A Huntsville man’s aggravated child abuse charge has been upgraded to murder after the infant died from its injuries, Huntsville Police officials say.

Huntsville Police officials say on June 8, officers responded to a local hospital following reports of an injured infant.

Medical staff told officers that the child had sustained injuries consistent with child abuse. Officials say that at the time of the report, the infant was in critical condition.
Following the investigation, it was determined that 24-year-old Victavious Tarez Dennis was alone with the infant in his home when the injuries occurred. At this time, the infant’s age is unknown.

Dennis was initially charged with Aggravated Child Abuse - Family, and was booked into the Madison County Jail.

Days later, the infant died, and Dennis’ charge was upgraded to murder.

An Alabama family mourning the death of a 4-month-old girl says she would still be alive if she hadn’t been in her father’s care.
Victavious Dennis, 24, is charged with the murder of his 4-month-old daughter, Kyla Jean. The baby was taken to the hospital in critical condition June 8 and died three days later. Medical staff said she had sustained injuries consistent with child abuse.
At a bond hearing, police said Dennis admitted at the hospital he was responsible for any injuries to Kyla but claimed it was an accident. He told investigators he was giving her a bath the night before and she slipped out of his hands. He said she hit her head on the toilet, bathtub and floor. :rolleyes:
Kyla’s family says the little girl would still be alive if she hadn’t been in Dennis’ care. Her mother, Madison Posey, was just two weeks away from regaining full custody, according to the baby’s great-aunt and great-uncle, Stephanie and Justin Griffin.

“She [Posey] never got to see her baby take another breath,” Stephanie Griffin said.
Posey tested positive for CBD when she gave birth to Kyla and her twin sister four months ago. She says her doctor recommended taking the CBD to gain weight during the pregnancy.:rolleyes:

Because of this, Dennis was given temporary full custody of the twins, and she wasn’t allowed to see them without him present.

“We would not be sitting here today and getting prepared to bury Kyla in the next few days had they not just given those children to him,” Stephanie Griffin said.
She says Posey went to visit her baby in the early morning of June 8 when she noticed something wasn’t right.


“Her arms were stiff, and they fell to the side. She said, ‘Call 911 right now. What have you done to my baby?’” Stephanie Griffin said. “He said, ‘Nothing. She’s fine.’”
The Griffins believe the ambulance took too long to make it to the hospital.

Once there, they learned baby Kyla had a brain bleed, broken ribs, a broken collarbone and liver failure. They say it was only at the hospital that Dennis said he accidentally dropped her the night before.

“He was hiding something,” Justin Griffin said.
The Griffins say both Kyla’s twin sister and older brother have had past injuries that were never explained. They always questioned those injuries and Dennis.

“I think he thought at this time this was going to slip by, too. ‘Oh, if I own up to it that I accidentally dropped her in the tub giving her her bath, that maybe it would slide by again,’” Stephanie Griffin said.
Following the incident, Kyla’s siblings were swept up into the foster care system. The Griffins blame the Alabama Department of Human Resources for initially putting the children in Dennis’ care and say they should be with family members right now. They add Posey has to go through another program to hopefully get a chance at full custody.
