in a split second that he will forever regret.” He urged the judge to weigh the actual conduct vs. the consequences, characterizing Upson’s actions as a “momentary loss of control.”

The defendant’s employer told the judge Upson has an incredible work ethic, is honest, punctual and reliable.

“He regrets what happened every day and that is punishment enough,” he said.


The boy suffered several strokes while hospitalized and remains at risk for seizures and Attention Deficit Hyperactivity Disorder, only time will tell what lasting effects may remain, County Attorney Briden told the court.

Prior to imposing the sentence, Judge Ignatius said she had read a two-page letter written by the victim’s caretakers Andrew and Melissa Marshal that detailed the boy’s current medical status, the progress that he has made since he was injured and his limitations. Briden said the couple did not wish to attend the sentencing hearing.

Upson received a two- to four-year suspended prison sentence on the falsifying charge for returning to the 196 Deer Hill Road home in the Chocorua section of Tamworth and cleaning up blood and vomit, with the purpose to impair the police investigation.
