A 35-year-old Minnesota woman has been charged with second-degree murder, with intent, in connection to the death of a boy she was planning to adopt, according to court documents.

A criminal complaint states that Kellie Jo Anderson arrived at Sanford Emergency Department in Fargo on April 23. With her was a child of an unidentified age who is described in the complaint as being "blue and lifeless with bruising to the face and head."

A doctor found the child had a body core temperature of 82 degrees when they arrived, along with and fixed, dilated pupils that don't normally occur until 10 minutes after death. The doctor also noted that to reach a body core temp of 82, the child had likely been dead for around 40 minutes.

Anderson told a detective that the boy woke up that morning with a 99.8-degree fever, so she kept him home from daycare. She said the child "self injures" himself and that he "threw himself several times from the bath to the toilet" that day, which is where she believed he injured his mouth.

Anderson, who is a nurse, according to the criminal complaint, also said she thought the boy had a seizure, prompting her to drive him to the emergency room. She placed the child in a car seat and said he was "babbling" with labored breathing during the drive.

A couple of blocks from the hospital, Anderson pulled over because the child stopped "babbling" and she could not find a pulse. She was about to begin CPR, she said, until she noticed a faint pulse, so she got back in the vehicle and drove to the ER.

Anderson's husband, who was at work at the time, said the child has no history seizures or injuring himself and that there were no marks or injuries to the child when he bathed him around 8 p.m. the night before.

According to the complaint, Anderson admitted that she and her husband were reconsidering their summer adoption plans. Additionally, no baby monitors were found in the house despite Anderson saying she used monitors to keep an eye on the child.

An autopsy conducted by the Ramsey County Medical Examiner's Office revealed that the child had injuries to his head, face, arms, legs, chest, back, hand, foot and penis, in addition to internal injuries. A preliminary cause of death has been ruled homicide by probable asphyxia and blunt force trauma.

If the husband had any thought the child was being abuse and that is why he was going to halt the adoption he should be arrested as well.

The penalties should be harsher for foster/adoptive parent who abuse children that they are entrusted to care for since they initiated it by becoming resources to children in need.

People are not forced to become foster/adoptive parents it is a choice and honestly what money you get even at the top rate is not always worth it.

Kellie Jo Anderson, 35, rushed toddler Henry Anderson to hospital last month with bruises across his body and head, and with a cut to the inside of his lip and genitals.

The foster mom claimed that Henry, who she is related to, “threw himself several times from the bath to the toilet” on the night before his hospital admission, and said he likely suffered a seizure as a result.

Officers arrested her and allege that she tortured Henry to death.

When the toddler was admitted to hospital, suspicious medics told police that his injuries were not consistent with Ms Anderson’s story.

Henry was “blue and lifeless with bruising to the face and head”, when he arrived at the Sanford Medical Center.

The young boy’s body temperature showed that he had been dead for 40 minutes before arriving at the hospital.
An autopsy later determined that the cause of his death was asphyxiation from blunt-force trauma, and the medical examiner ruled that he was a homicide victim.

Earlier this month, Henry’s family started a GoFundMe page to buy playground equipment in his memory, and said he “touched so many hearts”.

They wrote:
“Henry was a vibrant boy, full of life and he had a smile that lit up a room.

“Henry spent a lot of time with his Grandma Kayla who loved him so much.

“Henry was a sweet and happy little boy who touched so many hearts.”

They added that their world had been “shattered”.

I wonder what the conversations were between the pre-adoptive parents.

Could the husband be so oblivious to the fact that not only did his wife not want the child she despised and wanted to hurt him.

He is responsible for safe guarding the child and he failed he should be held accountable as well.

Court documents say Henry was brought to the Sanford Emergency room ‘blue’ and lifeless, with bruising to the head and face on April 23, 2020.

Anderson told officers she and her husband were set to adopt the child later that summer.

Documents say she told police that the child ‘self-injures’ himself and said that Henry threw himself around and wouldn’t feel pain. She stated she gave the child a bath around noon that day, stating the injuries on his mouth were self-inflicted. Anderson also said the child ‘threw himself several times from the bath to the toilet.’ Anderson said she also believed the child may have seized in the bathtub or shortly after.

A preliminary autopsy stated the child likely died from asphyxia associated with blunt force trauma. The manner of death is listed as homicide.

If convicted, Anderson could spend up to 40 years in prison.

I hate that this will probably give her a lesser charge and sentence.

Why didn't she just give the baby back if she did not want him?

There would have been so many people willing to adopt this little nugget.
 
The foster mom who killed her toddler son has been sentenced to spend the next 35 years in prison.

36-year-old Kellie Jo Anderson is now convicted of second-degree murder in the death of 18-month-old Henry, who had been in her care since April 2019. Anderson told officers she and her husband were set to adopt the child later in the summer of 2020.

“This case can only be described as heinous,” Clay County Judge Jade Rosenfeldt said.

Anderson must serve at least 23 years of her sentence before she is considered for supervised probation.

“You’re a monster! I hate you so much,” a family member of Henry testified Friday afternoon.

Documents say she told police that the child ‘self-injures’ himself and said that Henry threw himself around and wouldn’t feel pain. Documents say officers then interviewed Anderson’s husband who said when he last saw the child the night before, Henry had no injuries.

Anderson’s husband also told police that Henry does not usually throw himself around and has never had a seizure before.

“It should have never happened. I think Kellie needs to have a long sentence because no one should do that to a baby,” one of Henry’s great grandmothers wrote in a statement that was read in court Friday afternoon.

“Imagine Henry’s pain when his caretaker, his foster mom, his protector and a nurse brutally and viciously murdered him,” Henry’s cousin said in a video recording to the court.

Officers noted a cut on the inside of Henry’s lip, numerous bruises on his back and side, a small bump on the child’s head, and multiple marks and bruising on the toddler’s face. Henry also had a laceration and injury to his genitals.

“When we talk about justice for Henry, that’s hard to do. What this family wants is their child back and we can’t do that,” Clay County Attorney Pam Foss said.

Foss stated Anderson’s previous comments blaming drug use for what unfolded in April 2020 would have quickly been found untrue if the case would have gone to trial.

“The biggest disappointment in my life is hurting someone I loved,” Anderson testified to the court Friday afternoon. “I’m very sorry. There is nothing I can say that will help.”

While Anderson pleaded guilty earlier last month, the state asked a Clay County Judge to consider aggravated factors in the case to give Anderson a longer prison sentence. Foss stated due to Henry’s vulnerable age, the overall cruelty of the assault, Anderson’s role as an authority/trusted figure to Henry, as well as the fact the offense happened in a zone of privacy warranted Anderson to spend 35 years in prison.

can anyone tell me what the 'with intent' part of the charge means?! I know when you get a drug charge, usually 'with intent' refers to distribution (i.e. possession with intent to distribute) but I'm not sure what 'murder with intent' would mean...
