A mother accused of remaining silent after her 2-month-old was suffocated by his father has asked that statements that she watched as he taped a sock in the child’s mouth not be admissible in court because police allegedly did not inform her of her rights, according to court records.
Ramos-Melendez “was asked if she would come with the police to give a statement,” prosecutor Bob Sombathy wrote. Ramos-Melendez “said she was expecting the police to come talk with her because she learned from social media that her ex-boyfriend confessed to killing their baby.”
Ramos-Melendez only considered herself a witness at the beginning of the interview, officials wrote. It wasn’t until Ramos-Melendez told officers her ex “did it in front of me” that the nature of interview changed and she became a suspect. At that point, she was read her rights and agreed to proceed, prosecutors wrote.
After that, Ramos-Melendez allegedly admitted to seeing the baby “weak and violet” but doing nothing. She also bought supplies to dispose of Gediaelamir’s body and rode with Quinones-Rivera to where he threw the baby in a puddle, prosecutors wrote.
“She knew her boyfriend was jealous of the baby, and she knew he hated it when the baby cried,” Sombathy wrote. “She had witnessed her boyfriend use tape to tie up the baby’s arms and mouth four times prior to this murder. Despite this, she never told anyone or took any action to protect her baby from this man.”
Ramos-Melendez was taken into custody in February at her Bronx home after Quinones-Rivera walked into the Parker Police Department about a month earlier and confessed to the killing their infant son, Gediaelamir Rivera, in June 2015 inside a Parker motel. Quinones-Rivera also spoke about his role in the 2-month-old’s death in a January interview with The News Herald. He said he had smoked marijuana that night and was angry with Gediaelamir because he would not stop crying. Quinones-Rivera said he stuffed a sock in the child’s mouth and then wrapped tape around his head to secure the sock before falling asleep.

Gene Anthony Quinones-Rivera, 27, confessed to killing his own baby and burying the body learned his fate today.
"He was crying and I put in his mouth socks and then I wrap around with two blankets. And then I go to sleep. And when I wake up, he was (dead)," Gene Quinones-Rivera described.
Quinones-Rivera was emotional in court as Judge Michael Overstreet sentenced him to life in prison without the possibility for parole. Rivera will also be sent to a correctional facility in South Florida to be closer to his family.
Quinones-Rivera doesn't believe his child's mother did anything wrong.
"She don't do anything to kill the baby," cried Quinones-Rivera.
