Jessica Martinez, who has pleaded guilty to a vehicular manslaughter charge, was sentenced to a minimum determinate period of custody of one and a half years and an indeterminate period of up to eight and a half years for a total sentence of 10 years.
Part of the sentence also suspended her driving privileges for one year after being released. An interlock system will also be installed in any vehicle used by Martinez.
The interlock will remain installed after one year has been completed, after she is released from prison, and two more years or until ordered by a court order.
After Martinez was released from prison, she was accepted to the Bonneville County Felony Treatment Court as part of a special term of her probation.
On Nov. 15, the Idaho Falls/Bonneville County Dispatch Center received a call of a traffic accident with injuries. Police determined the vehicle had traveled 310 feet after leaving the road and rolled once.
When first responders arrived they found a single vehicle at the scene with five occupants. Martinez and a 7-year-old were transported via ambulance, but the juvenile later died from injuries sustained in the accident.
The 7-year-old was ejected from the vehicle. The child was sitting in the second-row middle seat and was not restrained between two forward-facing car seats.
According to the affidavit, the boyfriend of Martinez arrived at the crash and took the other three occupants, all juveniles, to Eastern Idaho Regional Medical Center.
Police interviewed him, and he said that Martinez was angry and yelled at him for taking too long at the grocery store.
The boyfriend believed Martinez had been drinking due to her actions and attitude. Wanting to avoid a fight in front of the kids, the boyfriend went to a friend’s house and turned off his phone due to Martinez text messaging him constantly.
Police searched the vehicle and found a Crown Royal bottle lying next to the driver-side door, and Martinez told police that she had consumed half of the bottle. Martinez’s blood was drawn for evidentiary.
The affidavit states that police interviewed the three children, and the oldest, an 8-year-old, told investigators that her mother was drunk before they left the house. The children’s father has taken custody of the three children.
