The Brevard County Sheriff’s Office has arrested Tanya Galvin, 41, and Ricky Nicole Tubbs, 25, in connection with the death of a 6-month-old baby found in a plastic container.

The sheriff's office said on March 1, a deputy saw three children between the ages of 2 and 4 walking alone on Caroline Street in Cape Canaveral.

After finding out where the children lived, deputies went to the home and found Galvin asleep.

"Galvin advised that she did not know where the children were and assumed they were with Ms. Tubbs," the sheriff's office reported.

Deputies say the 2-year-old was "wet and smelled of urine."

While looking for diapers to change the child, a deputy discovered an infant, nude and unresponsive in a plastic storage container.

Deputies immediately began CPR until the arrival of paramedics.

"During CPR, water was purged from the child’s mouth and nose. The infant was transported to a local hospital where he was pronounced deceased," a news release said.

The child was identified as 6-month-old Scorpio Sharp.

An autopsy showed that he died of drowning, according to officials.

Deputies say the baby and another child under the supervision of Tubbs was placed in foster care by the Department of Children and Families (DCF).

Tubbs reportedly left the residence the night before and was to return before the children's father left for work in the morning.

When she did not return, investigators say the children's father left for work and told Tubbs to return immediately so the children would not have to be in the care of Galvin for a long period of time.

"The investigation further determined that Tubbs had consumed alcohol and narcotics during the evening and did not return to the residence, in violation of the order of DCF, until after the infant had been discovered by deputies," the news release said.

The children were reportedly alive when the children's father left for work.

Galvin is charged with aggravated manslaughter of a child and violation of probation.

She is being held at the Brevard County Jail on no bond.

Tubbs was charged with neglect of a child with great bodily harm.

Deputies said the investigation into the boy’s death led them to discover that the victim and another child had been placed in Tubbs’ care by the Department of Children and Families and her and her partner were the only two adults authorized to watch the children.

Tubbs also told DCF that no other adults lived at the home, according to a news release.

On the night before Sharp’s death, deputies said Tubbs left the children with her boyfriend for the night and the plan was that she would return in the morning before he went to work but when she didn’t arrive on time, her boyfriend called her to let her know she needed to get home and that he would be leaving the kids with Galvin, which was not allowed.

Deputies said Tubbs had been drinking alcohol and doing narcotics that night and she didn’t return home until after Sharp was discovered in the plastic container.

Records show further investigation determined that Sharp was put in a bathtub at the home and drowned while in Galvin’s care and was ultimately discarded in the children’s room. His clothes were found soaked with water, lying on the bathroom floor next to the tub.

Only one of the children was strong enough to lift Sharp and even that would have been with great difficulty that would have caused injury to the infant, according to a news release.

Galvin and Tubbs were both arrested Friday.

Galvin is accused of aggravated manslaughter of a child and violation of probation while Tubbs is facing a neglect charge.

Shouldn't the boyfriend be arrested as well for leaving the baby with thing 2.

The state really picked a winner in thing 1 to supervise this shit show.

Scorpio Sharp

In an email, a spokesperson for DCF said that in this case, “a non-relative placement was the only available option outside of a licensed foster placement. Ms. Tubbs and the other disclosed household member both passed thorough background checks, as outlined in state administrative code. It was not disclosed to the Department of Children and Families that Tanya Galvin was a household member, and therefore, she was not subject to a background screening. Additionally, locks and alarms were installed throughout the home, intended to help keep the children safe.”

The day the baby was found dead, he was left with Tanya Galvin, who investigators say had a documented history of violence, which Sheppard has questions about.

“Who knew she was living there and what was done to make sure that she was not watching the children?” Sheppard said during an interview with Jones.

DCF and its sub-contractor, Brevard Family Partnership, took Tubbs at her word that no one else lived in the apartment when a safety check was developed on Feb. 15, and the children were temporary placed with Tubbs as a non-relative. The following day, a home study was completed, and a formal placement was established.

Court records found that a warrant was issued for Galvin for violation of probation on grand theft charges. Her address listed was the apartment where the newborn died. The probation officer noted in an arrest warrant for Galvin that on or around March 7, Galvin moved from that apartment where she had been living, which was a violation of her probation because she didn’t have permission....

Scorpio Sharp was found dead on March 1. DCF stated that four welfare visits were done between Feb. 15, the date of placement, and March 1, and Galvin was not present during those visits.

Galvin is charged with aggravated manslaughter. Tubbs is charged with child neglect with great bodily harm. And DCF said there are no children currently in Tubbs’ care, and no other children will be placed in her home in the future.

There was a dispute over whether DCF would pay for the child’s burial. DCF has been now actively working with the baby’s parent and coordinating with the local community-based care lead agency to ensure he receives a proper burial.

A spokesperson for DCF called the child’s death heartbreaking and said the department offers sympathy and condolences to all who knew and loved him.

Wow. Poor Scorpio didn't last two weeks in that household. Apparently DCF does "thorough background checks" but not drug screens on its potential placement caregivers. I'd lay you 90 to nothin' Tubbs has a criminal record and Galvin's residential address isn't difficult to confirm. Another DCF fail. Hmmm...lemme do some snooping...BRB

ETA: Ricky Nicole Tubbs: *possible* assault on a pregnant woman charge from 2016. Quoted "likely associates: Tanya Latrice Galvin" and others. Ricky and Tanya's listed address is the same apartment unit in Cape Canaveral. Yeah, very "thorough background check" indeed, DCF.

Oh good. Mizz Tubbs is/was pregnant. I mean, I would say I hope they took the baby away, but clearly DCF is a garbage fire disaster sooo I wonder what will happen to the little person.
 

DCF sites three opportunities when its staff could’ve made a decision to move Scorpio and his sister prior to his death: twice during internal meetings and again during a shelter hearing.

During interviews, staff members expressed they feel pressure to utilize alternative placements in order to prevent children from entering foster care. Smith said Tubbs told her that her mom did not reside in the home. Tubbs’ herself, as a child, had been in and out of foster care, according to DCF records and the investigator said she was aware that it was because of Galvin’s substance abuse history.
