A middle school teacher who allegedly tied up a 13-year-old girl before raping her at his Wisconsin home is headed for trial.
Peter Schmidt, 56, waived his right to a preliminary hearing on Tuesday in Wausau, where he was charged last month with first-degree sexual assault of a child younger than 16 with the use of force and related charges after the teen told police about the alleged 2016 assault, the Wausau Daily Herald reports.
Schmidt — who worked as a science teacher at D.C. Everest Middle School in Weston since 2002 prior to being place on leave after the allegations surfaced — began communicating with the 13-year-old girl on Whisper and Snapchat, according to a criminal complaint.
Schmidt identified himself to the girl as a 22-year-old man named “Kyle” and regularly discussed his desire to have sex with her before asking the girl for photos. In August 2016, the girl went to Schmidt’s home in Mosinee, which she felt compelled to do, she told police.
Once there, the girl told police Schmidt forcibly kissed her after giving her a tour of his home. He then forcibly tied the girl’s hands to bedposts before raping her, she told investigators.
Schmidt told the girl not to discuss what happened with anyone and continued contacting the girl on social media, prompting her to block him, according to the criminal complaint.
Schmidt, who has been licensed to teach in Wisconsin since 1985, has since been placed on leave and doesn’t have access to schools, the district’s superintendent told parents, adding that the student allegedly involved did not attend D.C. Everest Middle School. Messages seeking additional comment from district officials were not immediately returned Wednesday.
Schmidt has also been suspended “until further notice” from a nonprofit group that encourages youngsters to learn about democracy called Kids Voting Marathon County, according to the organization’s executive director.
A judge on Tuesday, meanwhile, ruled that he found probable cause in the case and ordered Schmidt be arraigned and stand trial. A date for Schmidt’s trial had not been set as of Tuesday, according to the Wausau Daily Herald.
Schmidt, who is also facing possession of marijuana and drug paraphernalia charges after police said they found nearly 45 grams of pot in his home, is scheduled to be arraigned on Sept. 11. He has yet to enter a plea on the charges, WSAU reports.
The allegations are the latest legal issue for Schmidt, who has barred by a judge from contacting the victim or any other juveniles. He was convicted of disorderly conduct in 2016 and was also convicted of second-offense drunken driving in 2013, according to the Wausau Daily Herald.
