2-year-old girl died with bruises on her face, head, eye, ear, back and under her tongue, prosecutors said Tuesday. She died with a busted tooth and a brain filled with fluid and starved of oxygen.

“This is a child who had been abused and abused,” prosecutor Jill Harris said.

Evalynn Arnold died May 28, three days after her mother’s boyfriend, Robert Griffis, called 911 to report she was not breathing and was turning blue, Harris said. He also called the mother, Destiny Martin, while she was working as a baker at Walmart.

On Tuesday, Martin came to court to try for a bond. Prosecutors have presented no evidence suggesting Martin hurt her daughter, Johnson said, adding that she thinks the autopsy will show Evalynn died of natural causes or was hurt by someone else.

Martin has repeatedly said Evalynn had been banging her head against her crib, which explains her injuries, Johnson said. Martin tried to protect the girl from herself by dismantling the crib two or three days before she went to a hospital and letting her sleep on the floor.

Because Evalynn’s sibling has epilepsy, Johnson said, Martin thought her other child might be suffering from a genetic disorder.

Harris countered that Martin either hurt her daughter or knew Griffis did. The girl was covered in bruises, something neighbors and relatives noticed during the three months the couple lived in Hampton Roads. One neighbor heard the girl screaming in the middle of the night when Martin was home, about three weeks before she died.

Doctors say that’s right around the time Evalynn would’ve suffered a cut to her liver, Harris said.

It’s also around the time witnesses told investigators Evalynn stopped eating. Harris noted that the toddler weighed little for her age.

Still, Martin never got her child care.

“She was complicit,” Harris said. “She did nothing to stop it.”

After hearing about the injuries Evalynn suffered, Judge Joseph Massey denied Martin a bond.

Her mother, a 27-year-old woman who left her in a boarding room with her abuser while working as many shifts at Walmart as she could.

Other relatives and neighbors who didn’t report past abuse.

But it’s Robert Griffis, the 26-year-old who considered the girl his daughter, who needs to go to prison, prosecutor Jill Harris said Thursday in closing arguments. He’s the one who beat and suffocated 2-year-old Evalynn Arnold.

“He took away everything from that little girl,” Harris told jurors as a photo of a smiling Evalynn was shown on the screen behind her.

“Everything.”

After three days of testimony and some seven hours of deliberation, jurors agreed and convicted Griffis of four felonies: two counts of malicious wounding, child abuse resulting in serious injury, and child abuse not resulting in serious injury.

They recommended he serve 35 years in prison. Circuit Judge Mary Jane Hall will formally sentence him at a later date. Judges normally impose jurors’ recommendations.

Prosecutors said Griffis beat Evalynn and then suffocated her by putting a pillow over her face in the boarding room where they lived with Evalynn’s mother and Griffis’ girlfriend, Destiny Martin. She’s charged with child abuse and scheduled to go to trial later this month.

Griffis’ lawyers told jurors Evalynn was known to bang her head against walls and cabinets, that she often had self-inflicted bruises. No one testified they saw Griffis hit Evalynn, assistant public defender Daniel Woislaw said.

At sentencing, Harris pushed jurors to give Griffis the maximum sentence: 55 years. Defense attorney Linda McCausland nudged them toward the minimum, 13 years, noting that given his age, the maximum would be tantamount to a life sentence.

“Revenge doesn’t bring Evalynn back,” McCausland said.

On May 25, 2017, just hours after Evalynn was rushed to the hospital, Griffis told police he checked on the girl around 6:30 that morning and she was “fine,” Detective Jennifer Smith said in court documents. When he checked on her about an hour later, she was face-down in her pillow. When he picked her up she was limp, blue and not breathing.

Doctors diagnosed her with severe swelling on the brain, bruises on her head and face, as well as a lacerated liver and left kidney, Murphy said.

Evalynn died two days after arriving a the hospital.

NORFOLK, Va. - The mother of a two-year-old girl who died in May 2017 pleaded guilty in a Norfolk court Wednesday morning.

Destiny Martin was arrested along with Robert Griffis after Martin's child, Evelynn Arnold, was found unresponsive in her Norfolk home. The child died a few days later.

Griffis was convicted of child abuse and malicious wounding charges earlier this month. He was sentenced to 35 years behind bars.

Martin was originally charged with child neglect; her trial was scheduled for Wednesday. Instead of going through with a trial, Martin pleaded guilty to a lesser charge of contributing to the delinquency of a minor.

Martin will not have to serve any jail time, but she must remain on good behavior for two years and complete a parenting class. If she does not, she could serve 12 months in jail.
