A young mother and her boyfriend were sentenced to two years of probation for repeatedly pinching her 2-month-old daughter and covering the bruises with makeup.
The couple was living together in Dover when originally charged with abusing the baby in February for biting and pinching her on her face and thighs to quiet her cries. The baby has been placed in a foster home, officials said.
Dover police began to investigate in February after receiving a call reporting the infant possibly was being abused. The baby was taken to St. Clare's Hospital in Dover for examination of bruises on her face and thighs.
Jasmine Agens, now 19, pleaded guilty in October to hindering apprehension by admitting she covered the bruises to avoid detection. Her boyfriend, Justin Torres, now 21 pleaded guilty in October to a disorderly persons offense of simple assault on the baby by pinching her.
Agens' lawyer, Wayne Morse, told Superior Court Judge Catherine Enright it's unfair for Agens to have a felony conviction for hindering while Torres, who admitted pinching the child, was able to plead to a disorderly persons offense.
Morse and Torres' lawyer, Michael D'Alessio, characterized their clients as young people frustrated by parenthood.
"She was in a basement apartment with a crying baby, 2 months old," Morse said.
Morris County Assistant Prosecutor Melissa Ercolano said Agens, as the mother, originally was charged with endangerment by pinching her daughter and using concealer to hide the bruises. She made no attempt to protect the baby or call 911 when Torres abused the infant, Ercolano said.
"There's a certain lack of remorse here," Ercolano said of Agens. "It's all the other defendant's fault instead of her being sorry."
In a brief statement to the judge, Agens apologized and said "It will never happen again." Authorities said she has lost custody of the child.
