A Kremmling man is being held on a $1 million bond amid accusations of him repeatedly raping a child, as well as allowing another man to do so in his presence.

Larry Darnell of and Eric Cordero were arrested after a year and a half investigation into the two men repeatedly sexually assaulting a child.

Darnell is being charged with five counts of sexual assault against a child while in a position of trust, three counts of sexual exploitation of a child as well as contributing to the delinquency of a minor and possession of material showing the sexual exploitation of a child.

Cordero was arrested on charges of sexual assault on an incapable victim, sexual assault on a victim under 15, sexual assault with the aid of a person or weapon, sexual assault on a child and sexual assault with a 10-year age difference, all single counts.

According to the arrest warrant, Darnell would frequently drug the child while assaulting the child and also for allowing Cordero to assault the child. He is also accused of making child pornography, including videos of the assaults.

The child positively identified both men.

According to the arrest warrant, Darnell frequently drugged the child with methamphetamine as he assaulted the child on multiple occasions over the course of at least two years.

Additionally, Darnell is accused of allowing Cordero to have sex with the child. Cordero allegedly admitted to investigators that he inappropriately touched and performed oral sex on the child.

The warrant further accuses Darnell of producing child pornography, including taking explicit photos of the child. The warrant says authorities have video evidence of the assaults.

The warrant details other allegations that Darnell drugged women with Seroquel, an antipsychotic medication used to treat schizophrenia and bipolar disorder, and fondled them after they had fallen asleep in front of the child.

A third man has been charged after authorities obtained evidence tying him to a series of alleged sexual assaults against a child.

Daniel A. Gutierrez, 25, was charged with two counts of sexual assault after the Grand County Sheriff’s Office received DNA results from the Colorado Bureau of Investigation tying him to a child rape case involving two other men.

According to the arrest affidavit for Gutierrez, Darnell allowed him to have sex with the child on at least one occasion. Darnell is also accused of allowing Cordero to have sex with the child. Cordero allegedly admitted to investigators that he inappropriately touched and performed oral sex on the child.

The affidavit says tests performed by the Colorado Bureau of Investigation strongly indicated the presence of Darnell’s and Gutierrez’s DNA. The child also identified Darnell, Gutierrez and Cordero as perpetrators, according to the affidavit.

Grand County District Court Judge Mary Hoak gave a man the harshest sentence possible under state law for what the judge called one of the worst cases the court has ever seen.

During a sentencing hearing for Larry Darnell, 52, who in May pleaded guilty to felony sexual assault on a child by a person in a position of trust as part of a pattern, Darnell’s attorney claimed his client had amnesia of his crimes.
“There is an issue with his cognition,” defense attorney Chad Oxman said as he tried to argue Darnell suffers from serious memory issues that need treatment. “Mr. Darnell wasn’t necessarily uncooperative because he really has memory issues.”

Darnell did not speak at the hearing.
In response, Chief Deputy District Attorney Kathryn Dowdell said she believes Darnell is a liar and called his claims of memory loss “offensive,“ as she pointed out that Darnell recorded multiple assaults of the child.

“I just simply don’t believe Mr. Darnell in his statements. I don’t believe, as Mr. Oxman called it, that he has amnesia of the crime,” Dowdell said. “This was not a one-time event. This was sustained abuse that happened over months and years. It was calculated abuse.”
Judge Hoak said Darnell’s memory loss was essentially irrelevant because of the video evidence and sentenced him to the harshest possible penalty for sex crimes in Colorado — an indeterminate life sentence.
Hoak added that it was rare to have explicit evidence proving what happened.

“This is one of worst sexual assault cases this court has seen,” Hoak said. “Mr. Darnell is welcome to deny remembering anything he’s done, but the bottom line here is that the court’s understanding is he videotaped his crime, or at least part of it.”
With an indeterminate sentence, the Colorado Sex Offender Management Board will be responsible for the exact length of Darnell’s incarceration, for which 16 years imprisonment will be the minimum, though the board can keep him imprisoned
