Damian Nesselrodt was recently charged with the murder of an infant after an incident when authorities found a baby with bruises on its torso in 2023.
The Augusta County Sheriff’s Office responded to a call about a baby not responding on April 8, 2023. There, authorities found an infant with bruises on its torso in the care of Nesselrodt. After 17 months of investigations, a grand jury indicted Nesselrodt for the murder.

According to court documents, Nesselrodt told investigators he had laid the baby down on a bobby pillow, scrolled on Facebook for several minutes and got up to use the restroom. Once he left the restroom, he found the baby unresponsive. Nesselrodt was the only caretaker in the home at the time.
After an autopsy was conducted on the child, the baby’s death was ruled as a homicide and the cause of death was blunt force trauma to the torso.

Nesselrodt is currently imprisoned for other charges at Wallens Ridge State Prison in Big Stone Gap, Virginia. He has no court date set up for this incident yet.

  • Conviction of second-degree murder

  • He will serve a mandatory 5-year probation period after his prison sentence is served
  • He is ordered not to contact any of the victim’s family
  • He is ordered not to have any unsupervised contact with a minor
