A San Antonio mother and her boyfriend have been charged in the death of a five-year-old boy whose remains are believed to have been found at the bottom of a ravine in Colorado earlier this week, court records obtained by the KSAT 12 Defenders show.

Daniel Garcia, 26, and the boy’s mother, Nickolle Christina Aguilar, 25, both face a felony charge of injury to a child causing serious bodily injury-death.

Last week, San Antonio police received information from the FBI that a grandmother claimed her five-year-old grandson, Domenic Patrick Aguilar-Acevedo had died at a northeast San Antonio hotel around July 25, records show.

The woman, in an interview with FBI agents in Costa Rica, said that she tracked her daughter down in the Central American country and was informed by Aguilar that Domenic had suffered an “unexplainable death,” the warrant states.

Instead of reporting the boy’s death to authorities in San Antonio, Aguilar and Garcia drove to Colorado the next morning with the body and camped in a public camping area near the Rocky Mountain State Park, records show.

The couple then buried Domenic’s body in a remote location near the campsite and fled by car to Mexico and eventually on to Costa Rica.

Aguilar confirmed the details her mother provided to authorities in Costa Rica and said that she and Garcia did not seek medical help for her child after he had become ill, records show.

An SAPD detective was able to obtain surveillance video from the hotel that showed Garcia carrying what appeared to be a lifeless body out of the room and down a stairway, according to the warrant.

The SAPD detective traveled to Colorado on Wednesday, and after meeting up with the Aguilar and the grandmother, human remains were located during a search in Grand County, Colorado, near the town of Fraser, records show.

Results of an autopsy performed by the Larimer County Medical Examiner’s Office are pending, however, trauma was found on the remains and the body was in the same clothing Domenic was seen wearing in the hotel surveillance video, the warrant states.

During an interview with the SAPD detective on Thursday, Aguilar said she had witnessed the victim suffer “extensive physical abuse” by Garcia for several weeks.

She told the detective that on July 24, Garcia struck Domenic so hard that he bounced off of a wall and then landed on the floor.

Domenic at one point vomited a black and brown liquid substance after the physical abuse had started in San Antonio.

A source familiar with the investigation said Saturday that both Garcia and Aguilar were in custody in Florida.

She failed that baby... She let her boyfriend beat him and did nothing... But I will wait until more details come out to judge completely, because I don't know what kind of control he had over her or whether he threatened her as well. The fact she told her mother everything, is fully cooperating with police, and apparently led them to the body definitely says something about the situation. She's far from innocent, but culpability is on a spectrum.

As for "stepdad" I think he needs to be hit with a battering ram until he starts vomiting black and brown substances.
 
Nickolle Aguilar allegedly told investigators she witnessed Garcia hurting Aguilar-Acevedo he died, but she did not step in because “she was too eager to be in a relationship.” She allegedly also said they did not report the child’s death after she and Garcia discussed losing custody of their other kids.

In this version of events, the couple brought the boy’s body to Colorado, camped in a remote area and buried him. They allegedly drove down to Costa Rica. The truth emerged when Aguilar’s mother asked asked about the child, authorities said. Aguilar allegedly revealed what happened. Her mother called officials in San Antonio, authorities said.

Investigators went to the campsite on Aug. 25 and discovered Aguilar-Acevedo’s body in a ravine, according to this version of events. The remains were exposed to elements and animals for almost a month, authorities said.

Aguilar and her mother allegedly also went to the campsite to “do the right thing,” so that the child could get an appropriate burial.

Both defendants reportedly face charges of child abuse resulting in death.

Domenic’s mother, Nickolle Aguilar, who is also charged in the case, took the witness stand and testified against Garcia -- her ex-boyfriend -- as a part of a plea deal.
Aguilar testified how the two met in the fall of 2020 and eventually introduced their children to each other.

She said that Garcia was in a custody dispute with the mother of his children who lived in San Antonio so they decided to move to the Alamo City.
When they arrived in San Antonio in early July, they stayed at several hotels. Aguilar testified that Garcia told her that she didn’t discipline her son enough.
She said as they got to San Antonio the abuse was more frequent.

Aguilar said Garcia would hold Domenic down on the bed with one hand and hit him with the other hand.
“(Garcia would) make him take really cold showers, spank him and punch him in the butt,” Aguilar testified. “With close fists.” When the prosecutor asked Aguilar how many times Garcia hit the boy, she replied, “I don’t know a specific number.”

Aguilar testified that Garcia would punish Domenic because the boy wouldn’t provide him an answer right away, wouldn’t keep quiet, didn’t eat his food fast enough and one time had a bathroom accident.
On July 24, 2021, surveillance footage from a hotel showed Garcia and Aguilar walking down a stairwell with their four young children. In the video, Domenic is the only one wearing a hoodie, pajamas and a mask over his face. The boy is seen walking slowly down the stairs when Garcia tugs at him.
Several minutes later, Garcia is seen running back up the stairs with Domenic slumped over in his arms. Aguilar said that Domenic had started throwing up and Garcia took him back up to the room.

Minutes later, Aguilar goes back to the room herself.

“I walked into the bathroom, Domenic was laying in the bath tub unconscious,” she said.
Hours go by into the next day, and a little over 12 hours later, the video shows the couple leaving the hotel with Garcia carrying Domenic.
Aguilar said they never called 911 to seek help for Domenic and instead decided to flee to Colorado to bury her son’s body. She said it was her idea to go to Colorado because she had promised to take her kids there to see the snow.

“I wanted to leave him somewhere beautiful, and it was beautiful there,” she testified.
In opening statements, the defense shifted all the blame of Domenic’s death on Aguilar. They listed a timeline of investigations opened against her by Florida Child and Family services about the alleged lack of care she provided to her children.

