Police have made an arrest in the death of a three-year-old, whose remains were found in a garbage bag.

Early this morning, Oscoda Township police were dispatched to investigate a report of a human foot seen protruding from the bag outside a home on Cedar Lake Road.

Officers confirmed the report, determining the death was the result of foul play.

They identified the victim as a resident of the home. Police say the person they arrested stays at the home frequently.

Officials said that Iosco County Prosecuting Attorney James A. Bacarella has charged Justine Marie Johnson of Oscoda with one count of Felony Murder and one count of First Degree Child Abuse.

Both charges carries a term of life in prison without parole.

Officers from The Oscoda Township Police Department were sent to a home in Oscoda Township regarding a child’s foot being seen in a trash bag inside the residence. During the the investigation, the body of a three-year-old child was found in a trash bag inside Johnson’s home.

The child was said to be deceased and had suffered multiple stab wounds to her torso. The investigation resulted in a warrant for the arrest of Justine Marie Johnson, on Sept. 17.

The warrant charges Johnson with one count of Felony Murder.

Officials said that Ms. Johnson plead not guilty to both charges and is being held without bond.

Was reading several FB stories. Grandma (Justin’s mom) was commenting. Apparently, grandma and great grandma (Justin’s grandma) were the primary caregivers of the baby (Sutton). Mom (Justine) was on heroin and other drugs. She’d drop by the house to shower, sleep eat, hang out etc.. before hitting the streets again. I guess during one of the crash sessions is when the killing happened. The grandmas are kind of in denial saying “oh it wasn’t Justine” , and they’re still looking for the “real killer”. As a kind of funny aside, some neighbors comments that after killing Sutton, Justine stole their car. Not “funny” but definitely crack head behavior.

A Michigan mom showed little emotion in a court appearance Tuesday on felony murder charges after she allegedly stabbed her 3-year-old daughter to death and stuffed her into a garbage bag.

Justine Johnson, 22, was arraigned on one count each of felony murder and first-degree child abuse. She pleaded not guilty to both charges and is scheduled for a Sept. 28 probable cause conference.
Sutton Moser was found around 4 a.m. Friday by her uncle, WJRT-TV reported, a day after Johnson told him to mind his own business when he asked where her child was. Hours after finding Sutton’s body, police came upon Johnson walking along railroad tracks, refusing to talk about her child’s death.

Johnson was ordered held without bond after Iosco County Prosecuting Attorney James Bacarella told the court that she was a danger to the community and to herself, and Judge Christopher Martin concurred, due to the serious nature of the crime.

“This was a very violent and brutal murder,” Bacarella said, according to the Oscoda Press. “We have genuine concerns for the public’s safety, and there is also the fact that Ms. Johnson has engaged in self harm since the crime.”

Johnson’s mother and Sutton’s grandmother, Alisa Johnson, said she could not believe her daughter would have harmed the tot and thinks she is innocent.

“Justine loved Sutton with all her heart,” Alisa Johnson told WNEM-TV. “She’d never let anybody hurt that baby. She would always be there for her, she never did anything to hurt her.”
 
When police responded to a little girl’s body having been found in a trash bag in northern Michigan, they went looking for the child’s mother, 22-year-old Justine M. Johnson. Eventually finding Johnson walking along some rural railroad tracks, they broke the news to her that her child had been killed.

In response, the mother seemed to have no reaction, appearing unmoved by the news. Within a few days, Johnson would be charged with murder, accused of repeatedly stabbing her 3-year-old child to death.
The two-page document to support a warrant states that about 3:50 a.m. on Friday, Sept. 17, two Oscoda Township police officers responded to a residence after a 23-year-old brother of Johnson’s called 911 to report having found a human foot jutting out of black garbage bag. On inspecting the bag, the officers found the body of Sutton M. Mosser.

Sutton’s body had been wrapped in bedding, and the trash bag had itself been placed in a blue plastic tote, the document states. Sutton’s body was clothed only in a pink and white disposable diaper.
Officers interviewed Johnson’s brother who called 911, as well as a 17-year-old brother. The younger brother said he awoke about 6 p.m. on Sept. 16, went to a bathroom, and found his sister using drugs, he said.

When the teen asked Johnson where Sutton was, she told him to “mind your (expletive) business,” the document states.
The brother took a shower and on exiting it, he noticed Johnson was no longer in the house, he told police.

The teen brother left the house to visit a girl, returning home to the Cedar Lake address about 10:30 p.m., he said. His sister was still not there, he said.

