Officers responded to Chatham Gardens on Kelly Street shortly before noon Tuesday for a report of a child not breathing. Firefighters were attempting lifesaving measures and rushing 13-month-old Dianelis Brito into an ambulance when officers arrived. She was pronounced dead at Rochester General Hospital.
The ensuing investigation determined the girl had ingested a mixture of cocaine and fentanyl that caused her death.
Her father, Dillon Brito, 31, is charged with manslaughter and tampering with physical evidence. Police said he failed to keep the drugs away from his daughter and later attempted to hide evidence of the drugs.
Brito was taken into custody the day his daughter died on several outstanding warrants in Genesee County. After being released, Rochester police arrested him on the charges for his daughter's death.
Brito’s arraignment was held in Rochester City Court Saturday morning. He will remain in custody with no bail, due to him having more than two past felony charges, according to Judge Dixon.
During his arraignment, prosecutors said he is a four-time felon. Those convictions include drug possession and robbery in Genesee County.