They also mentioned text messages between Aguilar and Garcia in August 2021 after Domenic’s death of her saying how much she loved him.

One text allegedly said she failed her children and blames herself and not Garcia.

An unpopular opinion but I would be happy if she got a far longer sentence then the actual baby killer.

She sacrificed her child for a dick and thinks placing him somewhere beautiful makes up for what she did.

These stupid women need to stop being coddled and held accountable for their shitty choices.

She could have dropped him off at a social services agency if this man was more important - which he obviously was.

She wanted to be in a relationship with that, the first violent act against the son should have convinced her that he was not a real man! And to take her children and leave him! Yes, she should have more of the blame, she brought a violent person to her children and let him stay and kill her son!

Testimony from the mother established that the defendant, Daniel Garcia, would strike victim over issues like not answering questions fast enough or not eating fast enough.
“[Domenic] wouldn’t answer right away, wouldn’t keep quiet, not eat his food fast enough … one time he pooped himself,” the mother, Nickolle Cristina Aguilar, testified last week.

That pattern of abuse ended tragically in July 2021, when Garcia threw Domenic into a wall, fatally injuring the child. Dominic began vomiting what investigators described as a dark substance before he died a few hours later.
Garcia was on trial for injury to a child resulting in death, aggravated assault with a deadly weapon resulting in serious bodily injury, and altering, destroying, or concealing a human corpse.

Nickolle Aguilar earlier this month pleaded guilty to one count of injury to a child causing serious bodily injury by omission and was subsequently sentenced to a maximum of 15 years in a state correctional facility. She was required to testify against Garcia as part of her plea agreement,

A mother charged in the death of her 5-year-old son had her plea withdrawn and sentencing halted because of her status as a U.S. resident.

Nickolle Aguilar, who was scheduled to be sentenced on Friday, is a U.S. resident though she claimed to be a citizen during her plea hearing and Pre-Sentence Investigation interview, Judge Velia J. Meza revealed on Friday.

“When I asked you if you were a citizen at the time of the plea, your answer was ‘yes,’” Meza said Friday.

At trial, Aguilar said she did not have a U.S. passport so she smuggled herself from Nicaragua to Costa Rica, Meza said.

Meza said she read letters from Aguilar’s family that stated she was born in Costa Rica and moved to the U.S. as a child.

The plea was withdrawn and will be reworked with an immigration attorney present.
 
Just baffles me that after he Kills her son she claims she wants to be in a relationship with him?? She witnessed him be totally unreasonable about her son’s behavior! You don’t make eating a meal a race! She saw he was far less than a real man, and yet she wanted that!? How desperate was she? Mr Garcia is all cleaned up, haircut, shave right in time for him to meet his new prison mates! I hope it’s truly miserable for him and he’s turned inside out every day!
 
A woman was sentenced to 15 years behind bars on Tuesday for the death of her 5-year-old son.

The Bexar County Criminal District Attorney's Office said 27-year-old Nickolle Aguilar pleaded guilty to charges of injury to a child with serious bodily injury by omission in the death of her son, Domenic Aguilar-Acevedo, in 2021.
Aguilar was offered a 15-year plea bargain in exchange for her testimony in the trial against her co-defendant and ex-boyfriend, 29-year-old Daniel Garcia, who was found guilty of a similar charge.

Garcia, Aguilar and her son were at an extended-stay at a San Antonio hotel in July of 2021. Garcia, who had been abusing the child over a period of time, struck Domenic with significant force, leading to his death.

Surveillance video captured Garcia and Aguilar carrying the child’s body out of the hotel room. Investigators said the couple then traveled to Colorado where they disposed of Domenic's body, eventually fleeing the country.

The district attorney’s office said Aguilar failed not only to intervene in the physical abuse but also, later, to seek adequate medical care for her child.
Garcia is set to be sentenced later this month.

During the hearing, prosecutors played a video of Domenic saying “I love you so much, mommy, I love you so much, mommy.”
As the video played, Domenic’s father let out a scream and reportedly threw a water bottle. He got up and walked toward the defendant, video from local ABC affiliate KSAT showed.

“I should kill your f—— a– right here!” Engwiller yelled as a slew of deputies surrounded him and escorted him out of the courtroom.

In the end, 226th District Court Judge Velia J. Meza sentenced Garcia to life in prison for Domenic’s brutal death, the Bexar County District Attorney’s Office said. A jury in May convicted Garcia, 29, on charges of injury to a child with serious bodily harm.

I would be more angry and wantto hurt the mom if I was the bio-dad after seeing the video of the boy saying I love you mommy and she allowed my child to be abused, killed and thrown away by a random dick.

I thought the same thing too. I would of been charging after mom first and foremost after seeing that video but I guess since it was his trial POS mom was not there. I think that these bio units who allow their children to be abused are just as bad if not worse than the person who made the final blow because they do nothing to stop it. They are complacent in the abuse, that parent has the power to stop the abuse, to protect their child as they should but instead they don't-they CHOOSE to ALLOW horrible things to happen to their babies, their punishment should be the same if not worse than the offenders. When your a parent it's your job to protect and care for your kids, not to throw them into the lions den so that you can not be alone and keep a steady piece of ass

I would like to know bio-dad's backstory.

If mom was so desperate to be in a relationship why did she not ask the father to take the child/ren.

The answer is either two things - did not want to lose child support/welfare benefits or she just hated the father and did not want the children to be safe with him.

Just like we need to hold parents who say they forgot the baby in the car accountable - we need to do the same for parents who fail to protect their children from their abusive partners.

Aguilar (the mom) is not going to do 15 years and will be paroled still able to reproduce children which is pretty scary.