The older brother told police he arrived home about 3:30 a.m. on Sept. 17, finding only his younger brother there. The younger man told his older brother he had found a human foot sticking through a trash bag, prompting them to search the area for their sister.

The older brother “became extremely upset” and called 911, the document states.

Police found Johnson about 8:50 a.m., walking on the Lake State Railway tracks north of Vaughn Trail. They took her to headquarters and tried interviewing her.

A detective sergeant told Johnson her daughter had been found dead.
“Justine Johnson gave no reaction to the news of her daughter being deceased and appeared unemotional,” the document states. “The [detective sergeant] noted that Justine Johnson remained unemotional and calm and advised [him] that she did not wish to talk about the death of her daughter.”

The Michigan State Police Forensic Science Laboratory Technician Team processed the scene and noted Sutton had been stabbed multiple times. In the trash bag with Sutton were a sweatshirt and a pair of size 11 women’s pants, with a notable amount of blood on the latter.

During her interview with police, Johnson said she wore size 11 pants, the document states. Both of Johnson’s brothers identified the sweatshirt found with Sutton’s body as belonging to Johnson, adding she was wearing it on Sept. 16, the document states.
 
A northern Michigan mother accused of fatally stabbing her 3-year-old daughter and placing her body in a trash bag has been found mentally fit for trial.

Iosco County District Judge Christopher P. Martin on Jan. 11 ruled that 22-year-old Justine M. Johnson is psychologically competent to participate in future court proceedings, according to Iosco County Prosecutor James A. Bacarella. Martin based his ruling on reports from staff at the Center for Forensic Psychiatry in Ypsilanti.

Martin in late September had ordered Johnson to undergo an evaluation at the facility, as requested by defense attorney Nathan R. Tyler.

A 22-year-old mother who allegedly stabbed her own 3-year-old daughter to death and stashed the body in a trash bag told a Child Protective Services investigator that SpongeBob Squarepants ordered the murder.

That’s according to Ryan Eberline, the CPS investigator who interviewed Justine Johnson in jail after the latter had been arrested on charges of felony murder and first-degree child abuse. Eberline testified in court Friday for a preliminary examination of Johnson, who is accused of killing her daughter, Sutton Mosser, on Sept. 16—just two days after her third birthday.

The grisly killing came to light after Johnson’s 17-year-old brother found a bag at the back of the house the family shared and noticed the toddler’s foot sticking out of it.

According to Mlive.com, Eberline said in court Friday that drugs played a large role in Johnson’s psychotic break. The distraught mother, who reportedly cried throughout Friday’s court proceedings, told the investigator that she didn’t remember killing her own daughter.

“She told me that she didn’t remember the specifics of what happened at the time of what happened to Sutton, that she was experiencing hallucinations due to heroin withdrawal and not sleeping for approximately two weeks,” Eberline said.

Before the alleged murder, Johnson was at her mother’s apartment. As she walked home, she passed out in a graveyard, according to Eberline. When Johnson awoke and finally made it home, she thought the TV was talking to her and telling her to slay her daughter or die, the investigator said.

“She was getting hallucinations from the TV that had instructed her to take her daughter’s life or they would kill her. It was SpongeBob who was saying these things on the TV. If she didn’t do what she did to her daughter they would kill her. She said she was afraid for her life and she had lost her mind,” Eberline said.

She previously told her brother to mind his business when he asked where Sutton was. I guess she has had time to come up with the Sponge Bob defense.

There’s no hell in the afterlife that meets the intensity, physical pain and and suffering as detoxing from heroin .. do I excuse anything she did not one fucking iota .. she should be happy she was “insane” and doesn’t remember .. in my experience the further people descend into heroin addiction the blacker the soul and the more the propensity to enjoy and dish out cruelty to anything or anyone ..

Johnson told investigators she had hallucinated while watching SpongeBob on her TV and the animated character commanded her to kill her daughter or face death herself.

Johnson underwent mental competency testing and the court ruled she was fit to stand trial on the murder and child abuse charges. She then went through a second round of competency testing, but the result hasn't been announced.
Johnson faces a mandatory sentence of life in prison with no chance of parole when she appears in court for sentencing at a later date.

I’m sorry but how in the hell was that moron of a grandmother given guardianship of that child? Let’s the daughter come in and out shooting up and strung out on drugs. Nice role model for the brother also. And where was this worthless turd when all of this was going down? She should have been sentenced to a lobotomy if for nothing else but the stupid shit she said, “ Justine would have never hurt that baby, she love Sutton with all her heart…she would always be there for her”. I guess in between heroine binges is grams idea of always. That must have made for some quality mother daughter time. People in the midst of heroine withdrawal are usually delightful.
