HOMESTEAD, Fla. (AP) — Police in Florida say a woman gave birth to a premature baby and left her near a backyard shed covered by an empty plant bucket.

News outlets report 20-year-old Martha Godinez-Diaz was arrested Monday on felony child abuse and neglect charges. The baby survived.

An arrest affidavit says the child’s grandfather found the baby. Godinez-Diaz’s boyfriend told police she called him, complaining of stomach pains. When he and other relatives arrived home, she said she was fine. But they noticed a change in the size of her abdomen.

Miami-Dade Fire Rescue officials said the placenta was still attached to the baby.

Officials said the baby has a “genetic malformation of the brain.” She remains in the hospital.

Godinez-Diaz is being held without bond. An attorney isn’t listed on jail records.

The grandfather of a newborn girl who was allegedly left under a bucket by her mother outside her Homestead home was granted custody of the baby and her sister Wednesday.

Mother Martha Estella Godinez-Diaz, 20, was arrested Monday on charges including child abuse and child neglect after police say she gave birth to the premature baby while alone outside the home, then placed it under a potting plant bucket.

The girl’s father, Mynor Perez-Garcia, appeared in court Wednesday, where he declared before a judge that he’s certain he’s the father of the girl. The judge ultimately gave custody of the baby and the couple’s 5-year-old daughter to Perez-Garcia’s father, Rigoberto Perez.

“I’m going to be very happy with my granddaughters, I’m going to take care of them to avoid any problems,” Perez told reporters in Spanish after Wednesday’s hearing.

The judge also said Godinez-Diaz will not be allowed visitation with the baby, for now. Godinez-Diaz was ordered held on $100,000 bond and remained behind bars Wednesday on an immigration hold, records showed.

The baby was hospitalized and suffers from a “genetic malformation of the brain,” police said.

Martha Estella Godinez-Diaz, 20, was outside her residence alone when she gave birth on June 6, according to WTVJ-Ch. 6. The infant girl was between 31 and 33 weeks old, a police report said.

Suspicious, the boyfriend’s father, who lives with the couple, searched the backyard and found the infant with a potting plant bucket on top of her and noticed the baby’s feet moving, the man told WSVN-Ch. 7.

According to police, Godinez-Diaz recently moved to South Florida from Guatemala and she told investigators she has been having memory problems since April when she was in a car crash.
