A 23-year-old man, Tamorian Moore, has been charged with murder for killing his neighbor, Leonard Foster, on his 81st birthday, the Austin Police Department (APD) said.

Police said on Saturday, Feb. 18, around 1:51 p.m., officers received a check welfare call in South Austin.

The caller stated they had been waiting to hear from Foster for several days. The caller reported going to Foster's apartment, where a door was open, and his car was gone.

The caller told police they saw Moore driving Foster's vehicle before carrying garbage bags from Foster's apartment. Officers arrived and detained Moore carrying the trash bags.

Officers then checked Foster's apartment, but Foster was not located.

Throughout the investigation, detectives gathered that Moore was Foster's neighbor. Foster's body was found in Moore's apartment. Foster was pronounced dead at 11:37 p.m. Dr. Escott, police said.
Upon questioning, Moore told police that he believed Foster was trying to seduce him and ‘Lucifer’ killed him. When asked how ‘Lucifer’ killed Foster, Moore claimed he didn't know because he blacked out, according to his arrest affidavit.

On Feb. 19, the Travis County Medical Examiner's Office performed Foster's autopsy. They determined Foster was killed by blunt force trauma. He also had cut marks on his body.
 
Leonard Foster, 81, was found dead in his apartment Saturday, and his family believes the suspect may have targeted him because he was gay. The Austin Police Department said it was still investigating his death but added it has “no indication that it was a bias-motivated crime at this time.”

On Feb. 18, Foster’s family called for a welfare check, and police ultimately found Foster’s body in his neighbor’s apartment. That neighbor, 23-year-old Tamorian Moore, was arrested and charged with murder.
According to an arrest affidavit, Moore said he “lived across from a pedophile” who had “been watching him since he moved in,” according to the affidavit. When police questioned him about this, Moore said he did not want to talk about him. KXAN searched both the national and state sex offender registries for Foster, but Foster was not listed. APD confirmed it had no information Foster had been “investigated for any sex-related offenses.”
Investigators said Foster died from blunt and sharp force trauma to the head. The affidavit also states police found Moore with a trash bag filled with paper towels and a pillow that looked like it was covered in blood.

“He did not deserve that. A wonderful, beautiful spirit,” said Foster’s niece Debra Adams. “He was so very loved. That’s why he was missed so soon.”
Foster’s family believes the attack may have been a hate crime.

“We would like to see the charges upgraded,” Adams said.

Foster’s relatives called cops on the 18th after finding the front door of his apartment unlocked, officers said. He was not there.

“The caller stated they had been waiting to hear from Leonard Foster for several days,” police wrote on Facebook.

Then, a caller told officers almost an hour later that Foster’s truck was back at his apartment complex, which is on Royal Crest Drive. But he wasn’t driving. Another man, later identified as Moore, was allegedly operating it.

Another caller said that Moore, wearing latex gloves, was putting black trash bags in the vehicle, according to police.

Cops said they arrived about two hours after the original call. They found Moore carrying a black trash bag over his shoulder. He allegedly ran when they spoke to him, and he even took off his pants to get away.

Cops detained him, they said, and discovered he had a handgun in his pants pocket. He also had a door key, they said.

Moore’s shoes had a strong odor of cleaning products and were drenched, officers said. Blood stained a pillow and paper towels in the trash bag he possessed, according to the affidavit. There were allegedly jugs of bleach in an apartment he had been leaving.
