Two parents are in custody, charged with homicide, after investigators said their child died from a drug overdose.

The Shiawassee County Sheriff’s Office said David Bannister and Jennifer Kincaid were arrested following the death of their one-year-old.

Deputies responded to the home in Shiawassee Township in February when the child was found unresponsive. Investigators said the infant died from an acute fentanyl overdose. Narcotics and firearms were recovered from the home.

A Shiawassee County jury convicted the mother of a 1-year-old baby boy of manslaughter for his death attributed to a fentanyl overdose.

On Friday, the jury found 41-year-old Jennifer Kincaid guilty of manslaughter and possession of methamphetamine for the February 2022 death of 1-year-old twin David. She was acquitted of another drug possession charge.
David Bannister pleaded guilty in March to manslaughter and felony firearms for the child's death.
 
A Shiawassee County woman will spend at least 10 years in prison for the overdose death of her infant son in February 2022.
Shiawassee County Circuit Court Judge Matthew Stewart sentenced 41-year-old Jennifer Kincaid to more than 10 years to a possible 30 years for contributing to the deadly overdose of her 1-year-old son.
Kincaid offered no additional comments at sentencing, as tears streamed down her face.

"Your honor, respectfully I have nothing to say," said Kincaid. "I feel like I said what I needed to say at trial."

Judge Stewart said he focused the sentence on punishment, after years of this case.
"By placing your child in the position that would likely lead to his death and his death was in fact a result of your utter thoughtlessness and carelessness, this court's sentence will focus primarily on the protection of society and punishment," said the judge.
The 1-year-old twin sister of the victim was placed in foster care after the boy's death.
 
Ohh my gosh are they beautiful little babies!!! Poor baby losing their other half. I always have wondered if twins feel the loss of their twin differently than people who lost their sibling.if it’s a different feeling of loss and grief because they are twins.
 
David Bannister was sentenced to between 200 and 600 months in prison for the death of his 1-year-old son.
"I hope Mr. Bannister that you spend the rest of your life trying to reconcile those facts, because Mr. Koerner is right. You are the only one who knows what happened," said Judge Matthew Stewart as he was handing down the sentence.
He was convicted in February 2023 for delivering narcotics. But even in court today, Bannister was adamant the drugs were not his.

"I did not bring drugs into the home and I did not use drugs in the home," said Bannister. "Everything else that he said was true, and I can't bring back my son."
Bannister showed remorse in court and admitted that it was a case of "gross negligence"

But Judge Stewart struggled to reconcile Bannister's statements with the facts of the case.

"You want to tell me that you didn't have any drugs in the house when you had no idea how they got to them when you were dealing the drugs just before and just after he died," he said.
The twin sister of the victim was placed into foster care after the boy's death.
 
The best thing about this is that when she leaves prison her reproductive system will have closed up shop! If she wants to take drugs at least her child won’t suffer
